After over three hours of hearing from public comment by those in attendance, the majority of whom were in favor of the measure, the City Council voted 8-7 to adopt \u201c<\/span><span style=\"font-weight: 400;\"><a href=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/05\/Danville-Illinois-Sanctuary-Cities-Ordinance-5.02.2023.pdf\">An Ordinance Adding Chapter 142 To the Danville, Illinois Code of Ordinances; Requiring Compliance With Federal Abortion Laws<\/a>.<\/span><span style=\"font-weight: 400;\">\u201d <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Mayor Rickey Williams, Jr. was the tie-breaking vote. The vote made the City of Danville the 67th city in the nation and the first in Illinois to pass a \u201csanctuary city for the unborn\u201d ordinance.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Like the \u201csanctuary for the unborn\u201d ordinances passed in <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/new-mexico-edgewood-66th-sanctuary-unborn\/\"><span style=\"font-weight: 400;\">four<\/span><\/a><span style=\"font-weight: 400;\"> cities and two counties in New Mexico, the Danville Ordinance does not explicitly ban abortion but simply requires compliance to federal statutes on abortion which prohibit the mailing or receiving of abortion-inducing drugs or abortion paraphernalia. The Danville Ordinance <\/span><span style=\"font-weight: 400;\">finds that federal law, in 18 U.S.C. \u00a7\u00a7 1461-1462, \u201cimposes felony criminal liability on every person who ships or receives abortion pills or abortion-related paraphernalia in interstate or foreign commerce\u201d and that all such acts are \u201coffenses under the federal Racketeer Influenced and Corrupt Organizations (RICO) Act.\u201d The ordinance further argues that \u201c<\/span><span style=\"font-weight: 400;\">the laws of Illinois do not and cannot secure a right, privilege or immunity to act in violation of federal criminal statutes such as 18 U.S.C. \u00a7\u00a7 1461\u201362, or to engage in criminal or racketeering conduct as defined by federal law.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Leading up to the council meeting the Danville City Council received letters from the <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/05\/2023-04-24_letter_from_aclu-il_to_danville_public_services_committee-1-1.pdf\"><span style=\"font-weight: 400;\">ACLU of Illinois<\/span><\/a><span style=\"font-weight: 400;\"> and Illinois <\/span><span style=\"font-weight: 400;\">Attorney General <a href=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/05\/2023-05-01-IL-OAG-Letter-to-Mayor-Williams.pdf\">Kwame Raoul<\/a><\/span><span style=\"font-weight: 400;\"> opposing the measure. At Tuesday night\u2019s meeting the council heard from several in opposition to the ordinance, including <\/span><a href=\"https:\/\/www.ipha.org\/\"><span style=\"font-weight: 400;\">Illinois Pharmacy Association<\/span><\/a><span style=\"font-weight: 400;\"> Executive Director Garth Reynolds and Executive Board President Carrie Wiggins. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Reynolds shared, \u201cIf city council would move forward with passing the ordinance we would be put into a position, tomorrow, to file a complaint to the Department of Financial and Professional Regulation and to the State Board of Pharmacy that the City of Danville is in violation of the [Illinois Pharmacy] Practice Act.\u201d <\/span><\/p>\n<p><span style=\"font-weight: 400;\">In her testimony, Wiggins argued the ordinance would impact mifepristone which, if prohibited from being received in Danville, would \u201churt those with Cushing\u2019s syndrome.\u201d Wiggins also shared similar concerns that the ordinance would prevent the use of misoprostol for the treatment of stomach ulcers and methotrexate for the treatment of rheumatoid arthritis. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Several attorneys also argued that the Supreme Court of the United States, in the <\/span><i><span style=\"font-weight: 400;\">Dobbs<\/span><\/i><span style=\"font-weight: 400;\"> decision, had given the issue of abortion back to the states and that these federal statutes were not applicable to the State of Illinois. However, as loud as these voices were, these voices were not in the majority on Tuesday night.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The majority of those in the packed council chambers were there in support of the City Council passing the \u201csanctuary city for the unborn\u201d ordinance. A director from <\/span><a href=\"https:\/\/www.facebook.com\/righttolifeofeasttexas\"><span style=\"font-weight: 400;\">Right To Life of East Texas<\/span><\/a><span style=\"font-weight: 400;\"> and the founder of the Sanctuary Cities for the Unborn Initiative pushed back against some of the statements made by the ACLU of Illinois, defended the Comstock Act as the Supreme Law of the Land, and argued that the Supreme Court never said that this was just a states\u2019 issue.<\/span><\/p>\n<p><a href=\"https:\/\/www.liveaction.org\/walgreens-cvs-petition\/http:\/\/\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter size-large wp-image-283198\" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/Keep-Abortion-Pill-Out-Of-Walgreens-CVSLAN-Horizontal--700x180.jpg\" alt=\"Walgreens CVS banner\" width=\"700\" height=\"180\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/Keep-Abortion-Pill-Out-Of-Walgreens-CVSLAN-Horizontal--700x180.jpg 700w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/Keep-Abortion-Pill-Out-Of-Walgreens-CVSLAN-Horizontal--300x77.jpg 300w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/Keep-Abortion-Pill-Out-Of-Walgreens-CVSLAN-Horizontal--768x197.jpg 768w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/Keep-Abortion-Pill-Out-Of-Walgreens-CVSLAN-Horizontal--500x128.jpg 500w\" sizes=\"(max-width: 700px) 100vw, 700px\" \/><\/a><\/p>\n<p><span style=\"font-weight: 400;\">The director quoted the <\/span><i><span style=\"font-weight: 400;\">Dobbs<\/span><\/i><span style=\"font-weight: 400;\"> decision which stated, <\/span><span style=\"font-weight: 400;\">\u201cThe Constitution does not prohibit the citizens of each State from regulating or prohibiting abortion. <\/span><i><span style=\"font-weight: 400;\">Roe<\/span><\/i><span style=\"font-weight: 400;\"> and <\/span><i><span style=\"font-weight: 400;\">Casey <\/span><\/i><span style=\"font-weight: 400;\">arrogated that authority. The Court overrules those decisions and returns that authority to the people and their elected representatives.\u201d<\/span><span style=\"font-weight: 400;\"> Representatives from <\/span><a href=\"https:\/\/studentsforlife.org\/\"><span style=\"font-weight: 400;\">Students for Life of America<\/span><\/a><span style=\"font-weight: 400;\"> from Indianapolis, Indiana, shared about their experiences with the abortion business known as Clinic for Women seeking to locate in Danville, and Executive Director Melanie Lyon of the Indiana-based <\/span><a href=\"https:\/\/www.thevoicesforlife.com\/\"><span style=\"font-weight: 400;\">Voices for Life<\/span><\/a><span style=\"font-weight: 400;\"> shared about Clinic for Women\u2019s long history of health violations.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Speaking of the abortion facility in Indianapolis, whose administrator has been involved in the <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/illinois-residents-fight-indiana-abortion-property-danville\/\"><span style=\"font-weight: 400;\">purchasing<\/span><\/a><span style=\"font-weight: 400;\"> of a building 85 miles away in Danville, Illinois, Lyon shared, <\/span><span style=\"font-weight: 400;\">&#8220;Voices for Life monitors all abortion facilities in Indiana for illegal activity and works to hold them accountable. There is a long history of health and safety violations in the Indiana abortion industry, and Clinic for Women is no exception. Reviewing their health inspection reports, you&#8217;ll find accounts of dusty equipment, lack of record keeping, expired drugs for patient use, and failure to sanitize medical equipment, among many other violations properly. It&#8217;s simple: Danville women deserve better.&#8221;\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Dr. Alveda King, niece of Dr. Martin Luther King Jr, also wrote a <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/05\/Letter-to-Danville.pdf\"><span style=\"font-weight: 400;\">letter<\/span><\/a><span style=\"font-weight: 400;\"> in support of the Danville Ordinance:<\/span><\/p>\n<p style=\"padding-left: 30px;\"><em><span style=\"font-weight: 400;\">The negligence of the abortion industry has been tolerated for far too long at the expense of the innocent and vulnerable, and if any change is going to be made it must start with upholding the same standards, transparency and accountability expected of all medical practitioners. Danville, if your city passes this ordinance, you will not be the first to recognize these federal statutes &#8211; nor is it likely that your city will be the last. Several federal judges have already opined with favorable statements towards these federal statutes, which many in the abortion industry consider \u2018catastrophic\u2019 to abortion access in America.<\/span><\/em><\/p>\n<p><span style=\"font-weight: 400;\">When it came time for the council to decide to adopt or reject the proposed ordinance, several council members expressed concern about the statements made by an OBGYN and the Illinois Pharmacy Association \u2013 fearing that their decision to vote in favor of the ordinance could negatively impact those in their community with postpartum hemorrhaging, Cushing\u2019s Syndrome, rheumatoid arthritis, and stomach ulcers. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Alderwoman Eve Ludwig argued that her interpretation of the ordinance was that it only prohibited the mailing and receiving of abortion-inducing drugs if those drugs were intended to be used with the \u201cpurpose to terminate the pregnancy of a woman, with knowledge that the termination by any of those means will with reasonable likelihood cause the death of an unborn child.\u201d In the end, the city council cast their votes. When the vote became a tie, Mayor Rickey Williams, Jr. voted in favor of the ordinance.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">After the council meeting, some lingering concerns from members of the City Council and a few citizens of Danville were addressed regarding the mailing and receiving of abortion-inducing drugs. Attorney Jonathan Mitchell, who has agreed to represent the City of Danville at no cost to the city and their taxpayers, shared, \u201cThis ordinance does nothing to restrict the shipment or receipt of drugs that are used for non-abortion purposes. It remains legal to ship and receive mifepristone and misoprostol if the intended use does not involve abortion.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">While the Illinois Pharmacy Association\u2019s position on the federal statutes cited in the Danville Ordinance appears to be unwavering, they are not the first Illinois organization to find themselves addressing the Comstock Act this year.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In February 2023, Attorneys General from 20 states wrote a <\/span><a href=\"https:\/\/ago.mo.gov\/docs\/default-source\/press-releases\/2023-02-01-fda-rule---walgreens-letter-danielle-gray.pdf?sfvrsn=ff1e6652_2\"><span style=\"font-weight: 400;\">letter<\/span><\/a><span style=\"font-weight: 400;\"> to Danielle Gray, who serves as the Executive Vice President of Walgreens Boots Alliance, Inc. located in Deerfield, Illinois. That letter read:<\/span><\/p>\n<p style=\"padding-left: 30px;\"><i><span style=\"font-weight: 400;\">\u201cMany people are not aware that federal law expressly prohibits using the mail to send or receive any drug that will \u201cbe used or applied for producing abortion.\u201d 18 U.S.C. \u00a7 1461. Although many people are unfamiliar with this statute because it has not been amended in a few decades, the text could not be clearer: \u201cevery article or thing designed, adapted, or intended for producing abortion \u2026 shall not be conveyed in the mails.\u201d And anyone who \u201cknowingly takes any such thing from the mails for the purpose of circulating\u201d is guilty of a federal crime. Obviously, a federal criminal law\u2014especially one that is, as here, enforceable through a private right of action\u2014deserves serious contemplation.\u201d\u00a0<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">In March 2023, America\u2019s second-largest pharmacy chain <\/span><a href=\"https:\/\/ag.ks.gov\/docs\/default-source\/documents\/dg-mifepristone-letter-to-ks-ag.pdf?sfvrsn=bc6bd1a_2\"><span style=\"font-weight: 400;\">responded<\/span><\/a><span style=\"font-weight: 400;\"> to the AGs and assured each that they did not intend to dispense mifepristone within their state or ship mifepristone into their state from any of their pharmacies.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">When covering the story, POLITICO <\/span><a href=\"https:\/\/www.politico.com\/news\/2023\/03\/02\/walgreens-abortion-pills-00085325\"><span style=\"font-weight: 400;\">quoted<\/span><\/a><span style=\"font-weight: 400;\"> the State Government Affairs Advisor for the <\/span><a href=\"https:\/\/www.pharmacist.com\/\"><span style=\"font-weight: 400;\">American Pharmacists Association<\/span><\/a><span style=\"font-weight: 400;\"> who admitted that his members were struggling to navigate the <\/span><span style=\"font-weight: 400;\">\u201cblatant contradictions between state and federal law that make it very challenging to identify what is legal and what is not legal.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Regardless of what happens in the days to come, the <\/span><a href=\"http:\/\/www.sanctuarycitiesfortheunborn.com\/\"><span style=\"font-weight: 400;\">Sanctuary Cities for the Unborn<\/span><\/a><span style=\"font-weight: 400;\"> Initiative has arrived in Illinois and Danville will likely not be the last city to pass an ordinance.
