{"id":289689,"date":"2023-04-21T14:28:10","date_gmt":"2023-04-21T19:28:10","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=289689"},"modified":"2024-09-20T12:10:37","modified_gmt":"2024-09-20T17:10:37","slug":"fact-check-response-report-children-consent","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/fact-check-response-report-children-consent\/","title":{"rendered":"Fact Check Response: What does the UN-linked report actually say about children and consent?"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><span style=\"font-weight: 400;\">The AP recently issued a <\/span><a href=\"https:\/\/apnews.com\/article\/fact-check-united-nations-report-consent-772818741019\"><span style=\"font-weight: 400;\">fact check<\/span><\/a><span style=\"font-weight: 400;\"> alleging that various <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/un-report-calls-sexual-activity-decriminalized\/\"><span style=\"font-weight: 400;\">outlets<\/span><\/a><span style=\"font-weight: 400;\"> have misrepresented information presented in a recent <\/span><a href=\"https:\/\/icj2.wpenginepowered.com\/wp-content\/uploads\/2023\/03\/8-MARCH-Principles-FINAL-printer-version-1-MARCH-2023.pdf\"><span style=\"font-weight: 400;\">report<\/span><\/a><span style=\"font-weight: 400;\"> known as the 8 March Principles written by the International Commission of Jurists (ICJ), endorsed by members affiliated with the Joint United Nations Programme on HIV\/AIDS (UNAIDS) and the United Nations Research Institute for Social Development, and launched on Wednesday, March 8 at a <\/span><a href=\"https:\/\/icj2.wpenginepowered.com\/wp-content\/uploads\/2023\/03\/CN-PRINCIPLES-joint-side-event_HRC-8-March-6-MARCH-2023.pdf\"><span style=\"font-weight: 400;\">side event<\/span><\/a><span style=\"font-weight: 400;\"> to the 52nd Session of the UN Human Rights Council.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Quoting a <\/span><a href=\"https:\/\/www.icj.org\/statement-regarding-the-8-march-principles\/\"><span style=\"font-weight: 400;\">statement<\/span><\/a><span style=\"font-weight: 400;\"> made by the ICJ on Thursday, the AP writes: \u201cThe 8 March Principles do not call for the decriminalization of sex with children, nor do they call for the abolition of a domestically prescribed minimum age of consent to sex.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Also responding to media attention given to this report, the Spokesperson for the UN Secretary General <\/span><a href=\"https:\/\/press.un.org\/en\/2023\/db230418.doc.htm\"><span style=\"font-weight: 400;\">stated<\/span><\/a><span style=\"font-weight: 400;\"> at a press briefing (emphasis added):<\/span><\/p>\n<p style=\"padding-left: 30px;\"><i><span style=\"font-weight: 400;\">I want to read something on behalf of our colleagues at the Joint United Nations Programme on HIV\/AIDS (UNAIDS), because there has been a lot of \u2014 how to say \u2014 malicious misreporting on a recent report on the age of legal consent.\u00a0 And I can tell you that the report released by the International Commission of Jurists in March has recently been misrepresented on a number of websites.\u00a0 It did not call for the decriminalization of sex with children, nor did it call for the abolition of the age of consent. The International Commission of Jurists report set out legal principles to guide the application of the international human rights law to criminal law across a range of issues.\u00a0 In the application of law, it is recognized that criminal sanctions are not appropriate against <\/span><\/i><b><i>adolescents of similar ages for consensual non-exploitative sexual activity<\/i><\/b><i><span style=\"font-weight: 400;\">.<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">Similarly, Christine Stegling, UNAIDS deputy executive director for policy, advocacy and knowledge, said in a <\/span><a href=\"https:\/\/apnews.com\/article\/fact-check-united-nations-report-consent-772818741019\"><span style=\"font-weight: 400;\">statement<\/span><\/a><span style=\"font-weight: 400;\"> to the AP: \u201cIn the application of law, it is recognized that criminal sanctions are not appropriate against adolescents of similar ages for consensual non-exploitative sexual activity.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">These comments are inadequate to assuage concerns surrounding this document.<\/span><\/p>\n<p><b>\u201cIN FACT, IF NOT IN LAW\u201d<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Nowhere in the report is any reference made to \u201cconsensual non-exploitative sexual activity\u201d between \u201cadolescents of similar ages.\u201d Instead, the report makes <\/span><a href=\"https:\/\/icj2.wpenginepowered.com\/wp-content\/uploads\/2023\/03\/8-MARCH-Principles-FINAL-printer-version-1-MARCH-2023.pdf\"><span style=\"font-weight: 400;\">reference<\/span><\/a><span style=\"font-weight: 400;\"> to \u201cadolescents\u2019 capacity to consent in certain contexts, in fact, even if not in law, when they are below the prescribed minimum age of consent in domestic law,\u201d and states, \u201csexual conduct involving persons below the domestically prescribed minimum age of consent to sex may be consensual in fact, if not in law.\u201d\u00a0<\/span><\/p>\n<div id=\"attachment_289690\" style=\"width: 710px\" class=\"wp-caption aligncenter\"><img aria-describedby=\"caption-attachment-289690\" decoding=\"async\" loading=\"lazy\" class=\"wp-image-289690 id=\"caption-attachment-289692\" class=\"wp-caption-text\">ICJ report, page 23 (Principle 16 continued)<\/p><\/div>\n<p><i><span style=\"font-weight: 400;\">Nowhere<\/span><\/i><span style=\"font-weight: 400;\"> in this document is the caveat that both parties should be of \u201csimilar ages\u201d mentioned. The question of the age of the party engaged in \u201csexual conduct involving persons below the \u2026 minimum age of consent\u201d is left unanswered. So, while the document may not <\/span><i><span style=\"font-weight: 400;\">explicitly<\/span><\/i><span style=\"font-weight: 400;\"> call for the decriminalization of sex between adults and minors, that is certainly implied, or at least left open. The language regarding \u201cconsensual non-exploitative sexual activity\u201d between \u201cadolescents of similar ages\u201d <\/span><i><span style=\"font-weight: 400;\">only<\/span><\/i><span style=\"font-weight: 400;\"> appears in comments from various UN representatives made <\/span><i><span style=\"font-weight: 400;\">after<\/span><\/i><span style=\"font-weight: 400;\"> the eruption of media furor over the document.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As <\/span><a href=\"https:\/\/c-fam.org\/turtle_bay\/checking-the-facts-about-the-march-8-principles-by-the-international-commission-of-jurists-icj\/\"><span style=\"font-weight: 400;\">noted<\/span><\/a><span style=\"font-weight: 400;\"> by C-Fam:<\/span><\/p>\n<p style=\"padding-left: 30px;\"><i><span style=\"font-weight: 400;\">The repeated use of the phrase \u201cin fact, if not in law\u201d is clearly intended to argue for laws prohibiting sex with minors to be enforced more leniently\u2014if at all\u2014in certain instances, where the argument could be made that the minor\u2019s \u201cevolving capacities\u201d render him or her effectively, if not legally, able to give consent.\u00a0 These passages notably omit any mention of whether the sexual activity involving a person under the age of 18 involves a fellow minor or a person who might be significantly older.<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">And <\/span><a href=\"https:\/\/www.nationalreview.com\/corner\/u-n-backed-report-dont-prosecute-some-adult-minor-consensual-sex\/\"><span style=\"font-weight: 400;\">according<\/span><\/a><span style=\"font-weight: 400;\"> to international lecturer and human dignity expert Wesley J Smith:<\/span><\/p>\n<p style=\"padding-left: 30px;\"><i><span style=\"font-weight: 400;\">If national laws are changed in line with this recommendation, it would essentially gut statutory-rape laws because it can only mean that if the minor consented to whatever kind of sex was engaged, it should not be prosecuted if the minor is deemed sufficiently mature to have said yes. (It is worth noting that this same approach is being pushed in Canada to grant \u201cmature minors\u201d access to euthanasia <\/span><\/i><a href=\"https:\/\/www.nationalreview.com\/corner\/canadian-parliamentary-committee-recommends-euthanasia-for-minors-without-parental-consent\/\"><i><span style=\"font-weight: 400;\">without parental consent<\/span><\/i><\/a><i><span style=\"font-weight: 400;\">.)<\/span><\/i><\/p>\n<p><b>MINORS CANNOT CONSENT TO SEX<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Furthermore, the assertion that minors can, in fact, consent to sexual activity is not accurate. <\/span><a href=\"https:\/\/time.com\/4929170\/inside-teen-teenage-brain\/\"><span style=\"font-weight: 400;\">Mainstream science<\/span><\/a><span style=\"font-weight: 400;\"> has repeatedly shown that children and adolescents do not have the cognitive and psychological <\/span><a href=\"https:\/\/www.health.harvard.edu\/mind-and-mood\/the-adolescent-brain-beyond-raging-hormones\"><span style=\"font-weight: 400;\">capacity<\/span><\/a><span style=\"font-weight: 400;\"> required to do so. <\/span><a href=\"https:\/\/www.health.harvard.edu\/mind-and-mood\/the-adolescent-brain-beyond-raging-hormones\"><span style=\"font-weight: 400;\">According<\/span><\/a><span style=\"font-weight: 400;\"> to Harvard Health Publishing:\u00a0<\/span><\/p>\n<p style=\"padding-left: 30px;\"><i><span style=\"font-weight: 400;\">[A]dolescents, compared to adults, find it more difficult to interrupt an action under way (stop speeding); to think before acting (learn how deep the water is before you dive); and even to choose between safer and riskier alternatives.\u2026 Adolescents&#8217; judgment can be overwhelmed by the urge for new experiences, thrill-seeking, and sexual and aggressive impulses.\u2026 Evidence is appearing that these differences have a definite basis in brain structure and functioning. Recent research has shown that human brain circuitry is not mature until the early 20s[.]<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">Adolescents, in other words, lack both the life experience and <\/span><a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/23998676\/\"><span style=\"font-weight: 400;\">cognitive development<\/span><\/a><span style=\"font-weight: 400;\"> required to make healthy decisions about sex and to avoid engaging in activities whose consequences they are not yet <\/span><a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/17383865\/\"><span style=\"font-weight: 400;\">ready<\/span><\/a><span style=\"font-weight: 400;\"> for.<\/span><\/p>\n<p><b>CONCLUSION<\/b><\/p>\n<p><span style=\"font-weight: 400;\">According to their own report:<\/span><\/p>\n<p style=\"padding-left: 30px;\"><i><span style=\"font-weight: 400;\">[T]he International Commission of Jurists produced successive drafts of the principles and circulated them to a wide range of expert jurists, academics, legal practitioners, human rights defenders and various civil society organizations working in diverse legal traditions, for their review. Between 2020 and 2022, a series of in-person and on-line consultations took place, until this final version of the principles was finalized and circulated for endorsement in early 2023.<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">The document as written implies that the authors feel underage sexual activity should be legally accepted.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If this report was reviewed by attorneys, with successive drafts produced, why was there no inclusion of such language regarding \u201csimilar ages\u201d in the document? Why was this language only mentioned by spokespersons <\/span><i><span style=\"font-weight: 400;\">after<\/span><\/i><span style=\"font-weight: 400;\"> the press pointed out the glaring problems in the document itself?
