That method has become even more important for pro-abortion activists after <em>Dobbs<\/em> allowed states to further restrict abortions in traditional settings.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Last week\u2019s decision stayed the Food and Drug Administration\u2019s 20-year-old approval of mifepristone, one of the medications that make up the abortion pill regimen. Alexandria Ocasio-Cortez (D-N.Y.) who told CNN that the FDA should ignore the ruling, arguing that judges were engaging in \u201can unprecedented and dramatic erosion of the legitimacy of the courts.\u201d <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Republican Rep. Moreover,\u00a0 FDA allowed its use for any reason, which overwhelmingly has nothing to do with maternal health and everything to do with not wanting a child.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Others were more critical. <\/span><a href=\"https:\/\/www.nytimes.com\/2023\/04\/10\/health\/abortion-ruling-pharma-executives.html?smtyp=cur&amp;smid=tw-nytimes\"><span style=\"font-weight: 400;\">The New York Times<\/span><\/a><span style=\"font-weight: 400;\"> reported Monday on a letter signed by more than 400 leaders of \u201csome of the drug and biotech industry\u2019s most prominent investment firms and companies.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The letter argued that Kacsymaryk undermined the authority Congress granted to the FDA and accused him of ignoring \u201cdecades of scientific evidence and legal precedent.\u201d It added that the decision created more \u201cregulatory uncertainty\u201d that would reduce \u201cincentives for investment\u201d and endanger \u201cthe innovation that characterizes our industry.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It\u2019s unclear how widely available mifepristone will ultimately be when the legal battles over the drug finish. According to Bloomberg, pharmacies are <\/span><a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2023-04-10\/abortion-pill-still-on-market-despite-judge-s-ruling-to-pull-it?srnd=premium\"><span style=\"font-weight: 400;\">continuing<\/span><\/a><span style=\"font-weight: 400;\"> to sell the pill while a judge in Washington has affirmed the FDA\u2019s approval. Two abortion businesses \u2013 Trust Women and Whole Woman\u2019s Health \u2013 <\/span><a href=\"https:\/\/twitter.com\/CAKitchener\/status\/1636413338744913920\"><span style=\"font-weight: 400;\">said<\/span><\/a><span style=\"font-weight: 400;\"> they would continue prescribing mifepristone despite the order.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cMedication abortions are still legal and available, and regardless of the outcome of this case, will remain legal and accessible,\u201d Trust Women opined on Twitter. \u201cJudge Kacsmaryk\u2019s ruling alone cannot reverse FDA approval of mife[pristone] and cannot take mife[pristone] off of the shelves.\u201d<\/span><\/p>\n<p><a href=\"https:\/\/abcnews.go.com\/Politics\/massachusetts-stockpile-abortion-pill-legal-dispute-escalates\/story?id=98472694\"><span style=\"font-weight: 400;\">At least three states<\/span><\/a><span style=\"font-weight: 400;\"> \u2013 Washington, California, and Massachusetts \u2013 have already started stockpiling abortion medication in apparent anticipation of rulings like Friday\u2019s. As Live Action News previously noted, Washington Gov. Jay Inslee (D) ordered 30,000 pill doses which, combined with another order from the University of Washington, provided a 4-year supply for the state.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">On Monday, Gov. Pritzker (D) similarly affirmed the desire to protect abortion in his state. \u201cAbortion including medication abortion remains safe, legal, and accessible in Illinois,\u201d he said, linking to an <\/span><a href=\"https:\/\/twitter.com\/GovPritzker\/status\/1645577723472154624?s=20\"><span style=\"font-weight: 400;\">article<\/span><\/a><span style=\"font-weight: 400;\"> noting that he and his attorney general said mifepristone would continue to be available in the state. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Michigan Gov. Gretchen Whitmer <\/span><a href=\"https:\/\/michiganchronicle.com\/2023\/04\/11\/governor-whitmer-addresses-abortion-pill-ruling\/#:~:text=Governor%20Gretchen%20Whitmer%2C%20who%20won,which%20prohibited%20abortions%20without%20exceptions.\"><span style=\"font-weight: 400;\">similarly said<\/span><\/a><span style=\"font-weight: 400;\"> the pill would remain available and that she had worked with insurers to maintain provision in the state. Meanwhile, some abortion providers have <\/span><a href=\"https:\/\/newhampshirebulletin.com\/2023\/04\/11\/medication-abortions-still-available-in-nh-following-texas-abortion-pill-ruling\/\"><span style=\"font-weight: 400;\">announced<\/span><\/a><span style=\"font-weight: 400;\"> they would continue providing the pill despite Friday\u2019s decision.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Alliance Defending Freedom, which represents the plaintiffs in this case, has <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/doctors-health-sue-fda-approving-abortion-drugs\/\"><span style=\"font-weight: 400;\">argued<\/span><\/a><span style=\"font-weight: 400;\"> that the FDA repeatedly botched its handling of mifepristone over the years:<\/span><\/p>\n<p style=\"padding-left: 30px;\"><em><span style=\"font-weight: 400;\">The U.S. Food and Drug Administration chose politics over science when it pushed for the legalization of the chemical abortion drugs mifepristone and misoprostol in 2000. The only way the FDA was able to approve the drugs was by characterizing pregnancy as an \u201cillness\u201d and arguing that these drugs provide a \u201cmeaningful therapeutic benefit.\u201d As the medical groups and doctors filing suit explain, by approving chemical abortion drugs, the FDA failed to abide by its legal obligations to protect the health, safety, and welfare of girls and women. <\/span><\/em><\/p>\n<p style=\"padding-left: 30px;\"><em><span style=\"font-weight: 400;\">The FDA never studied the safety of the drugs under the labeled conditions of use, ignored the potential impacts of the hormone-blocking regimen on the developing bodies of adolescent girls, disregarded the substantial evidence that chemical abortion drugs cause more complications than surgical abortions, and eliminated necessary safeguards for pregnant girls and women who undergo this dangerous drug regimen.<\/span><\/em><\/p>\n<p><span style=\"font-weight: 400;\">Some <\/span><a href=\"https:\/\/www.wsj.com\/articles\/abortion-pill-ruling-draws-muted-response-from-gop-71bbdda9\"><span style=\"font-weight: 400;\">have noted<\/span><\/a><span style=\"font-weight: 400;\"> Republicans\u2019 relative silence on the ruling, suggesting that it was a touchy subject after the decision in <\/span><i><span style=\"font-weight: 400;\">Dobbs<\/span><\/i><span style=\"font-weight: 400;\">.
