{"id":287362,"date":"2023-03-15T06:41:00","date_gmt":"2023-03-15T11:41:00","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=287362"},"modified":"2023-03-14T22:56:32","modified_gmt":"2023-03-15T03:56:32","slug":"21-republican-ags-brief-abortion-pill-lawsuit","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/21-republican-ags-brief-abortion-pill-lawsuit\/","title":{"rendered":"21 Republican AGs file brief asking court to dismiss abortion pill manufacturer\u2019s lawsuit"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><span style=\"font-weight: 400;\">A group of 21 pro-life attorneys general is defending West Virginia\u2019s abortion law, asking a district court to dismiss abortion pill manufacturer GenBioPro\u2019s \u201coutlandish\u201d <a href=\"https:\/\/archive.liveaction.org\/news\/abortion-pill-manufacturer-west-virginia-violated-constitution\/\">legal interpretation<\/a> challenging the state\u2019s restrictions.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cEach of the [\u2026] States has a sovereign interest in protecting their citizens\u2014born and unborn\u2014and has an interest in ensuring their laws are not preempted under an outlandish interpretation of the Food, Drug and Cosmetic Act (FDCA),\u201d reads last week\u2019s brief, which included Mississippi, Florida, South Dakota, and others.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Filed last week, the motion is the latest salvo in an ongoing war over post-<\/span><i><span style=\"font-weight: 400;\">Dobbs<\/span><\/i><span style=\"font-weight: 400;\"> abortion pill access across the U.S. Pro-life laws in West Virginia and North Carolina have encountered lawsuits claiming that the Food and Drug Administration\u2019s (FDA) guidance on mifepristone effectively trumps state restrictions as part of a legal concept known as pre-emption.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Texas, which also joined the motion, is currently hearing a <a href=\"https:\/\/archive.liveaction.org\/news\/doctors-health-sue-fda-approving-abortion-drugs\/\">lawsuit<\/a> in which doctors are challenging the FDA\u2019s initial authorization of the abortion pill.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The 21 attorneys general echoed West Virginia\u2019s prior motion to dismiss in arguing that GenBioPro grossly misinterpreted case law surrounding pre-emption. Both cited the Supreme Court\u2019s decision in <\/span><i><span style=\"font-weight: 400;\">Dobbs <\/span><\/i><span style=\"font-weight: 400;\">as further justification for states restricting abortion via pill within their borders.\u00a0<\/span><\/p>\n<p><a href=\"https:\/\/www.liveaction.org\/walgreens-cvs-petition\/\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter size-large wp-image-283198\" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/Keep-Abortion-Pill-Out-Of-Walgreens-CVSLAN-Horizontal--700x180.jpg\" alt=\"Walgreens CVS banner\" width=\"700\" height=\"180\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/Keep-Abortion-Pill-Out-Of-Walgreens-CVSLAN-Horizontal--700x180.jpg 700w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/Keep-Abortion-Pill-Out-Of-Walgreens-CVSLAN-Horizontal--300x77.jpg 300w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/Keep-Abortion-Pill-Out-Of-Walgreens-CVSLAN-Horizontal--768x197.jpg 768w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/Keep-Abortion-Pill-Out-Of-Walgreens-CVSLAN-Horizontal--500x128.jpg 500w\" sizes=\"(max-width: 700px) 100vw, 700px\" \/><\/a><\/p>\n<p><span style=\"font-weight: 400;\">GenBioPro\u2019s January lawsuit <\/span><a href=\"https:\/\/democracyforward.org\/wp-content\/uploads\/2023\/01\/33-0-Complaint.pdf\"><span style=\"font-weight: 400;\">argued<\/span><\/a><span style=\"font-weight: 400;\">: <\/span><\/p>\n<p style=\"padding-left: 30px;\"><em><span style=\"font-weight: 400;\">The Supreme Court\u2019s decision in Dobbs did not displace Congress\u2019s and FDA\u2019s roles in protecting the public health by deciding whether drugs are safe and effective, determining which precautions \u2014 if any \u2014 are necessary to ensure a drug\u2019s safe use, and ensuring safe and effective drugs are available to the public. Dobbs addressed only the underlying personal constitutional privacy right as it pertains to abortion; it did not speak to federal law regulating a drug maker\u2019s sale and distribution of, or a patient\u2019s access to, medication that is FDA-approved for distribution nationwide.<\/span><\/em><\/p>\n<p><span style=\"font-weight: 400;\">It adds that \u201cWest Virginia cannot override FDA\u2019s determinations about the appropriate restrictions on a medication that FDA approved for use and Congress subjected to this enhanced regulatory regime.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">GenBioPro dropped a similar lawsuit in Mississippi after the decision in <\/span><i><span style=\"font-weight: 400;\">Dobbs<\/span><\/i><span style=\"font-weight: 400;\">. While North Carolina\u2019s and West Virginia\u2019s legal battles are unfolding, it seems possible that further court battles are on their way. The judge in that case has <\/span><a href=\"https:\/\/www.washingtonpost.com\/national-security\/2023\/03\/11\/texas-abortion-pill-hearing-kacsmaryk\/\"><span style=\"font-weight: 400;\">reportedly scheduled<\/span><\/a><span style=\"font-weight: 400;\"> a hearing for Wednesday and a dozen states have already <\/span><a href=\"https:\/\/coag.gov\/press-releases\/2-24-23\/#:~:text=Feb.,miscarriages%20for%20excessively%20burdensome%20regulation.\"><span style=\"font-weight: 400;\">filed a lawsuit<\/span><\/a><span style=\"font-weight: 400;\"> accusing the FDA\u2019s abortion pill regulations of being excessively burdensome.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Extremely controversial, the abortion pill has encountered liberalized and restrictive regulations under different presidents. President Biden\u2019s FDA notably reversed its predecessor\u2019s decision to maintain the in-person dispensing requirement for the drug regimen \u2013 something pro-life advocates maintain is <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/obgyn-no-test-abortion-pill-experiments-women\/\">critical<\/a><span style=\"font-weight: 400;\"> to <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/no-test-abortion-pill-women-health-interventions\/\">prevent<\/a><span style=\"font-weight: 400;\"> potentially <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/no-test-abortion-pill-protocol-access-safety\/\">fatal<\/a><span style=\"font-weight: 400;\"> health <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/gruesome-india-case-dangers-no-test-abortion\/\">complications<\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Under Biden, however, the FDA removed those requirements, arguing that the literature indicated women could safely obtain the pill without that requirement. More recently, it released <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/fda-retail-pharmacies-abortion-pills-prescription\/\">updated guidance<\/a><span style=\"font-weight: 400;\"> allowing certified pharmacies to dispense the abortion pill. That prompted South Dakota Gov.
