Wade,<\/span><\/i><span style=\"font-weight: 400;\"> the 1973 U.S. Supreme Court decision that legalized abortion nationwide.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Dr. Eric Hazelrigg and the Alliance Defending Freedom (ADF) filed a request for the Arizona Supreme Court to overturn <\/span><a href=\"https:\/\/adflegal.org\/sites\/default\/files\/2023-03\/Planned-Parenthood-Arizona-v-Mayes-2023-03-01-Petition-For-Review-Arizona-Supreme-Court.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">a lower court\u2019s ruling last year<\/span><\/a><span style=\"font-weight: 400;\">. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cArizona is eager to preserve the innocent lives of children and restore dignity to women and the medical profession,\u201d stated Denise Harle, director of the ADF Center for Life, according to a <\/span><a href=\"https:\/\/adflegal.org\/press-release\/doctor-asks-arizona-high-court-uphold-states-pro-life-law\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">press release<\/span><\/a><span style=\"font-weight: 400;\">. \u201cSince Attorney General Mayes has said she refuses to defend the state\u2019s duly enacted pro-life law, we urge the Arizona Supreme Court to grant our petition for review and uphold this critical law that protects the lives of mothers and their children.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The pre-statehood <\/span><a href=\"https:\/\/www.azleg.gov\/ars\/13\/03603.htm\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">law<\/span><\/a><span style=\"font-weight: 400;\"> reads in part, \u201cA person who provides, supplies or administers to a pregnant woman [&#8230;] any medicine, drugs or substance, or [&#8230;] instrument or other means whatever, with intent thereby to procure the miscarriage of such woman, unless it is necessary to save her life, shall be punished by imprisonment in the state prison [&#8230;].\u201d This law was blocked after the passage of <\/span><i><span style=\"font-weight: 400;\">Roe v. Wade<\/span><\/i><span style=\"font-weight: 400;\">, but last year after the <\/span><i><span style=\"font-weight: 400;\">Dobbs v Jackson Women\u2019s Health<\/span><\/i><span style=\"font-weight: 400;\"> decision, then-Attorney General Mark Brnovich successfully sought to have the injunction on the law lifted.\u00a0<\/span><\/p>\n<p><a href=\"https:\/\/www.liveaction.org\/walgreens-cvs-petition\/\" target=\"_blank\" rel=\"noopener\"><img decoding=\"async\" loading=\"lazy\" class=\"size-large wp-image-283198 aligncenter\" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/Keep-Abortion-Pill-Out-Of-Walgreens-CVSLAN-Horizontal--700x180.jpg\" alt=\"Walgreens CVS banner\" width=\"700\" height=\"180\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/Keep-Abortion-Pill-Out-Of-Walgreens-CVSLAN-Horizontal--700x180.jpg 700w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/Keep-Abortion-Pill-Out-Of-Walgreens-CVSLAN-Horizontal--300x77.jpg 300w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/Keep-Abortion-Pill-Out-Of-Walgreens-CVSLAN-Horizontal--768x197.jpg 768w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/Keep-Abortion-Pill-Out-Of-Walgreens-CVSLAN-Horizontal--500x128.jpg 500w\" sizes=\"(max-width: 700px) 100vw, 700px\" \/><\/a><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">The 2022 court of appeals ruling decided that the pre-statehood law restricting abortions doesn\u2019t apply to <\/span><i><span style=\"font-weight: 400;\">physicians<\/span><\/i><span style=\"font-weight: 400;\">. The decision stated that the law had to be read in the context of subsequent laws, and since the legislature had passed \u201ca complex regulatory scheme to achieve its intent to restrict \u2014 but not to eliminate \u2014 elective abortions [&#8230;] reading [the pre-statehood law] to impose criminal liability for physicians providing those restricted abortions would <\/span><i><span style=\"font-weight: 400;\">eliminate<\/span><\/i><span style=\"font-weight: 400;\"> the elective abortions the legislature merely intended to <\/span><i><span style=\"font-weight: 400;\">regulate<\/span><\/i><span style=\"font-weight: 400;\"> under [other pro-life laws].\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">But Hazelrigg and the ADF argued that was nonsensical, and that there was no conflict between the pre-statehood law and later laws \u2013 such as one <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/arizona-house-abortions-15-weeks\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">passed shortly before the <\/span><i><span style=\"font-weight: 400;\">Dobbs<\/span><\/i><span style=\"font-weight: 400;\"> decision<\/span><\/a><span style=\"font-weight: 400;\"> which overturned <\/span><i><span style=\"font-weight: 400;\">Roe v. Wade<\/span><\/i><span style=\"font-weight: 400;\"> \u2013\u00a0 protecting preborn children from abortion after 15 weeks. In fact, there are\u00a0 \u201cmultiple laws forbidding physician-performed abortions,\u201d they wrote in their appeal. \u201cThe Legislature has criminalized some of the same conduct through multiple laws. That\u2019s not unusual or unconstitutional.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cArizonans deserve to have their laws fully enforced,\u201d the <\/span><a href=\"https:\/\/adflegal.org\/sites\/default\/files\/2023-03\/Planned-Parenthood-Arizona-v-Mayes-2023-03-01-Petition-For-Review-Arizona-Supreme-Court.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">ADF filing reads<\/span><\/a><span style=\"font-weight: 400;\">. \u201cThey made their voice heard at the ballot box\u2014electing Legislature after Legislature to protect life as much as possible. And lawmakers delivered. Then the appeals court rewrote [the state\u2019s pro-life law], doing with a pen what abortion proponents could not do with a vote. That\u2019s not how a republic works. Only this Court can fix it.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Planned Parenthood Arizona appears to be using any excuse to keep committing abortions in the state, despite the intent of most Arizonans.\u00a0\u201cIn December 2022, the Arizona Court of Appeals correctly harmonized all of the state legislature\u2019s laws, and under that interpretation, abortion has been and continues to remain legal in Arizona,\u201d said the CEO of Planned Parenthood Arizona, Brittany Fonteno, according to the <a href=\"https:\/\/apnews.com\/article\/abortion-arizona-doctors-625ff28be5d563a92c3952a3e2ad8b0b\" target=\"_blank\" rel=\"noopener\">Associated Press<\/a>. \u201cAs we have said time and time again, this archaic abortion ban the intervener (Hazelrigg) is trying to revive is cruel, harmful, and unpopular with the majority of Arizonans.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Pro-life organizations are celebrating this step. &#8220;The fight to protect unborn life and women from the harms of abortion does not end with an Arizona Court of Appeals ruling,&#8221; said Cathi Herrod, president of the Center for Arizona Policy, according to <\/span><a href=\"https:\/\/www.azcentral.com\/story\/news\/local\/arizona\/2022\/12\/31\/appeals-court-abortions-ok-in-arizona-up-to-15-weeks\/69767587007\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">AZ Central<\/span><\/a><span style=\"font-weight: 400;\">. &#8220;I am confident Arizona\u2019s pre-Roe law limiting abortion to cases where the mother\u2019s life is at risk will be upheld by Arizona\u2019s Supreme Court.&#8221;<\/span><\/p>\n<p style=\"text-align: center;\"><a href=\"https:\/\/give.liveaction.org\/general-donation\/?utm_source=lan&amp;utm_medium=display&amp;utm_campaign=monthly&amp;utm_content=article\"><i><strong>Did you know that as little as $10 a month is enough to reach more than 3,000 people with the truth about abortion that no one else is telling them?
