{"id":285092,"date":"2023-02-13T10:41:58","date_gmt":"2023-02-13T16:41:58","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=285092"},"modified":"2023-02-10T21:06:31","modified_gmt":"2023-02-11T03:06:31","slug":"colorado-first-law-donor-conceived","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/colorado-first-law-donor-conceived\/","title":{"rendered":"Colorado is first state to pass law regarding rights of donor-conceived persons"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><span style=\"font-weight: 400;\">In 2022, Colorado passed a <\/span><a href=\"https:\/\/leg.colorado.gov\/bills\/sb22-224\"><span style=\"font-weight: 400;\">first-of-its-kind law<\/span><\/a><span style=\"font-weight: 400;\"> establishing limited &#8220;protections&#8221; for donor-conceived persons \u2014 measures that the average person likely believes already exist in the fertility industry, but do not.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"> Requirements of the law include that sperm or egg donors agree to the release of their identity and medical information to donor-conceived persons on or after their 18th birthday, that sperm and\/or egg donor banks \u201crequest\u201d updated medical information from donors every three years, and provide written education to donors and recipients about the impacts on children conceived in this way. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Additionally, once 25 different families have received a donor\u2019s sperm or eggs, regardless of how many children are conceived within that family using the sperm or eggs, \u201c<\/span><span style=\"font-weight: 400;\">the [donor] bank shall not match or provide gametes from a donor to additional families.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Colorado donor banks will also be required to pursue and maintain licensure from the state board of health, as is routinely required for healthcare facilities across the country.<\/span><\/p>\n<h3>A staggering lack of accountability<\/h3>\n<p><span style=\"font-weight: 400;\">That a law like Colorado&#8217;s does not already exist in every state speaks volumes about the lack of regulation and accountability from an industry that proffers the promise of a person for pay, without regard to the physical or emotional wellbeing of children so created. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">As the Donor Deceived<\/span> <a href=\"https:\/\/donordeceived.org\/\"><span style=\"font-weight: 400;\">website<\/span><\/a><span style=\"font-weight: 400;\"> founded to fight fertility fraud asks, \u201c<\/span><span style=\"font-weight: 400;\">Why does a person created through donor conception have no legal right to their own donor information? Why aren&#8217;t there federal regulations requiring clinics\/doctors to properly maintaining (sic) and provide donor information?\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Wendy Kramer, founder of <\/span><a href=\"https:\/\/donorsiblingregistry.com\/\"><span style=\"font-weight: 400;\">Donor Sibling Registry<\/span><\/a><span style=\"font-weight: 400;\">, conceived a son with donor sperm and is now an outspoken advocate of the need for laws like the Colorado one. She previously told <\/span><a href=\"https:\/\/www.buzzfeednews.com\/article\/davidmack\/sperm-donor-dna-test-mix-up?origin=whttps:\/\/www.buzzfeednews.com\/article\/davidmack\/sperm-donor-dna-test-mix-up?origin=web-hfeb-hf\"><span style=\"font-weight: 400;\">Buzzfeed<\/span><\/a><span style=\"font-weight: 400;\">, \u201c<\/span><span style=\"font-weight: 400;\">I think for so many of us when we had to use a donor in order to have a child we all thought, \u2018Oh, it\u2019s the medical industry. These are medical professionals, so there\u2019s going to be the same ethics and morals and responsibilities and record-keeping.\u2019\u201d <\/span><\/p>\n<p><span style=\"font-weight: 400;\">But as Kramer learned the hard way, \u201cThese are sperm-sellers, and that\u2019s very different, and their ethics and responsibilities are very different.\u201d\u00a0<\/span><\/p>\n<p><a href=\"https:\/\/www.liveaction.org\/walgreens-cvs-petition\/\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter size-large wp-image-283198\" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/Keep-Abortion-Pill-Out-Of-Walgreens-CVSLAN-Horizontal--700x180.jpg\" alt=\"Walgreens CVS banner\" width=\"700\" height=\"180\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/Keep-Abortion-Pill-Out-Of-Walgreens-CVSLAN-Horizontal--700x180.jpg 700w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/Keep-Abortion-Pill-Out-Of-Walgreens-CVSLAN-Horizontal--300x77.jpg 300w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/Keep-Abortion-Pill-Out-Of-Walgreens-CVSLAN-Horizontal--768x197.jpg 768w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/Keep-Abortion-Pill-Out-Of-Walgreens-CVSLAN-Horizontal--500x128.jpg 500w\" sizes=\"(max-width: 700px) 100vw, 700px\" \/><\/a><\/p>\n<h3>Troubling revelations<\/h3>\n<p><span style=\"font-weight: 400;\">Live Action News has <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/sperm-donor-lied-ivf\/\"><span style=\"font-weight: 400;\">previously documented<\/span><\/a> <span style=\"font-weight: 400;\">the troubling revelations some donor-conceived children have unexpectedly received about their biological fathers\u2019 <\/span><a href=\"https:\/\/thewalrus.ca\/finding-a-father-on-facebook\/\"><span style=\"font-weight: 400;\">medical history<\/span><\/a>,<span style=\"font-weight: 400;\"> and others\u2019 <\/span><span style=\"font-weight: 400;\"><a href=\"https:\/\/donordeceived.org\/\">inability to access medical information about their donor parent altogether<\/a>\u00a0\u2014<\/span><span style=\"font-weight: 400;\">\u00a0a problem the Colorado law will ameliorate for children conceived within its borders once they turn 18. Other <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/women-learning-sperm-donor-fathered-100-children\/\"><span style=\"font-weight: 400;\">donor-conceived children<\/span><\/a><span style=\"font-weight: 400;\"> have devastatingly learned that the men they thought were their fathers <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/fertility-disaster-siblings-not-related\/\"><span style=\"font-weight: 400;\">weren\u2019t even related to them at all<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Disturbingly, stories have also emerged across the nation and the world of fertility doctors who<\/span> <a href=\"https:\/\/archive.liveaction.org\/news\/donor-conceived-children-shocked-fertility-doctors-fathers\/\"><span style=\"font-weight: 400;\">unethically impregnated female patients without their consent<\/span><\/a><span style=\"font-weight: 400;\">, and sometimes the number of an individual donor\u2019s offspring reaches into the<\/span> <a href=\"https:\/\/archive.liveaction.org\/news\/women-learning-sperm-donor-fathered-100-children\/\"><i><span style=\"font-weight: 400;\">hundred<\/span><\/i><i><span style=\"font-weight: 400;\">s<\/span><\/i><\/a><span style=\"font-weight: 400;\">. But as Devorah Goldman observed in an essay for<\/span> <a href=\"https:\/\/www.thepublicdiscourse.com\/2023\/01\/86859\/\"><span style=\"font-weight: 400;\">Public Discourse<\/span><\/a><span style=\"font-weight: 400;\">, \u201c<\/span><span style=\"font-weight: 400;\">this kind of fraud is primarily viewed as an offense against the women who are impregnated with sperm from the wrong man\u2026 For the <\/span><i><span style=\"font-weight: 400;\">children<\/span><\/i><span style=\"font-weight: 400;\"> involved, however, there is little legal recourse or consideration.\u201d (emphasis added)<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Goldman is right that children conceived via sperm or egg donation have historically been absent from conversations about the ethics and implications of commodifying the process of conception. But<\/span><span style=\"font-weight: 400;\"> increasingly, donor-conceived children are <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/woman-conceived-sperm-donor-discovers-50-siblings\/\"><span style=\"font-weight: 400;\">speaking up<\/span><\/a><span style=\"font-weight: 400;\"> for themselves and offering powerful testimony about their experiences.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A somber 2019 <\/span><a href=\"https:\/\/www.nytimes.com\/interactive\/2019\/06\/26\/magazine\/sperm-donor-siblings.html\"><span style=\"font-weight: 400;\">photo essay<\/span><\/a><span style=\"font-weight: 400;\"> for the New York Times by a 20-year-old donor-conceived man named Eli Baden-Lasar <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/mass-produced-sperm-donor\/\"><span style=\"font-weight: 400;\">put a face<\/span><\/a>\u00a0\u2014<span style=\"font-weight: 400;\">\u00a031 of them, to be exact \u2014\u00a0on the experience of children so generated. Commenting on his reaction to the knowledge that he had <\/span><i><span style=\"font-weight: 400;\">dozens<\/span><\/i><span style=\"font-weight: 400;\"> of half-siblings scattered across the country (1 of the 32 did not participate in the photo essay), he said, \u201c<\/span><span style=\"font-weight: 400;\">I felt both curious and anxious about these people and what they exactly meant to me. The sheer quantity of them gave me a feeling of having been mass-produced.\u201d <\/span><\/p>\n<p><span style=\"font-weight: 400;\">One of his half-siblings shared vulnerably, \u201cI learned that there are so many of them it\u2019s hard to feel included. I\u2019m an only child and was expecting a sibling relationship, not just like, \u2018Hey, cool, we have the same blood, whatever.\u2019\u2019 I told myself that it wasn\u2019t a big deal that I had siblings, just to numb the pain.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">And what does one <em>call<\/em> a fellow human conceived from the same donor\u2019s sperm? Baden-Lasar spoke to the complexities of this struggle: \u201cI\u2019m always hesitant to call anybody a brother or sister. But many of the other siblings use that language very loosely. I don\u2019t, probably because I already have a sister, and she will always be most important to me.\u201d <\/span><\/p>\n<h3>No longer ignoring their voices<\/h3>\n<p><span style=\"font-weight: 400;\">Groups like the newly-founded U.S. Donor Conceived Council, helmed by individuals who were themselves conceived through anonymous egg or sperm donation, are <\/span><a href=\"https:\/\/www.usdcc.org\/2022\/05\/11\/u-s-donor-conceived-council-makes-history-and-protects-donor-conceived-people-through-passage-of-bipartisan-colorado-bill\/\"><span style=\"font-weight: 400;\">striving<\/span><\/a><span style=\"font-weight: 400;\"> to make Colorado\u2019s legislation the law of the land. <\/span><span style=\"font-weight: 400;\">The USDCC celebrated \u201c<\/span><span style=\"font-weight: 400;\">the first act in the United States focused on protecting the rights of people conceived using sperm, eggs, or embryos provided by unknown third parties.\u201d <\/span><\/p>\n<p><span style=\"font-weight: 400;\">USDCC president and CEO Erin Jackson stated, \u201cMore than a million people in the United States have been created via sperm and egg donation with little consideration to their future needs or interests, including learning the identity of the person who contributed half of their DNA and having access to accurate medical information.
