{"id":283624,"date":"2023-01-18T08:45:13","date_gmt":"2023-01-18T14:45:13","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=283624"},"modified":"2023-01-17T15:48:08","modified_gmt":"2023-01-17T21:48:08","slug":"alabama-ag-prosecuted-abortion-pills","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/alabama-ag-prosecuted-abortion-pills\/","title":{"rendered":"Alabama AG clarifies remarks about who can be prosecuted for abortion pills"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>Alabama Attorney General Steve Marshall has clarified his recent statements that insinuated women in the state could be prosecuted for chemical abortions.<\/p>\n<p>Marshall responded to recent news of <a href=\"https:\/\/archive.liveaction.org\/news\/fda-retail-pharmacies-abortion-pills-prescription\/\" target=\"_blank\" rel=\"noopener\">FDA approval<\/a> for abortion pills to be dispensed at retail pharmacies like <a href=\"https:\/\/archive.liveaction.org\/news\/cvs-walgreens-announce-plans-sell-abortion-pill\/\" target=\"_blank\" rel=\"noopener\">CVS and Walgreens<\/a>. He pointed out that while the state&#8217;s Human Life Protection Act criminalizes abortionists and not women who undergo abortions, another law could potentially result in the prosecution of women taking the abortion pill.<\/p>\n<p>\u201cThe Human Life Protection Act targets abortion providers, exempting women \u2018upon whom an abortion is performed or attempted to be performed\u2019 from liability under the law,\u201d he said in a statement to <a href=\"https:\/\/archive.liveaction.org\/news\/florida-warns-pharmacists-dispense-abortion-pills\/\" target=\"_blank\" rel=\"noopener\">AL.com<\/a>. \u201cIt does not provide an across-the-board exemption from all criminal laws, including the chemical-endangerment law \u2014 which the Alabama Supreme Court has affirmed and reaffirmed protects unborn children.\u201d<\/p>\n<p><a href=\"https:\/\/give.liveaction.org\/future-of-abortion\/?utm_source=lan&amp;utm_medium=article&amp;utm_campaign=minibomb\"><b><i>For every dollar given, 34 more people can be reached with the truth about abortion. Will you join us in this life-saving work as a monthly donor today?<\/i><\/b><\/a><\/p>\n<p>Marshall likewise responded to an opinion issued by the Department of Justice which stated that postal carriers could deliver abortion pills, even in states which protect preborn children from abortion.<\/p>\n<p>\u201cPromoting the remote prescription and administration of abortion pills endangers both women and unborn children,\u201d he said. \u201cElective abortion \u2014 including abortion pills \u2014 is illegal in Alabama. Nothing about the Justice Department\u2019s guidance changes that. Anyone who remotely prescribes abortion pills in Alabama does so at their own peril: I will vigorously enforce Alabama law to protect unborn life.\u201d<\/p>\n<p>Marshall&#8217;s remarks soon caused outrage among abortion supporters, and he soon <a href=\"https:\/\/www.wsfa.com\/2023\/01\/12\/alabama-ag-clarifies-prosecution-rules-under-abortion-law\/\" target=\"_blank\" rel=\"noopener\">clarified<\/a> his remarks, saying it was abortionists, not women, who could be prosecuted. \u201cAgain, not targeting the woman herself, but in fact, targeting those providers to induce the abortion,\u201d he told WSFA. \u201cThere is a very specific provision in the law the legislator passed just a few years ago that specifically exempts the woman from criminal prosecution. It does target those who are providers.\u201d<\/p>\n<p>A number of attorneys general, including Marshall, <a href=\"https:\/\/www.al.com\/news\/2023\/01\/alabama-attorney-general-steve-marshall-urges-feds-to-reverse-decision-on-abortion-pills.html\" target=\"_blank\" rel=\"noopener\">signed a letter<\/a> urging the FDA to reconsider its decision to allow the abortion pill to be dispensed through retail pharmacies. \u201cThe Food and Drug Administration\u2019s decision to abandon commonsense restrictions on remotely prescribing and administering abortion-inducing drugs is both illegal and dangerous,\u201d the letter read. \u201cIn direct contravention of longstanding FDA practice and congressional mandate, the FDA\u2019s rollback of important safety restrictions ignores both women\u2019s health and straightforward federal statutes.
