In a roll call vote, Commissioners Roy Lee Criswell, Tina Dixon, Paul Grider, and Rodney Savage all voted in favor of the ordinance with Commissioner Dennis Lopez being the only commissioner to vote against the ordinance. The passage of the ordinance makes Roosevelt County, New Mexico (pop. 19,019) the second \u201cSanctuary County for the Unborn\u201d in New Mexico and the United States.<\/p>\n<p><a href=\"https:\/\/give.liveaction.org\/general-donation\/?utm_source=lan&amp;utm_medium=display&amp;utm_campaign=monthly&amp;utm_content=article\"><b><i>For every dollar given, 34 more people can be reached with the truth about abortion. Will you join us in this life-saving work as a monthly donor today?<\/i><\/b><\/a><\/p>\n<p dir=\"ltr\">Like the ordinance passed in <a href=\"https:\/\/archive.liveaction.org\/news\/lea-county-new-mexico-sanctuary-county-unborn\/\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/archive.liveaction.org\/news\/lea-county-new-mexico-sanctuary-county-unborn\/&amp;source=gmail&amp;ust=1673542295965000&amp;usg=AOvVaw3he5gmu2nG3MT8M-xvsDOg\">Lea County<\/a>, and like the ordinances passed in the cities of <a href=\"https:\/\/archive.liveaction.org\/news\/hobbs-first-sanctuary-city-unborn-new-mexico\/\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/archive.liveaction.org\/news\/hobbs-first-sanctuary-city-unborn-new-mexico\/&amp;source=gmail&amp;ust=1673542295965000&amp;usg=AOvVaw2SNW6spnxQlirFVL59l5f4\">Hobbs<\/a> and <a href=\"https:\/\/archive.liveaction.org\/news\/new-mexico-clovis-63rd-sanctuary-city-unborn\/\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/archive.liveaction.org\/news\/new-mexico-clovis-63rd-sanctuary-city-unborn\/&amp;source=gmail&amp;ust=1673542295965000&amp;usg=AOvVaw3_ztV_n387KYY6nairjrAc\">Clovis<\/a>, the Roosevelt County Ordinance functions as a de facto abortion ban. By requiring any abortion provider within the unincorporated area of Roosevelt County to comply with federal laws on abortion prohibiting the mailing or receiving of any abortion-inducing drugs or abortion-related paraphernalia, the ordinance makes it impossible for any abortion facility to function legally \u2014 even if they were to get their equipment or pharmaceuticals from elsewhere within the state.<\/p>\n<div id=\"attachment_283287\" style=\"width: 710px\" class=\"wp-caption aligncenter\"><img aria-describedby=\"caption-attachment-283287\" decoding=\"async\" loading=\"lazy\" class=\"size-large wp-image-283287\" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/mark-lee-dickson-roosevelt-county-nm-700x525.jpg\" alt=\"\" width=\"700\" height=\"525\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/mark-lee-dickson-roosevelt-county-nm-700x525.jpg 700w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/mark-lee-dickson-roosevelt-county-nm-300x225.jpg 300w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/mark-lee-dickson-roosevelt-county-nm-768x576.jpg 768w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/mark-lee-dickson-roosevelt-county-nm-500x375.jpg 500w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/mark-lee-dickson-roosevelt-county-nm.jpg 1200w\" sizes=\"(max-width: 700px) 100vw, 700px\" \/><p id=\"caption-attachment-283287\" class=\"wp-caption-text\">Roosevelt County, NM (Photo: Mark Lee Dickson)<\/p><\/div>\n<p dir=\"ltr\">The <a href=\"http:\/\/www.sanctuarycitiesfortheunborn.com\/\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=http:\/\/www.sanctuarycitiesfortheunborn.com&amp;source=gmail&amp;ust=1673542295965000&amp;usg=AOvVaw3-PQmALJZccZASDkgY6pGU\">Sanctuary Cities for the Unborn<\/a> ordinance, which had been <a href=\"https:\/\/archive.liveaction.org\/news\/roosevelt-new-mexico-sanctuary-county-unborn\/\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/archive.liveaction.org\/news\/roosevelt-new-mexico-sanctuary-county-unborn\/&amp;source=gmail&amp;ust=1673542295965000&amp;usg=AOvVaw1Kc9-VP1piyWoDSageA8Dw\">introduced<\/a> at their December County Commission meeting, requires everyone under jurisdiction of the county to follow federal laws on abortion \u2013 specifically 18 U.S.C. \u00a7\u00a7 1461-1462. Roosevelt\u2019s Ordinance states, \u201cIt shall be unlawful for any person to violate 18 U.S.C. \u00a7 1461 by using the mails for the mailing, carriage in the mails, or delivery of: any article or thing designed, adapted, or intended for producing abortion; or any article, instrument, substance, drug, medicine, or thing which is advertised or described in a manner calculated to lead another to use or apply it for producing abortion.\u201d<\/p>\n<p dir=\"ltr\">The ordinance continues, \u201cIt shall be unlawful for any person to violate 18 U.S.C. \u00a7 1462 by: using any express company or other common carrier or interactive computer service for carriage in interstate or foreign commerce of any drug, medicine, article, or thing designed, adapted, or intended for producing abortion\u201d as well as \u201cKnowingly taking or receiving, from such express company or other common carrier or interactive computer service, any matter or thing described.\u201d Roosevelt County\u2019s ordinance also prohibits any person from engaging in conduct which aids or abets any of these acts.<\/p>\n<p dir=\"ltr\">Unlike the ordinances which were passed in Hobbs, Clovis, and Lea County, New Mexico, the Roosevelt County ordinance is enforced through lawsuits by private citizens. The ordinance reads, \u201cAny person, other than the state, its political subdivisions, including Roosevelt County, and any officer or employee or agent of a state or local governmental entity in this state, has standing to bring and may bring a civil action against any person or entity\u201d in violation of these acts.<\/p>\n<p dir=\"ltr\">Attorney Mike Seibel with <a href=\"http:\/\/www.abortionontrial.org\/\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=http:\/\/www.abortionontrial.org&amp;source=gmail&amp;ust=1673542295965000&amp;usg=AOvVaw0NAjimWiCCf6Xue3viyn4y\">Abortion On Trial<\/a> shared, \u201cThis ordinance is a really important development for New Mexico because it allows lawsuits against any abortion provider or pharmacy within the unincorporated area of Roosevelt County which are found violating 18 U.S.C. \u00a7\u00a7 1461-1462.\u201d Seibel continued, \u201cOrdinances like this will prevent the unregulated and unsafe abortion industry from injuring women and destroying families.\u201d<\/p>\n<p dir=\"ltr\">The passage of the ordinance makes unincorporated communities of Roosevelt County like Arch, Kenna, Lingo, Milnesand, Pep, and Rogers \u201csanctuaries for the unborn.\u201d The ordinance does not apply to the incorporated cities within Roosevelt County. We have two children\u2019s homes, a pregnancy resource center, and one of our cities just approved a Safe Haven Baby Box. So this was just the next logical step in that progression towards supporting mommas and their unborn children.\u201d Smith continued, \u201cSince our courageous Roosevelt County Commission has done their part to protect residents in the unincorporated areas of our county, now is time for our city leaders to do their part in the incorporated areas of our county. Our Governor wants to make our state a destination for abortion, but that is not the will of the people of Roosevelt County. We want our county to be a destination for life and joy and hope &#8211; not darkness and despair.\u201d<\/p>\n<p dir=\"ltr\">While some have written off New Mexico as a \u201cpro-abortion\u201d state, Attorney Mike Seibel believes actions like the one taken by the Roosevelt County Commission proves otherwise. Seibel shared, \u201cThe groundswell of communities throughout New Mexico are revealing New Mexico\u2019s true nature as a pro-life state.\u201d<\/p>\n<p dir=\"ltr\">If Roosevelt County faces any litigation as a result of the passage of their ordinance, Attorney Jonathan F. Mitchell, the former Solicitor General of Texas and the architect of the Texas Heartbeat Act, has offered to represent the county at no cost to the county or taxpayers.<\/p>\n<p dir=\"ltr\">More cities and counties throughout the United States are expected to pass ordinances protecting unborn children in the weeks to come.
