The \u201cOrdinance Requiring Abortion Providers in the City of Clovis to Comply with Federal Law\u201d passed with a vote of 7-0, with one commission member choosing to abstain.<\/p>\n<p dir=\"ltr\">The passage of the ordinance did not happen overnight. It was first <a href=\"https:\/\/archive.liveaction.org\/news\/new-mexico-city-clovis-sanctuary-unborn\/\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/archive.liveaction.org\/news\/new-mexico-city-clovis-sanctuary-unborn\/&amp;source=gmail&amp;ust=1673113658741000&amp;usg=AOvVaw3xHkm6yssXbtDki-Q4nw3a\">introduced<\/a> October 13 and later <a href=\"https:\/\/archive.liveaction.org\/news\/clovis-pro-life-ordinance-halted-republican-politicians\/\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/archive.liveaction.org\/news\/clovis-pro-life-ordinance-halted-republican-politicians\/&amp;source=gmail&amp;ust=1673113658741000&amp;usg=AOvVaw3IZAQJzlSr228LeERdadJr\">tabled<\/a> at their November 3 meeting, then placed on the agenda to be untabled on December 1. At that meeting Commissioner David Bryant made the motion to untable the ordinance followed by Commissioner Juan Garza seconding the motion. The result of that motion was a tie. Commissioners David Bryant, Juan Garza, Chris Bryant, and Gene Porter in favor of untabling the ordinance and Commissioners Megan Palla, George Jones, Lauren Rowley, and Helen Casaus against untabling the ordinance \u2014 leaving Mayor Mike Morris to cast the determining vote\u00a0against untabling the ordinance.<\/p>\n<p><a href=\"https:\/\/give.liveaction.org\/general-donation\/?utm_source=lan&amp;utm_medium=display&amp;utm_campaign=monthly&amp;utm_content=article\"><b><i>For every dollar given, 34 more people can be reached with the truth about abortion. Will you join us in this life-saving work as a monthly donor today?<\/i><\/b><\/a><\/p>\n<p dir=\"ltr\">Knowing many citizens in Clovis wanted to see the ordinance passed, Commissioner Garza requested the untabling of the ordinance to be placed back on the agenda for January 5, the first city commission meeting of the new year. This time the outcome was different. Commissioner Juan Garza made the motion for the ordinance to be untabled, followed by Commissioner Chris Bryant seconding the motion. The motion passed 7-1 with Commissioner Lauren Rowley being the only commissioner voting against untabling the ordinance. Next, was the moment of truth.<\/p>\n<p dir=\"ltr\">Mayor Mike Morris shared with the Clovis Commissioners his pro-life beliefs, but expressed his disappointment with many of his constituents who did not agree with his plan to wait until after the legislative session. The Mayor wanted to see what Governor Michelle Lujan Grisham and the New Mexico Legislature would do and then pass something accordingly. Several others on the council saw no reason in waiting, however, arguing that they could always amend the ordinance if needed after the legislative session. Mayor Morris described the ongoing issue before their commision as a \u201cmajor distraction\u201d and a \u201clog jam\u201d to the operation of the City of Clovis\u2019s government. Ready for the measure to move forward, Mayor Pro-Tem Chris Bryant made the motion to untable the ordinance, which was followed by Commissioner David Bryant seconding the motion. The motion passed 7-0, with Commissioner Lauren Rowley abstaining from voting.<\/p>\n<div id=\"attachment_282961\" style=\"width: 609px\" class=\"wp-caption aligncenter\"><img aria-describedby=\"caption-attachment-282961\" decoding=\"async\" loading=\"lazy\" class=\" wp-image-282961\" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/clovis-2-700x525.jpg\" alt=\"\" width=\"599\" height=\"449\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/clovis-2-700x525.jpg 700w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/clovis-2-300x225.jpg 300w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/clovis-2-768x576.jpg 768w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/clovis-2-500x375.jpg 500w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/clovis-2.jpg 1200w\" sizes=\"(max-width: 599px) 100vw, 599px\" \/><p id=\"caption-attachment-282961\" class=\"wp-caption-text\">Photo: Mark Lee Dickson<\/p><\/div>\n<p dir=\"ltr\">The vote made the City of Clovis&#8217;s ordinance the second \u201csanctuary city for the unborn\u201d ordinance in the state and the 63rd \u201csanctuary city for the unborn\u201d ordinance passed in the nation. While the ordinance is different from the 62 other \u201csanctuary city for the unborn\u201d ordinances passed in <a href=\"https:\/\/sanctuarycitiesfortheunborn.org\/sanctuaries\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/sanctuarycitiesfortheunborn.org\/sanctuaries&amp;source=gmail&amp;ust=1673113658741000&amp;usg=AOvVaw2-liHXT_72_0KMC2XQxOPl\">61 communities<\/a> throughout Texas, Nebraska, Ohio, Louisiana, and Iowa, the ordinance \u2014\u00a0which is most like the ordinances passed in the City of <a href=\"https:\/\/archive.liveaction.org\/news\/hobbs-first-sanctuary-city-unborn-new-mexico\/\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/archive.liveaction.org\/news\/hobbs-first-sanctuary-city-unborn-new-mexico\/&amp;source=gmail&amp;ust=1673113658741000&amp;usg=AOvVaw3L96iWt8YO9b-qHxYND9HY\">Hobbs, New Mexico<\/a> and <a href=\"https:\/\/archive.liveaction.org\/news\/lea-county-new-mexico-sanctuary-county-unborn\/\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/archive.liveaction.org\/news\/lea-county-new-mexico-sanctuary-county-unborn\/&amp;source=gmail&amp;ust=1673113658741000&amp;usg=AOvVaw05TgXPDdQtLf7IeC9IxEzI\">Lea County, New Mexico<\/a> \u2014\u00a0accomplishes the same result of an abortion-free community.<\/p>\n<p dir=\"ltr\">By requiring any abortion provider within the city limits of Clovis to comply with federal laws on abortion prohibiting the mailing or receiving of any abortion-inducing drugs or abortion-related paraphernalia, the ordinance makes it impossible for any abortion facility to function legally \u2014 even if they were to get their equipment or pharmaceuticals from elsewhere within the state. This makes the Clovis Ordinance a de facto abortion ban.<\/p>\n<p dir=\"ltr\">Just as the Lubbock Ordinance stopped Planned Parenthood from performing abortions in the City of Lubbock, Texas, and the Hobbs Ordinance prevented Whole Woman\u2019s Health from starting abortions in the City of Hobbs, New Mexico, it is believed that the Clovis Ordinance will prevent CVS, Walgreens, or any abortion provider from legally receiving or distributing abortion-inducing drugs within the City of Clovis, New Mexico.<\/p>\n<p dir=\"ltr\">Originally the City of Clovis was not even thinking about the threat of CVS or Walgreens providing the abortion pill. The original concern was the abortion industry\u2019s exodus from Texas into Eastern New Mexico. Since abortion became illegal in Texas under the pre-Roe v. Wade statutes protecting preborn children from the moment of conception, abortion providers like Whole Woman\u2019s Health announced they were <a href=\"http:\/\/www.dallasnews.com\/news\/politics\/2022\/07\/06\/whole-womans-health-to-close-texas-abortion-clinics-relocate-to-new-mexico\/\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=http:\/\/www.dallasnews.com\/news\/politics\/2022\/07\/06\/whole-womans-health-to-close-texas-abortion-clinics-relocate-to-new-mexico\/&amp;source=gmail&amp;ust=1673113658741000&amp;usg=AOvVaw1OQjUk__xZ4CHfHBQo1gFX\">closing<\/a> their facilities in Fort Worth, McKinney, Austin, and McAllen and were relocating to Eastern New Mexico. Whole Woman\u2019s Health President and CEO Amy Hagstrom Miller shared with <a href=\"https:\/\/www.newsweek.com\/2022\/09\/16\/abortion-clinics-rush-relocate-friendlier-border-towns-bans-start-1739169.html\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.newsweek.com\/2022\/09\/16\/abortion-clinics-rush-relocate-friendlier-border-towns-bans-start-1739169.html&amp;source=gmail&amp;ust=1673113658741000&amp;usg=AOvVaw3hpjEOIBYrfEtv-4KbZkwE\">Newsweek<\/a>, \u201cWe\u2019d like to be in a border community because so many of our patients in Texas have been displaced. [Eastern New Mexico cities such as] Clovis, Hobbs and Roswell would be closer to Texas but those are small towns and there\u2019s not a lot of real estate.\u201d<\/p>\n<p dir=\"ltr\">According to the <a href=\"https:\/\/www.wsj.com\/articles\/in-states-where-abortion-is-legal-some-cities-look-to-restrict-access-11671749172\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.wsj.com\/articles\/in-states-where-abortion-is-legal-some-cities-look-to-restrict-access-11671749172&amp;source=gmail&amp;ust=1673113658741000&amp;usg=AOvVaw30dNRO4usS8cdpSr2P3PGu\">Wall Street Journal<\/a>, Miller admitted they were originally looking at \u201cHobbs and other towns close to the New Mexico-Texas border,\u201d but instead settled on Albuquerque. Miller shared, \u201cIt became a calculus of let\u2019s go to a place where we know we can be open, and we know we can be safe.\u201d<\/p>\n<p dir=\"ltr\">Despite CVS and Walgreens not being the original concern, the ordinance applies to CVS and Walgreens just as much as it applies to an abortion giant like Whole Woman\u2019s Health or Planned Parenthood. The ordinance is the first ordinance passed since CVS and Walgreens <a href=\"https:\/\/archive.liveaction.org\/news\/cvs-walgreens-announce-plans-sell-abortion-pill\/\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/archive.liveaction.org\/news\/cvs-walgreens-announce-plans-sell-abortion-pill\/&amp;source=gmail&amp;ust=1673113658741000&amp;usg=AOvVaw3MGjlLtaj88TGioeu5CUPW\">announced<\/a> their intent to distribute abortion-inducing drugs. Per the Clovis Ordinance, if CVS and Walgreens desire to legally distribute abortion-inducing drugs at their Clovis location they will have to apply for a license with the city of Clovis agreeing to comply with 18 U.S.C. \u00a7\u00a7 1461\u201362 which the Clovis Commission has found to \u201cimpose felony criminal liability on every person who ships or receives abortion pills or abortion-related paraphernalia in interstate or foreign commerce\u201d recognizing all such acts to be \u201cpredicate offenses under the federal Racketeer Influenced and Corrupt Organizations (RICO) Act.\u201d<\/p>\n<p dir=\"ltr\">The ordinance is also the first ordinance passed since the United States Department of Justice released an <a href=\"https:\/\/www.justice.gov\/olc\/opinion\/file\/1560596\/download\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.justice.gov\/olc\/opinion\/file\/1560596\/download&amp;source=gmail&amp;ust=1673113658741000&amp;usg=AOvVaw1I9BN0aVyQh8nHL1BkFhm1\">opinion<\/a> on 18 U.S.C. \u00a7\u00a7 1461\u201362 from Christopher Schroeder, Assistant Attorney General from the Office of Legal Counsel. The opinion appears to be in line with President Biden\u2019s pre-Dobbs <a href=\"http:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2021\/01\/22\/statement-from-president-biden-and-vice-president-harris-on-the-48th-anniversary-of-roe-v-wade\/\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=http:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2021\/01\/22\/statement-from-president-biden-and-vice-president-harris-on-the-48th-anniversary-of-roe-v-wade\/&amp;source=gmail&amp;ust=1673113658741000&amp;usg=AOvVaw0zsAEuPm6vCzhCq4kYNAnf\">commitment<\/a> of \u201cabortion access in every zip code\u201d and is recognized by the Sanctuary Cities for the Unborn Initiative as an attempt to discourage more governments from utilizing these federal statutes which Congress does not currently have the votes to repeal.<\/p>\n<div id=\"attachment_282964\" style=\"width: 710px\" class=\"wp-caption aligncenter\"><img aria-describedby=\"caption-attachment-282964\" decoding=\"async\" loading=\"lazy\" class=\"size-large wp-image-282964\" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/clovis-4-700x379.jpg\" alt=\"\" width=\"700\" height=\"379\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/clovis-4-700x379.jpg 700w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/clovis-4-300x163.jpg 300w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/clovis-4-768x416.jpg 768w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/clovis-4-500x271.jpg 500w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/clovis-4.jpg 1200w\" sizes=\"(max-width: 700px) 100vw, 700px\" \/><p id=\"caption-attachment-282964\" class=\"wp-caption-text\">Attorney Mike Seibel (center) takes a celebratory picture with Clovis residents after the historic vote. (Photo: Mark Lee Dickson)<\/p><\/div>\n<p dir=\"ltr\">Attorney Mike Seibel, who serves as General Counsel for <a href=\"https:\/\/www.abortionontrial.org\/\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.abortionontrial.org\/&amp;source=gmail&amp;ust=1673113658741000&amp;usg=AOvVaw2YMYpSaIjOj6gi1Bx68PJa\">Abortion On Trial<\/a> based in Albuquerque, was present at the historic commission meeting. Seibel shared, \u201cClovis passing this ordinance is a huge victory for the New Mexico pro-life community. This increases the momentum in a State where a majority of its citizens are pro-life.\u201d Seibel continued, \u201cThe citizens of Clovis acted like the persistent widow in the Gospel of Luke and kept pleading with their lawmakers for justice until they finally conceded to their demands. I cannot express enough gratitude for their persistence.\u201d The effort in Clovis was largely led by pastors whose congregations were in full support of the ordinance.<\/p>\n<p dir=\"ltr\">If Clovis faces any litigation as a result of the passage of the ordinance, Attorney Jonathan F. Mitchell, the architect of the Texas Heartbeat Act, has agreed to represent the city at no cost to the city and taxpayers.<\/p>\n<p dir=\"ltr\"><a href=\"https:\/\/pledge.liveaction.org\/?utm_source=lan&amp;utm_medium=email&amp;utm_campaign=prolife_pledge\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter size-large wp-image-277267\" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2022\/10\/pledge-live-action-ad-970x250-700x180.jpg\" alt=\"\" width=\"700\" height=\"180\" \/><\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Disclaimer: The views and opinions expressed in this article are those of the guest author and not necessarily of Live Action or Live Action News.
