Brian Kemp, on Friday, the office of Georgia\u2019s pro-life Attorney General Chris Carr asked the Georgia Supreme Court to immediately reverse the November 15th<\/sup>\u00a0ruling by a Superior Court judge that blocked enforcement of the state\u2019s Heartbeat Bill which would protect unborn children from abortion once an unborn child\u2019s heartbeat can be detected.<\/p>\n

Covering the story for the Associated Press<\/em>, Sudhin Thanawal<\/a>\u00a0wrote:<\/p>\n

Fulton County Superior Court Judge Robert McBurney\u2019s decision earlier this week was \u2018remarkable\u2019 and relied on a \u2018wholly unsupported theory that has no basis in law, precedent, or common sense,\u2019 the state attorney general\u2019s office said in court documents filed with the Georgia Supreme Court.<\/em><\/p>\n

It asked the high court for an order immediately putting McBurney\u2019s decision on hold while the justices take more time to consider an appeal. Such an order would restore the state\u2019s ban on abortion, which started roughly six weeks into pregnancy.<\/em><\/p>\n

Georgia Solicitor General Stephen Petrany wrote, \u201cThe harm to the state is significant and irreparable \u2026 Unborn children are at risk every day that the injunction continues. \u2026This Court should stay the lower court\u2019s decision now, without waiting to overrule it months down the line, while untold numbers of unborn children suffer the permanent consequences.\u201d<\/p>\n

Judge McBurney\u2019s 15-page-long decision was a real head scratcher. Maya T. Prabhu<\/a>, of The Atlanta Journal-Constitution, <\/em>wrote:<\/p>\n

Attorneys representing abortion rights activists and providers, last month argued<\/a> that when the law passed in 2019, Roe v. Wade \u2014 the 1973 U.S. Supreme Court ruling that guaranteed a right to an abortion until a fetus was viable outside the mother\u2019s body \u2014 was the law of the land and state law does not allow the Legislature to enact statutes that violate the law.<\/em><\/p>\n

A ruling by the 11th U.S. Circuit Court of Appeals in July allowed<\/a> Georgia\u2019s 2019 abortion law to be enforced. The U.S. Supreme Court\u2019s June decision<\/a> to overturn Roe v. Wade in Dobbs v. Jackson Women\u2019s Health Organization paved the way for Georgia\u2019s law to take effect.<\/em><\/p>\n

McBurney said that just because the Dobbs decision overturned the nearly 50-year-old Roe decision, it did not retroactively make the 2019 passage of Georgia\u2019s abortion law legal.<\/em><\/p>\n

Thanawala, quoting from the decision, wrote that McBurney declared that two key parts of the law \u201cwere plainly unconstitutional when drafted, voted upon, and enacted\u201d because the state passed the restriction on the procedure before the Supreme Court overturned Roe<\/em>\u2019s federal abortion protections.<\/p>\n

But in their appeal, attorneys for the state said it doesn\u2019t matter whether the law was not constitutional when it passed the General Assembly in 2019. It is \u201cnow in line with the law as established by the Dobbs decision,\u201d according to Prabhu.<\/p>\n

\u201cThe Superior Court fundamentally misunderstood the role of courts, which merely interpret law in the course of issuing judgments in individual cases,\u201d attorneys wrote in the appeal. \u201cCourts do not amend the constitution, and the constitution does not change simply because a court\u2019s view of it changes.\u201d<\/p>\n
