{"id":280238,"date":"2022-11-25T13:44:25","date_gmt":"2022-11-25T19:44:25","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=280238"},"modified":"2022-11-22T18:27:42","modified_gmt":"2022-11-23T00:27:42","slug":"kentucky-supreme-court-pro-life","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/kentucky-supreme-court-pro-life\/","title":{"rendered":"Kentucky Supreme Court hears oral arguments regarding constitutionality of state&#8217;s pro-life laws"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>(<a href=\"https:\/\/lc.org\/newsroom\/details\/112122-battle-for-unborn-life-continues-in-kentucky\" target=\"_blank\" rel=\"noopener\">Liberty Counsel<\/a>) The Kentucky Supreme Court heard oral arguments last Tuesday in\u00a0<i>Cameron v. EMW Surgical Center<\/i>\u00a0over whether the state\u2019s pro-life laws should remain in place while a legal challenge continues in court.<\/p>\n<p>The legal challenge before the state Supreme Court was initially filed in a circuit court in June by Kentucky\u2019s two abortion facilities, EMW Women\u2019s Surgical Center and Planned Parenthood, after the state\u2019s trigger law and six-week abortion ban became law. The trigger law criminalizes abortion in all circumstances except in medical emergencies that threaten the life of a woman and the six-week heartbeat law which bans abortion after the sixth week of pregnancy, typically when the baby\u2019s heartbeat is first detected.<\/p>\n<p>The decision before the Kentucky Supreme Court is whether to reinstate an injunction against the trigger and six-week bans that will last until the state\u2019s judicial system reaches a decision about whether those laws are unconstitutional. If the court blocks the bans, that temporarily would restore abortion access in the state.<\/p>\n<p>This oral argument occurred one week after voters defeated\u00a0<a href=\"https:\/\/ballotpedia.org\/Kentucky_Constitutional_Amendment_2,_No_Right_to_Abortion_in_Constitution_Amendment_(2022)#Text_of_measure\" target=\"_blank\" rel=\"noopener\">Kentucky&#8217;s Amendment 2<\/a>\u00a0which would have amended the state constitution to explicitly state it doesn&#8217;t \u201csecure or protect a right to abortion or require the funding of abortion.\u201d<\/p>\n<p>Liberty Counsel\u00a0<a href=\"https:\/\/lc.org\/100422KentuckyAmicusBriefSIGNED.pdf\" target=\"_blank\" rel=\"noopener\">filed<\/a>\u00a0an amicus brief at the Kentucky Supreme Court in\u00a0<i>Cameron v. EMW Surgical Center<\/i>\u00a0on behalf of the National Hispanic Christian Leadership Conference (NHCLC) and the Frederick Douglass Foundation in defense of the state\u2019s pro-life laws by arguing that the Kentucky Constitution protects life and not abortion.<\/p>\n<p><b>URGENT:\u00a0<\/b><a href=\"https:\/\/give.liveaction.org\/future-of-abortion\/?utm_source=lan&amp;utm_medium=article&amp;utm_campaign=minibomb\"><b><i>For every dollar given, 34 more people can be reached with the truth about abortion. Will you join us in this life-saving work as a monthly donor today?<\/i><\/b><\/a><\/p>\n<p>Liberty Counsel\u2019s amicus brief in\u00a0<i>Daniel Cameron in his official capacity as Attorney General of the Commonwealth of Kentucky v. EMW Women&#8217;s Surgical Center, P.S.C., et al.\u00a0<\/i>emphasizes \u201cthe eugenics-based abortion industry denies the fact that each human being has inherent value and dignity that is bestowed on them by their Creator. Instead, it leaves to government decision-makers the determination of when or if human life has worth and value.\u201d<\/p>\n<p>This broad group of African Americans and Hispanics represents tens of millions of constituents. These minority communities have been the direct target of abortion, and most Planned Parenthood\u2019s abortion clinics are located in black and Hispanic neighborhoods. Liberty Counsel also filed an amicus brief on behalf of the NHCLC and the Frederick Douglass Foundation at the U.S. Supreme Court in the\u00a0<i>Dobbs<\/i>\u00a0abortion case. In overturning\u00a0<i>Roe v. Wade<\/i>\u00a0and\u00a0<i>Planned Parenthood v. Casey<\/i>, the High Court cited to this brief acknowledging that abortion has disproportionally impacted the black community.<\/p>\n<p>Liberty Counsel\u2019s amicus brief states that, \u201cProhibiting abortions protects all developing human beings from racially motivated termination while in the womb. As Justice Thomas noted, today\u2019s \u2018[t]echnological advances have only heightened the eugenic potential for abortion, as abortion can now be used to eliminate children with unwanted characteristics, such as a particular sex or disability.\u2019 Thus, abortion may now be used as \u2018a disturbingly effective tool for implementing the discriminatory preferences that undergird eugenics.\u2019 For that reason, Kentucky has a compelling interest in \u2018preventing abortion from becoming a tool of modern-day eugenics.\u2019\u201d<\/p>\n<p>In defense of the unborn during Tuesday\u2019s hearing, Kentucky Solicitor General Matthew Kuhn stated, \u201cThe Attorney General respectfully urges the Court not to go down that path and not to create the Kentucky version of\u00a0<i>Roe v. Wade.\u201d<\/i><i>\u00a0<\/i><\/p>\n<p>Kuhn said, \u201cWhen it comes to abortion, our constitution here in Kentucky is simply silent. There\u2019s not a shred of historical evidence\u2026none from this Court\u2019s case law and none from our constitutional debates that suggests our constitution implicitly protects abortion. Our constitution leaves the issue of abortion, a divisive one, to the General Assembly.\u201d<\/p>\n<p>Kuhn also addressed the recent defeated pro-life ballot initiative, Amendment 2, and said, \u201cThe effect of the Second Amendment if it was adopted, would have made explicit, what we argued is already implicit in our Constitution.\u201d<\/p>\n<p>Justice Lisabeth T. Hughes responded, \u201cBut it strikes me that a ballot initiative is the purest form of democracy. Why are you suggesting that it (the initiative) has no impact?\u201d<\/p>\n<p>Justice Michelle M. Keller also stated, \u201cI agree with you that the words of the Constitution are what they were before November 8<sup>th<\/sup>, and they remain what they were subsequent to November 8<sup>th<\/sup>. And you ask us to ignore that vote when approaching this constitutional question today.\u201d<\/p>\n<p>Attorney Heather Getnarick for EMW Women\u2019s Clinic, arguing in favor of abortion said, \u201cPatients irreparable injury includes being forced to remain pregnant against their will. The patients constitutional right to abortion is inextricably bound up with the providers ability to provide that care.\u201d<\/p>\n<p>Getnarick also stated, \u201cThere are very real harms happening right now while these laws are not enjoined.\u00a0I am not suggesting that there would be no line drawing&#8230;There would be some point at which bans after a certain gestational age would be upheld because at that point the State&#8217;s interest would be compelling enough.\u201d<\/p>\n<p>Justice Laurance B. VanMeter responded regarding when life should be protected, \u201cWhy is&#8230;the line drawing exercise ultimately for the legislature&#8230;.isn\u2019t that ultimately the role of the legislature in public policy?<\/p>\n<p>Building up to a question about how the pro-abortion counsel gets around privacy not being interpreted to include a right to an abortion, Justice VanMeter asked, \u00a0\u201cHow do you address the argument that there was more or less a total abortion ban in 1910 very close in time to the 1891 constitution that was in place for 63 years until\u00a0<i>Roe v. Wade<\/i>&#8230;.So, if there\u2019s a right to privacy and self-determination that exists now it had to exist then.\u201d<\/p>\n<p>Liberty Counsel\u2019s Founder and Chairman Mat Staver said, \u201cSince the horrible abortion decisions were finally overturned at the U.S. Supreme Court on June 24, now the battle to protect life continues in Kentucky and in other states.
