The arguments will determine if the law can stand while the lawsuit, which challenges its constitutionality, plays out in court.<\/p>\n<p>The state&#8217;s trigger law, which protects nearly all preborn children from abortion, went into effect following the Supreme Court&#8217;s overturn of <em>Roe v. Wade<\/em>\u00a0in <em>Dobbs v. Jackson Women&#8217;s Health Organization<\/em>. It was immediately challenged by the abortion industry in the case\u00a0<i>Cameron v. EMW Surgical Center.\u00a0<\/i>While the law was initially blocked, an August\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/appeals-court-kentucky-protect-most-vulnerable\/\" target=\"_blank\" rel=\"noopener\">appeals court ruling<\/a>\u00a0allowed the law to stand, halting most abortions in the state. Following Tuesday&#8217;s hearings, the court will decide whether or not to uphold the appeals court ruling or place an injunction on the law, which would allow abortions to resume.<\/p>\n<p>The argument, as in many states, seems to hinge on the nebulous &#8220;right to privacy&#8221; in state constitutions, used by abortion activist groups to promote the alleged &#8220;right&#8221; to kill a human being in the womb.<\/p>\n<p><b>URGENT:\u00a0<\/b><a href=\"https:\/\/give.liveaction.org\/future-of-abortion\/?utm_source=lan&amp;utm_medium=article&amp;utm_campaign=minibomb\"><b><i>For every dollar given, 34 more people can be reached with the truth about abortion. Will you join us in this life-saving work as a monthly donor today?<\/i><\/b><\/a><\/p>\n<p>\u201cWe believe within that right to privacy and the right to self-determination, to determine what\u2019s best for your own future and your own body is also the right to access abortion,\u201d ACLU of Kentucky Communications Manager, Samuel Crankshaw told <a href=\"https:\/\/www.wkyt.com\/2022\/11\/15\/ky-supreme-court-set-hear-arguments-abortion-ban-tuesday\/\" target=\"_blank\" rel=\"noopener\">WKYT<\/a>. In other words, abortion is not an enumerated &#8220;right&#8221; in the state; abortion groups just want the law to be <em>interpreted<\/em> to include it as such.<\/p>\n<p>While the state legislature has passed the law ensuring protections for the preborn, Kentucky voters <a href=\"https:\/\/archive.liveaction.org\/news\/election-abortion-right-states\/\" target=\"_blank\" rel=\"noopener\">recently rejected<\/a> Amendment 2, which would have ensured that abortion is <em>not<\/em> a right in the state constitution. Had it passed, the ambiguous &#8220;privacy&#8221; interpretation would be moot.<\/p>\n<p>Kentucky Right to Life Executive Director Addia Wuchner told WKYT that she hopes the court retains its focus on the current Kentucky constitution.<\/p>\n<p>\u201cFrom the judicial side of it, the justices should be ruling on the Constitutionality. Not on what\u2019s popular,\u201d she said. \u201cWe\u2019re there because we have stated from the very beginning, there\u2019s not a right, an explicit right, to an abortion as the constitution stands right now.
