In August 2022<\/span>, <\/span>attorneys with <\/span>Alliance Defending Freedom<\/span><\/a> (ADF)<\/span>\u00a0filed a <\/span>brief<\/span><\/a> with the Polk County District Court on behalf of Governor Reynolds and the state of Iowa<\/span>, arguing that due to the Iowa Supreme Court\u2019s June 2022 <\/span>decision<\/span><\/a>\u00a0reversing its 2018 opinion that found a \u201cconstitutional right to an abortion\u201d in Iowa, as well as the U.S. Supreme Court’s\u00a0<\/span>reversal of Roe v. Wade<\/span><\/a> and Planned Parenthood v. Casey<\/span>,\u00a0the District Court should remove the injunction against Iowa’s Fetal Heartbeat Law<\/a>\u00a0and\u00a0allow the legislation to take effect. On October 28, ADF formally asked Polk County District Court Judge Celene Gogerty<\/a>\u00a0to lift the 2019 injunction<\/a> on the law.<\/span><\/p>\n

ADF is representing Governor Reynolds and the state because Iowa\u2019s long-time Attorney General Tom Miller has refused to defend the law because of his <\/span>pro-abortion views<\/span><\/a>. He failed to defend the <\/span>law<\/span> in <\/span>2018<\/span><\/a> and again in <\/span>2022<\/span><\/a>, and has faced no repercussions \u2014 not even a pay decrease \u2014 for his refusal to defend the law. In 2018, the <\/span>Thomas More Society<\/span><\/a> represented Governor Reynolds and the state; both the <\/span>Thomas More Society<\/span><\/a>\u00a0and\u00a0<\/span>Alliance Defending Freedom<\/span><\/a>\u00a0have provided their services pro bono.\u00a0<\/span><\/p>\n

ADF Attorney Christopher Schandevel <\/span>told<\/span><\/a> Judge Gogerty, \u201cBecause now that there is no fundamental right to an abortion in the state of <\/span>Iowa’s Constitution<\/span><\/a> or the <\/span>U.S. Constitution<\/span><\/a>, now it is clear that strict scrutiny is no longer the test, and now that it’s clear that the viability line is no more, faithfully applying Iowa binding law requires the court to reach a different result.”<\/span><\/p>\n

During the trial proceedings, Judge Gogerty asked the attorneys if she had the power to <\/span>reverse the injunction<\/span><\/a>. \u201cHow can a district court tell the Supreme Court? I don\u2019t have the authority to do that, do I?\u201d She wondered aloud whether or not a District Court Judge has the \u201c<\/span>jurisdiction to reverse the injunction<\/span><\/a>\u201d or can determine a \u201c<\/span>new legal standard<\/span><\/a>\u201d in Iowa to protect abortion. In closing, she announced she would release her decision by the end of two months.<\/span><\/p>\n

Iowa’s\u00a0<\/span>law<\/span><\/a>, s<\/span>igned by pro-life Governor Kim Reynolds in 2018, protects preborn children after a heartbeat can be detected, at approximately six weeks into a pregnancy. The <\/span>law<\/span><\/a> allows for <\/span>several exceptions<\/span><\/a>. The <\/span>ACLU, Iowa\u2019s Planned Parenthood, and Emma Goldman Abortion Clinic in Iowa City<\/span> promptly <\/span>sued<\/span><\/a>. <\/span>On<\/span> June 1, 2018, <\/span>a few weeks after the bill’s signing, <\/span>Polk County District Court Judge Michael Huppert issued an injunction, blocking enforcement of the lifesaving\u00a0<\/span>legislation<\/span><\/a>.<\/span><\/p>\n

Several months later, Judge Huppert <\/span>ruled<\/span><\/a> that there was “a <\/span>fundamental right to abortion<\/span><\/a> under the state constitution and that abortion restrictions must meet the strict scrutiny standard\u201d based on the 2018 <\/span>Iowa Supreme Court decision<\/span><\/a> that held a woman has \u201c<\/span>a fundamental right to an abortion<\/span><\/a>.\u201d The judge said the law \u201ccould not meet that <\/span>test<\/span><\/a>\u201d <\/span>and permanently enjoined the state, disallowing the implementation of the l<\/span>aw<\/span>. Governor Reynolds <\/span>declined to appeal<\/span><\/a> his decision and the injunction still stands.<\/span><\/p>\n

At the time of the bill’s\u00a0<\/span>passage, it was referred to as \u201c<\/span>the <\/span>most stringent, comprehensive abortion ban in the nation<\/span><\/a>.\u201d<\/span> Since 2018, <\/span>other states<\/span><\/a> have passed similar legislation, with varying degrees of success. The laws have been implemented and are now saving countless lives in <\/span>some states<\/span><\/a>. In others, the bills, signed into law, are mired in <\/span>court challenges<\/span><\/a>.<\/span><\/p>\n

Despite Attorney Schandevel pointing to both the <\/span>Iowa<\/span><\/a> and <\/span>U.S. Supreme Court<\/span><\/a> rulings to overturn the long-touted \u201cconstitutional right to an abortion,\u201d the ACLU of Iowa’s legal director and Planned Parenthood attorney Rita Bettis Austen\u00a0<\/span>argued<\/span><\/a> that the law<\/span>\u00a0\u201cwas unconstitutional when it passed” and \u201cremains unconstitutional today.\u201d<\/span><\/p>\n

Since the reversal of\u00a0<\/span>Roe<\/span><\/a>, abortion activists and the complicit mainstream media peddle the falsehood that laws like these criminalize women – imprisoning them for having an abortion. However, even the pro-abortion Associated Press had to admit that this is not true. Buried in the very last sentence of a lengthy article, their writer acknowledges that none of the heartbeat bills in the nation punish women who have an abortion. She <\/span>wrote<\/span><\/a>\u00a0that\u00a0pregnant women \u201c… are not held liable under any of the laws.\u201d Pro-life laws frequently penalize an abortionist, but not women.<\/span><\/p>\n

Currently an <\/span>abortion sanctuary state<\/span><\/a>, pregnant women allegedly travel to Iowa from as far as <\/span>Texas and Louisiana<\/span><\/a> for abortions up to the 20th week of pregnancy. Iowa’s <\/span>abortion sanctuary status<\/span><\/a> would change if the judge, who is <\/span>not affiliated with a political party<\/span><\/a>, were to lift the injunction, allowing the <\/span>pro-life protections<\/span><\/a>\u00a0to stand.\u00a0<\/span>If she does so, her decision will save many lives from abortion.<\/span><\/p>\n
