According to the <\/span>National Catholic Register<\/span><\/a> (NCR) and <\/span>Catholic News Agency<\/span><\/a> (CNA), <\/span>Robert Dell\u2019Oro<\/span><\/a>, a member of the <\/span>Pontifical Academy for Life<\/span><\/a>, has publicly criticized the U.S. Supreme Court’s\u00a0<\/span>Dobbs<\/span><\/i> decision and urged support for legal abortion prior to the possibility of fetal pain. He made his comments during\u00a0a recent panel discussion hosted by Loyola Marymount University, a Jesuit institution where Dell\u2019Oro is a moral theology professor and holds the O\u2019Malley Chair in Bioethics.<\/span><\/p>\n

During the October 12th panel discussion, entitled \u201c<\/span>Confronting the Dobbs Decision: A Conversation About the Legality of Abortion<\/span><\/a>,\u201d Dell\u2019Oro <\/span>suggested<\/span><\/a> that that the Supreme Court\u2019s landmark decision \u201cviolates norms of democratic personal freedom and respect for women\u2019s basic autonomy in a way that verges on the \u2018totalitarian.\u2019\u201d <\/span>According<\/span><\/a> to the NCR, \u201cDell\u2019Oro attacked the <\/span>Dobbs<\/span><\/i> ruling for failing to uphold democracy, which \u2018maximizes rather than restricts a space of personal freedom for all citizens, including women.\u2019\u201d<\/span><\/p>\n

Dell\u2019Oro suggested that <\/span>Roe<\/span><\/i> went too far in establishing fetal viability as the point at which states can restrict abortion. \u201cI submit that the ability of the fetus to feel pain represents the point at which the legal right to choice ought to end,\u201d he proposed.\u00a0<\/span><\/p>\n

His comments are problematic for many reasons. Firstly, the point at which a preborn human can feel pain does not enjoy scientific consensus. Some organizations, like the American College of Obstetricians and Gynecologists (ACOG), <\/span>state<\/span><\/a> that the preborn child cannot feel pain until as late as 24 weeks\u2019 gestation \u2013 roughly the same point as so-called \u201cviability.\u201d More recent research settles on the ability to feel pain by the end of the first trimester<\/a> of pregnancy, and other scientists have <\/span>proposed<\/span><\/a> that fetal pain may be possible as early as 7-8 weeks\u2019 gestation.<\/span><\/p>\n

Secondly, Dell\u2019Oro\u2019s position as a moral theologian in a Catholic institution and regular member of the Pontifical Academy of Life would seem to obligate him to faithfully disseminate Church teaching on the sanctity of life. That <\/span>teaching<\/span><\/a> is, and always has been, that every life is worthy of protection from the moment of conception (fertilization) and that every abortion is a moral evil. <\/span>Suggesting that <\/span>any<\/span><\/i> abortions might be acceptable (as abortion is an act of intentional homicide against a human not yet born) contravenes the teachings of the Church Dell\u2019Oro ostensibly represents.<\/span><\/p>\n

In addition, Roe v. Wade<\/em> actually overruled state laws in 1973 that had been passed by elected legislators. In other words, Roe<\/em> itself\u00a0bypassed the democratic process<\/em>, forcing<\/em>\u00a0legalized abortion upon every state in the nation.<\/p>\n

According<\/span><\/a> to NCR, the Pontifical Academy for Life \u201cwas founded in 1994 by Pope St. John Paul II to study \u2018the principal problems of biomedicine and of law, relative to the promotion and defense of life[.]\u2019\u201d Its original bylaws required members to sign a declaration affirming their commitment to \u201cbear witness that \u2026 every human being is a person\u201d and that, \u201cfrom the moment the embryo is formed until death, it is the same human being which grows to maturity and dies.\u201d <\/span><\/p>\n

That requirement was dropped in 2016\u00a0\u2014 and it has led to questionable decisions by t<\/span>he Academy. Earlier this year, it released <\/span>Theological Ethics of Life: Scripture, Tradition, Practical Challenges<\/span><\/i><\/a>, a book which many have <\/span>criticized<\/span><\/a> as calling for reform to the Church\u2019s teaching on contraception. And last week, pro-abortion atheist<\/em><\/strong> Mariana Mazzucato was <\/span>appointed<\/span><\/a> as a full member to the Academy.\u00a0<\/span><\/p>\n

\u201cThe problem with appointing people who do not share a Catholic worldview and value system is the academy\u2019s positions fail to represent a Catholic mind,\u201d <\/span>said<\/span><\/a> moral theologian <\/span>Christian Brugger<\/span><\/a>. And when \u201cthe body no longer can be trusted to speak in concert with the Gospel, it loses its evangelical purpose.\u201d<\/span><\/p>\n
