Update 10\/14\/22:\u00a0<\/strong>The Indiana Supreme Court issued an order on October 12 continuing the block on the state’s law protecting preborn children from abortion.<\/p>\n

The Supreme Court ruling came after a request from state Attorney General\u00a0Todd Rokita that it take up the case directly, skipping the intermediary appeals court. The Court did not, however, honor Rokita’s request to set aside County Judge Kelsey Hanlon’s injunction, and instead scheduled a hearing on the lawsuit against the pro-life law for January 12.<\/p>\n

Amy Hagstrom Miller, president of Whole Woman\u2019s Health, said that her facility will begin scheduling abortion appointments once again following this ruling.<\/p>\n

\u201cThat is some stability and security for the patients that we haven\u2019t had in quite some time,\u201d Hagstrom Miller told The Associated Press<\/a>.<\/p>\n

Indiana Right to Life CEO Mike Fichter decried the loss of innocent life that will now occur. \u201cAlthough we are confident the law will be upheld, it will be far too late for those whose lives will be lost as this is argued in the courts,\u201d he said in a statement.<\/p>\n

9\/23\/22:<\/strong>\u00a0<\/strong>A pro-life law in Indiana was blocked by Owen County Judge Kelsey Hanlon after it had been in effect for just one week.<\/p>\n

The Indiana law protected most preborn children<\/a> from abortion, though it permitted abortion up to 10 weeks in cases of rape and incest, to protect the health of the mother (though intentional killing is not medically necessary<\/a>), and in cases where the preborn child was diagnosed with a lethal anomaly. It also required that abortions be committed only in hospitals or surgical centers, instead of in standalone abortion facilities.<\/p>\n

Lawsuits were filed by both Planned Parenthood<\/a> and the ACLU<\/a>, and Hanlon ruled in their favor, putting an injunction in place to block the law. According to the Associated Press<\/a> (AP), abortion facilities are already preparing to begin committing abortions again.<\/p>\n

\u201cPeople are getting the word that abortion is now legal again, and people are ready to get their health care that they deserve and that they desire,” Katie McHugh, an abortionist with Women’s Med Center in Indianapolis, told the AP. \u201cI had really hoped for this, but honestly, I didn\u2019t really expect it. So the fact that this is what happened is such a pleasant surprise and such a validation of what we have been saying this whole time.\u201d<\/p>\n

Women’s Med Center (which also has a facility in Ohio) said it plans to begin committing abortions again on Friday, just one day after Hanlon’s ruling.<\/p>\n

In the ruling, Hanlon claimed that even though abortion was not legal when Indiana’s constitution was written, there is still a “reasonable likelihood” that abortion is protected. The Indiana constitution, Hanlon wrote, \u201cis more explicit in its affirmation of individual rights and its limitation of legislative power to intrude into personal affairs\u201d than even the United States constitution. Tom Fisher, the state\u2019s solicitor general, disagreed, saying abortion was not supported when Indiana’s constitution was written in 1851. \u201cThat history forecloses any legitimate claim to a right to have an abortion under the Indiana Constitution,” he said.<\/p>\n

Abortion is now permitted in the state up to 20 weeks after fertilization.<\/p>\n

In a statement<\/a>, Attorney General Todd Rokita vowed to defend the pro-life law in court. “Indiana has a long history of defending life, and that fight will continue,” he said. “I’ll do everything in my power to advance this mission to protect mothers and children at every step of the way. We are working vigorously to protect unborn children and the physical, mental, and emotional well-being of their mothers. We plan to appeal and continue to make the case for life in Indiana.”<\/p>\n
