According to a <\/span><a href=\"https:\/\/www.kaine.senate.gov\/press-releases\/kaine-murkowski-sinema-and-collins-introduce-legislation-to-codify-roe-v-wade\"><span style=\"font-weight: 400;\">press release<\/span><\/a><span style=\"font-weight: 400;\"> on Senator Kaine\u2019s website, the bill aims to \u201cenact in federal law the essential holdings of <\/span><i><span style=\"font-weight: 400;\">Roe v. Wade<\/span><\/i><span style=\"font-weight: 400;\"> and related cases, protecting abortion rights and contraception access.\u201d It would restore the \u201cundue burden\u201d standard applied in <\/span><i><span style=\"font-weight: 400;\">Planned Parenthood v. Casey<\/span><\/i><span style=\"font-weight: 400;\"> and essentially reset the legal status of abortion to a pre-<\/span><i><span style=\"font-weight: 400;\">Dobbs<\/span><\/i><span style=\"font-weight: 400;\"> status quo at the federal level.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">But, according to <\/span><a href=\"https:\/\/www.vox.com\/policy-and-politics\/2022\/8\/22\/23306142\/kaine-collins-codify-roe-abortion-congress\"><span style=\"font-weight: 400;\">Vox<\/span><\/a><span style=\"font-weight: 400;\">, so-called \u201cabortion rights\u201d groups hate the bill. Why? Primarily, because it doesn\u2019t go far enough.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Mini Timmaraju, president of NARAL, stated, \u201cTo those who say we want to go back in a time machine to the day before <\/span><i><span style=\"font-weight: 400;\">Dobbs<\/span><\/i><span style=\"font-weight: 400;\">, that was still a bad day.\u201d <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Senator Elizabeth Warren (D-Mass.) objected similarly, saying returning to a pre-<\/span><i><span style=\"font-weight: 400;\">Dobbs<\/span><\/i><span style=\"font-weight: 400;\"> status quo \u201cis not good enough.\u201d <\/span><\/p>\n<p><span style=\"font-weight: 400;\">And Senator Tammy Duckworth (D-Ill.) explained her objection to the bill by complaining that it doesn\u2019t \u201cfully [guarantee] a woman\u2019s right to reproductive choice.\u201d Presumably, a \u201cfull guarantee\u201d would involve abortion on demand up to \u2013 or even after \u2013 birth.<\/span><\/p>\n<p><strong>READ:\u00a0<em><a href=\"https:\/\/archive.liveaction.org\/news\/pro-abortion-lawmaker-calls-extreme-threat\/\">Pro-abortion lawmaker calls pro-lifers \u2018extreme\u2019 and a \u2018threat\u2019 to the country<\/a><\/em><\/strong><\/p>\n<p><span style=\"font-weight: 400;\">Critics also argue that the bill doesn\u2019t actually codify <\/span><i><span style=\"font-weight: 400;\">Roe<\/span><\/i><span style=\"font-weight: 400;\"> because the language is too vague. A coalition of pro-abortion organizations claimed in a joint <\/span><a href=\"https:\/\/www.plannedparenthood.org\/about-us\/newsroom\/press-releases\/coalition-of-reproductive-health-rights-and-justice-groups-respond-to-new-bill-from-senators-kaine-murkowski-sinema-and-collins\"><span style=\"font-weight: 400;\">statement<\/span><\/a><span style=\"font-weight: 400;\"> that the bill \u201cdoes not expressly prohibit pre-viability abortion bans, leaving states able to continue to pass abortion bans that are denying people access to essential health care across the country. This bill has been written for a world that does not exist and would provide little solace in the nightmare we are living.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, the <\/span><a href=\"https:\/\/www.kaine.senate.gov\/imo\/media\/doc\/reproductive_freedom_for_all_act_bill_text.pdf\"><span style=\"font-weight: 400;\">bill<\/span><\/a><span style=\"font-weight: 400;\"> explicitly says that states \u201cshall not impose an undue burden on the ability of women to terminate a pregnancy before fetal viability.\u201d It also specifies that \u201cviability\u201d is to be <em>subjectively determined<\/em> by a woman\u2019s doctor, not a specific, objective guideline, leaving the door wide open for exceptions to any theoretical gestational limit a state might pass.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Pro-abortion opponents of the bill also <\/span><a href=\"https:\/\/www.vox.com\/policy-and-politics\/2022\/8\/22\/23306142\/kaine-collins-codify-roe-abortion-congress\"><span style=\"font-weight: 400;\">argue<\/span><\/a><span style=\"font-weight: 400;\"> that the bill is a \u201cstunt\u201d because it doesn\u2019t have the necessary Senate votes to pass. Furthermore, they do not believe it would withstand legal challenges, given the current composition of the Supreme Court.
