This usually occurs around six weeks, though the heart starts beating as early as <a href=\"https:\/\/archive.liveaction.org\/news\/pro-abortion-authors-lied-heartbeats\/\" target=\"_blank\" rel=\"noopener\">16-22 days<\/a>. The ruling comes as state lawmakers consider a bill that would protect <em>all<\/em> preborn children in South Carolina from abortion.<\/p>\n<p>The heartbeat law went into effect in July, following the Supreme Court&#8217;s overturning of <em>Roe v. Wade<\/em>. It was then challenged in a lawsuit by abortion advocates, who claim that it violates the state&#8217;s constitutional right to privacy. On July 26,\u00a0Judge Casey Manning <a href=\"https:\/\/archive.liveaction.org\/news\/south-carolina-protections-stand\/\" target=\"_blank\" rel=\"noopener\">declined a request<\/a> to place a temporary injunction on the law while the lawsuit proceeded. At that time, Manning also agreed with a request to send the case directly to the Supreme Court given its significance. That move led to the high court&#8217;s August 17 decision to put the law on hold while it hears the case.<\/p>\n<p><strong>READ:\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/congress-should-pass-the-heartbeat-bill-to-protect-life-once-a-heartbeat-is-detected\/\" target=\"_blank\" rel=\"noopener\"><em>The science is clear: At 22 days, a baby\u2019s heart begins to beat<\/em><\/a><\/strong><\/p>\n<p>In its decision, the court maintained that it was best to return to the &#8220;status quo&#8221; of the state&#8217;s allowance of abortion prior to the overturn of <em>Roe<\/em>. &#8220;To the extent we address the merits, we acknowledge an arguably close question is presented, which further supports the need to maintain the status quo \u200b(that allowed abortions during the first twelve weeks, or first trimester, of pregnancy) by granting a temporary injunction,&#8221; the court <a href=\"https:\/\/www.cnn.com\/2022\/08\/17\/politics\/south-carolina-abortion-ban-temporarily-blocked\/index.html\" target=\"_blank\" rel=\"noopener\">said<\/a>.<\/p>\n<p>&#8220;We applaud the court\u2019s decision to protect the people of South Carolina from this cruel law that interferes with a person\u2019s private medical decision,&#8221; said Jenny Black, president and CEO of Planned Parenthood South Atlantic, in a <a href=\"https:\/\/www.foxnews.com\/politics\/south-carolina-supreme-court-temporarily-blocks-abortion-law-near-total-ban-state-house\" target=\"_blank\" rel=\"noopener\">statement<\/a>. &#8220;Today the court has granted our patients a welcome reprieve, but the fight to restore bodily autonomy to the people of South Carolina is far from over. No matter what happens, we will never stop fighting for our patients\u2019 right to make their own decisions about their bodies and futures.&#8221;<\/p>\n<p>State Attorney General Alan Wilson has vowed to fight to defend the law in court. \u201cWhile we are disappointed, it\u2019s important to point out this is a temporary injunction,\u201d Wilson told the <a href=\"https:\/\/archive.ph\/hTcu2#selection-725.0-725.238\" target=\"_blank\" rel=\"noopener\">Washington Post<\/a>. \u201cThe court didn\u2019t rule on the constitutionality of the Fetal Heartbeat law.
