{"id":273486,"date":"2022-08-02T18:46:01","date_gmt":"2022-08-02T23:46:01","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=273486"},"modified":"2022-08-02T16:14:33","modified_gmt":"2022-08-02T21:14:33","slug":"biden-doj-sues-idaho-pro-life-laws","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/biden-doj-sues-idaho-pro-life-laws\/","title":{"rendered":"Biden DOJ sues Idaho, claims pro-life laws will prevent women from receiving &#8216;medical care&#8217;"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><span style=\"font-weight: 400;\">The Biden Administration&#8217;s Department of Justice (DOJ) has filed a lawsuit against Idaho\u2019s 2020 trigger <\/span><a href=\"https:\/\/legislature.idaho.gov\/wp-content\/uploads\/sessioninfo\/2020\/legislation\/S1385.pdf\"><span style=\"font-weight: 400;\">law<\/span><\/a><span style=\"font-weight: 400;\"> protecting most preborn children from abortion. The DOJ\u00a0<\/span><a href=\"https:\/\/www.cnn.com\/2022\/08\/02\/politics\/justice-department-abortion-idaho\/index.html\"><span style=\"font-weight: 400;\">claims<\/span><\/a><span style=\"font-weight: 400;\"> the law will impede women from receiving life-saving treatments in the event of ectopic pregnancy or in cases where other life-threatening complications are present. Idaho\u2019s trigger law, which is set to go into <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2022-08-02\/biden-doj-sues-idaho-over-state-s-six-week-abortion-ban\">effect<\/a> on August 25, makes committing an abortion a felony punishable by up to five years in prison \u2014 but it contains exceptions for cases of rape or incest that have been reported to the authorities, and to save the life of the mother.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Despite the law&#8217;s exceptions, the Biden administration is suing under the Emergency Medical Treatment and Labor Act (EMTALA), which <\/span><a href=\"https:\/\/www.cms.gov\/Regulations-and-Guidance\/Legislation\/EMTALA\"><span style=\"font-weight: 400;\">specifies<\/span><\/a><span style=\"font-weight: 400;\"> that hospitals receiving Medicare funds \u201care \u2026 required to provide stabilizing treatment for patients with [emergency medical conditions].\u201d According to the DOJ, &#8220;The Idaho law would make it a criminal offense for doctors to comply with EMTALA&#8217;s requirement to provide stabilizing treatment, even where a doctor determines that abortion is the medical treatment necessary to prevent a patient from suffering severe health risks or even death.&#8221; <\/span><\/p>\n<p><span style=\"font-weight: 400;\">In short, the administration wants the deliberate killing of a preborn human being included under the category of &#8220;stabilizing treatment.&#8221;<\/span><\/p>\n<p>The state of Texas filed a lawsuit in mid-July against the Biden administration regarding the administration&#8217;s use of abortion in EMTALA. Attorney General Ken Paxton stated in the suit, &#8220;The Abortion Mandate requires that a provider perform an abortion if \u2018abortion is the stabilizing treatment necessary to resolve [an emergency medical condition].\u2019 This condition has never been a part of EMTALA&#8230;. EMTALA does not mandate access to abortion or codify a right to an abortion as \u2018stabilizing treatment\u2019 for an \u2019emergency medical condition.\u2019 The Abortion Mandate cites no other federal law that would authorize or require an abortion. No federal statute, including EMTALA, supersedes or preempts the States\u2019 power to regulate or prohibit abortion.\u201d<\/p>\n<p><span style=\"font-weight: 400;\">&#8220;In the days since the <\/span><i><span style=\"font-weight: 400;\">Dobbs<\/span><\/i><span style=\"font-weight: 400;\"> decision, there have been widespread reports of delays or denials to pregnant women experiencing medical emergencies,&#8221; Attorney General Merrick Garland <\/span><a href=\"https:\/\/www.cnn.com\/2022\/08\/02\/politics\/justice-department-abortion-idaho\/index.html\"><span style=\"font-weight: 400;\">claimed<\/span><\/a><span style=\"font-weight: 400;\">. &#8220;We will use every tool at our disposal to ensure that pregnant women get the medical care that they are entitled to.&#8221;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Attorney General Merrick Garland <\/span><a href=\"https:\/\/www.cnn.com\/2022\/08\/02\/politics\/justice-department-abortion-idaho\/index.html\"><span style=\"font-weight: 400;\">told<\/span><\/a><span style=\"font-weight: 400;\"> reporters, &#8220;The Supreme Court said that each state can make its own decisions with respect to abortion, but so too can the federal government. Nothing that the Supreme Court said, said that the statutes passed by Congress, such as EMTALA are in any way invalid. It&#8217;s quite the opposite. The Supreme Court left it to the people&#8217;s representatives. EMTALA was a decision made by the Congress of the United States.\u201d Referencing Article VI, paragraph 2 of the US Constitution, commonly known as the <\/span><a href=\"https:\/\/www.law.cornell.edu\/wex\/supremacy_clause\"><span style=\"font-weight: 400;\">Supremacy Clause<\/span><\/a><span style=\"font-weight: 400;\">, he continued: \u201cFederal law invalidates state laws that are in direct contradiction.&#8221;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This is the first legal action taken by the Biden administration against a state which has limited abortion following the overturning of <\/span><i><span style=\"font-weight: 400;\">Roe v.
