{"id":273442,"date":"2022-08-03T10:40:27","date_gmt":"2022-08-03T15:40:27","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=273442"},"modified":"2022-08-02T16:14:51","modified_gmt":"2022-08-02T21:14:51","slug":"massachusetts-governor-sweeping-codifying-abortion-law","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/massachusetts-governor-sweeping-codifying-abortion-law\/","title":{"rendered":"Massachusetts governor signs sweeping bill codifying abortion in state law"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>Massachusetts Governor Charlie Baker signed a bill Friday that includes a number of provisions to protect abortion in the state.<\/p>\n<p>The legislation, <a href=\"https:\/\/malegislature.gov\/Bills\/192\/H5090\" target=\"_blank\" rel=\"noopener\">H.5090<\/a>, codifies many of the provisions Baker sought to protect when he issued an <a href=\"https:\/\/www.mass.gov\/executive-orders\/no-600-protecting-access-to-reproductive-health-care-services-in-the-commonwealth?n\" target=\"_blank\" rel=\"noopener\">executive order<\/a> shortly following the Supreme Court&#8217;s overturn of <em>Roe v. Wade,\u00a0<\/em>including the following:<\/p>\n<ul>\n<li>protections for abortionists and patients who may face lawsuits from other states<\/li>\n<li>a requirement that insurers must pay for abortions without applying any co-pays or deductibles<\/li>\n<li>an order that <a href=\"https:\/\/www.masslive.com\/politics\/2022\/07\/massachusetts-abortion-protections-bill-shielding-providers-and-patients-signed-into-law-by-gov-charlie-baker.html\" target=\"_blank\" rel=\"noopener\">requires<\/a> all pharmacists to provide emergency contraception<\/li>\n<li>a requirement that all public colleges and universities will soon offer chemical abortion<\/li>\n<li>a clarification to the state law to ensure that late-term abortions are still committed<\/li>\n<\/ul>\n<div class=\"video-container\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Our administration took quick action in the hours after Roe v. Wade,\u201d Baker said in a <a href=\"https:\/\/www.masslive.com\/politics\/2022\/07\/massachusetts-abortion-protections-bill-shielding-providers-and-patients-signed-into-law-by-gov-charlie-baker.html\" target=\"_blank\" rel=\"noopener\">statement<\/a> Friday morning. \u201cThis new legislation signed today builds on that action by protecting patients and providers from legal interference from more restrictive laws in other states. We are grateful for the compromise and dedication to the issue that our legislative colleagues demonstrated to make this important, bipartisan law a reality.\u201d<\/p>\n<p>According to <a href=\"https:\/\/www.masslive.com\/politics\/2022\/07\/massachusetts-abortion-protections-bill-shielding-providers-and-patients-signed-into-law-by-gov-charlie-baker.html\" target=\"_blank\" rel=\"noopener\">Mass Live,<\/a> there was much debate over the language in the bill allowing late-term abortions after 24 weeks. Ultimately, lawmakers decided to allow late-term abortions provided one of the following four (extremely broad)\u00a0<a href=\"https:\/\/www.masslive.com\/politics\/2022\/07\/massachusetts-abortion-protections-bill-shielding-providers-and-patients-signed-into-law-by-gov-charlie-baker.html\" target=\"_blank\" rel=\"noopener\">criteria<\/a> are met: the abortion is \u201cnecessary to preserve the life of the patient,\u201d \u201cnecessary to preserve the patient\u2019s physical or mental health,\u201d \u201cwarranted because of a lethal fetal anomaly or diagnosis,\u201d or \u201cwarranted because of a grave fetal diagnosis that indicates that the fetus is incompatible with sustained life outside of the uterus without extraordinary medical interventions.\u201d<\/p>\n<p>However, the deliberate killing of a preborn human being is <a href=\"https:\/\/archive.liveaction.org\/news\/pro-life-replies-abortion-never-medically-necessary\/\" target=\"_blank\" rel=\"noopener\">not medically necessary<\/a>, especially at such a late stage in pregnancy. Children have survived premature birth with assistance <a href=\"https:\/\/archive.liveaction.org\/news\/youngest-preemie-world-21-weeks-going-home\/\">starting at just 21 weeks<\/a> gestation. A third trimester abortion is done via an induction procedure and usually takes two to three days to complete because of the baby&#8217;s large size. The entire, horrific procedure is described here:<\/p>\n<p><center><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/aBIhez7C1dM\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/center>&nbsp;<\/p>\n<p>If the mother&#8217;s life or health is in danger and her pregnancy needs to end, an emergency c-section makes the most sense. Rather than waiting several days for her child to die, she can deliver right away \u2014 and doctors can provide immediate, life-saving care to that child. Since children as young as 21 weeks have survived outside the womb, there is a chance that her baby may live.<\/p>\n<p>Furthermore, the homicide of an undelivered baby is never &#8220;warranted,&#8221; even if that child receives a fetal diagnosis. It is common for doctors to offer death via abortion as a first option rather than striving to offer life-saving care and comfort to their patients, both mother and child. But there is <em>never<\/em> a need for the deliberate killing of a child late in pregnancy, even given one of the stipulations that Massachusetts lawmakers have offered.<\/p>\n<p>Planned Parenthood offered its praise of the new Massachusetts legislation. &#8220;I am so proud that in the face of the Supreme Court\u2019s unprecedented assault on reproductive freedom, Massachusetts is setting a national example for expanding abortion access and valuing the providers who work hard every day to deliver care, save lives, and help people control their own futures,&#8221; <a href=\"https:\/\/www.masslive.com\/politics\/2022\/07\/massachusetts-abortion-protections-bill-shielding-providers-and-patients-signed-into-law-by-gov-charlie-baker.html\" target=\"_blank\" rel=\"noopener\">said<\/a>\u00a0Jennifer Childs-Roshak, the president and CEO of Planned Parenthood League of Massachusetts.<\/p>\n<p>The pro-life group Massachusetts Citizens for Life also responded to the bill&#8217;s passage. &#8220;We regret that Governor Baker wasted no time in signing the expanded abortion bill, H.5090, into law last Friday,&#8221; the group wrote on <a href=\"https:\/\/www.facebook.com\/MassProLife\/\" target=\"_blank\" rel=\"noopener\">Facebook<\/a>. &#8220;Although this is disappointing news, we are resolved to keep fighting to pass protective pro-life measures in Massachusetts!&#8221;<\/p>\n<p style=\"text-align: center;\"><strong><em><a href=\"https:\/\/www.facebook.com\/liveactionnewsonline\/?ref=br_rs\" target=\"_blank\" rel=\"noopener\">\u201cLike\u201d Live Action News on Facebook<\/a>\u00a0for more pro-life news and commentary!<\/em><\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Massachusetts Governor Charlie Baker signed a bill Friday that includes a number of provisions to protect abortion in the state.
