{"id":273413,"date":"2022-08-02T14:44:07","date_gmt":"2022-08-02T19:44:07","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=273413"},"modified":"2022-08-02T13:38:24","modified_gmt":"2022-08-02T18:38:24","slug":"michigan-courts-wrangle-1931-abortion-law","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/michigan-courts-wrangle-1931-abortion-law\/","title":{"rendered":"Michigan courts wrangle at whiplash speed over enforcement of 1931 pro-life law"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><span style=\"font-weight: 400;\">The state of Michigan has a 1931 <\/span><a href=\"https:\/\/www.legislature.mi.gov\/documents\/mcl\/pdf\/mcl-328-1931-III.pdf\"><span style=\"font-weight: 400;\">law<\/span><\/a><span style=\"font-weight: 400;\"> on the books which not only prohibits most abortions, but also criminalizes the act of committing one.\u00a0In anticipation of the potential overturning of <i>Roe v. Wade<\/i>, Planned Parenthood of Michigan <a href=\"https:\/\/www.plannedparenthood.org\/about-us\/newsroom\/press-releases\/planned-parenthood-files-lawsuit-in-michigan-to-block-90-year-old-felony-abortion-ban-and-affirm-a-state-right-to-abortion-2\">filed suit<\/a> in April to block Michigan Attorney General Dana Nessel from enforcing the law. Nessel <a href=\"https:\/\/www.freep.com\/story\/news\/politics\/2022\/04\/07\/michigan-abortion-nessel-lawsuit\/9498411002\/\">stated<\/a> that she would not defend the state in the lawsuit, and agreed with Planned Parenthood\u2019s position that the law is unconstitutional. The law states:<\/span><\/p>\n<p style=\"padding-left: 30px;\"><i><span style=\"font-weight: 400;\">Any person who shall wilfully administer to any pregnant woman any medicine, drug, substance or thing whatever, or shall employ any instrument or other means whatever, with intent thereby to procure the miscarriage of any such woman, unless the same shall have been necessary to preserve the life of such woman, shall be guilty of a felony, and in case the death of such pregnant woman be thereby produced, the offense shall be deemed manslaughter.<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">But whether that law will go back into effect remains to be seen, as legal ups and downs have been happening so quickly in Michigan that it is difficult to keep track of the law\u2019s status at any given moment.<\/span><\/p>\n<p><strong>READ:\u00a0<em><a href=\"https:\/\/archive.liveaction.org\/news\/michigan-governor-veto-funding-adoption-pregnancy\/\">Pro-abortion Michigan governor to veto funding for adoption and pregnancy services<\/a><\/em><\/strong><\/p>\n<p><span style=\"font-weight: 400;\">Court of Claims Judge Elizabeth Gleicher \u2013 who admits to making annual donations to Planned Parenthood \u2013 was assigned to the case. In May, she <\/span><a href=\"https:\/\/www.wxyz.com\/news\/michigan-county-prosecutors-can-enforce-1931-abortion-ban-appeals-court-rules\"><span style=\"font-weight: 400;\">issued<\/span><\/a><span style=\"font-weight: 400;\"> a temporary injunction prohibiting enforcement of the 1931 law, <\/span><a href=\"https:\/\/www.freep.com\/story\/news\/politics\/2022\/07\/29\/michigan-abortion-lawsuit-judge-elizabeth-gleicher\/10182617002\/\"><span style=\"font-weight: 400;\">arguing<\/span><\/a><span style=\"font-weight: 400;\"> that Planned Parenthood had a reasonable chance of winning its case. Although the Michigan legislature attempted to secure Judge Gleicher\u2019s recusal from the case on the grounds that she could not be impartial in a case concerning an organization she obviously supported, she <\/span><a href=\"https:\/\/www.freep.com\/story\/news\/politics\/2022\/07\/29\/michigan-abortion-lawsuit-judge-elizabeth-gleicher\/10182617002\/\"><span style=\"font-weight: 400;\">refused<\/span><\/a><span style=\"font-weight: 400;\">, saying the legislature\u2019s argument \u201cborder[ed] on frivolous.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">After Judge Gleicher issued the injunction, a group of Michigan county prosecutors asked the Court of Appeals to rule on whether the temporary injunction applied to them. On Monday, August 1, the Court of Appeals <\/span><a href=\"https:\/\/www.wxyz.com\/news\/michigan-county-prosecutors-can-enforce-1931-abortion-ban-appeals-court-rules\"><span style=\"font-weight: 400;\">determined<\/span><\/a><span style=\"font-weight: 400;\"> that \u201c[b]ecause county prosecutors are local officials, jurisdiction of the Court of Claims does not extend to them.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Some Republican county prosecutors <\/span><a href=\"https:\/\/abcnews.go.com\/Health\/wireStory\/michigan-court-county-prosecutors-enforce-abortion-ban-87755652\"><span style=\"font-weight: 400;\">pledged<\/span><\/a><span style=\"font-weight: 400;\"> to enforce the law, while at least seven Democratic prosecutors said they would decline to do so.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, just hours later, at the behest of Governor Gretchen Whitmer\u2019s attorneys, Oakland County Judge Jacob Cunningham issued a restraining order against county prosecutors, and scheduled a hearing for Wednesday, August 3.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The ultimate outcome remains unknown.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Governor Gretchen Whitmer has <\/span><a href=\"https:\/\/www.freep.com\/story\/news\/local\/michigan\/2022\/04\/07\/michigan-abortion-law-ban-gretchen-whitmer-supreme-court\/9485031002\/\"><span style=\"font-weight: 400;\">filed<\/span><\/a><span style=\"font-weight: 400;\"> a separate lawsuit concerning the 1931 law. The Michigan Supreme Court has not yet stated whether it will hear the case.
