The legislative session was called after a judge <a href=\"https:\/\/archive.liveaction.org\/news\/west-virginia-judge-blocks-law-protecting-preborn-children\/\" target=\"_blank\" rel=\"noopener\">blocked<\/a> an 1800s pro-life law from taking effect earlier this month.<\/p>\n<p><a href=\"https:\/\/www.cnn.com\/2022\/07\/26\/politics\/west-virginia-special-session-abortion\/\" target=\"_blank\" rel=\"noopener\">HB 302<\/a> would outlaw abortion in nearly all cases, making the procedure a felony. The only exceptions would be\u00a0for a &#8220;nonmedically viable fetus,&#8221; a medical emergency, or an ectopic pregnancy \u2014 though treatment for an ectopic pregnancy is <a href=\"https:\/\/archive.liveaction.org\/news\/planned-parenthood-ectopic-treatment-abortion\/\" target=\"_blank\" rel=\"noopener\">not an abortion<\/a>. While the bill originally did not include any exceptions for rape or incest, those measures were added prior to its passage in the House.<\/p>\n<p><center><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/5TmomK2RB2A\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/center>&nbsp;<\/p>\n<p><strong>READ: <em><a href=\"https:\/\/archive.liveaction.org\/news\/west-virginia-governor-law-preborn-disabilities-abortion\/\" target=\"_blank\" rel=\"noopener\">West Virginia governor signs law protecting preborn babies with disabilities from abortion<\/a><\/em><\/strong><\/p>\n<p>According to the bill, any physician who commits an abortion could face up to 10 years in prison. The bill explicitly states that the mother will not be penalized.<\/p>\n<p>Governor Jim Justice added the abortion bill to the lawmakers&#8217; agenda on Monday, asking them to &#8220;clarify and modernize the abortion-related laws currently existing as part of the West Virginia Code, to ensure a coherent, comprehensive framework governing abortions and attendant family services and support to expecting mothers to provide the citizens of this State more certainty in the application of such laws.&#8221;<\/p>\n<p>&#8220;From the moment the Supreme Court announced their decision in <em>Dobbs<\/em>, I said that I would not hesitate to call a Special Session once I heard from our Legislative leaders that they had done their due diligence and were ready to act,&#8221; Justice said in a\u00a0<a href=\"https:\/\/governor.wv.gov\/News\/press-releases\/2022\/Pages\/Governor-Justice-amends-Special-Session-Call-asking-Legislature-to-clarify-and-modernize-abortion-related-laws.aspx\" target=\"_blank\" rel=\"noopener\">statement<\/a>. &#8220;As I have said many times, I very proudly stand for life and I believe that every human life is a miracle worth protecting.&#8221;<\/p>\n<p>According to the <a href=\"https:\/\/apnews.com\/article\/abortion-health-west-virginia-charleston-government-and-politics-6f287b5b7fc20e4995d2c3fbabe8a154\" target=\"_blank\" rel=\"noopener\">Associated Press<\/a>, tensions were high throughout the debate on Wednesday, as the sounds of pro-abortion protestors could be heard outside. Yet Del. Brandon Steele noted that the protests didn&#8217;t phase him, saying, \u201cWhat\u2019s ringing in my ears is not the noise of the people here.
