{"id":271136,"date":"2022-06-30T06:40:35","date_gmt":"2022-06-30T11:40:35","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=271136"},"modified":"2022-06-29T16:32:40","modified_gmt":"2022-06-29T21:32:40","slug":"pregnant-student-discrimination-college","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/pregnant-student-discrimination-college\/","title":{"rendered":"Pregnant student wins discrimination lawsuit against college"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><span style=\"font-weight: 400;\">A <\/span><a href=\"https:\/\/www.sltrib.com\/news\/education\/2022\/06\/15\/pregnant-student-was\/?fbclid=IwAR2k7WdddlCq1twRw0AtLj8cPw4Brg-M3mipsi2BHSzZmRSGSXOi4EzMQyM\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">pregnant student<\/span><\/a><span style=\"font-weight: 400;\"> at Salt Lake Community College (SLCC) has won a discrimination lawsuit against the school. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The student had been told by one of her professors that she should drop a class due to her frequent absences, which were due to her having a difficult pregnancy. The class was a prerequisite for other courses and was only offered in the early morning, but she had trouble getting to class at that time due to severe morning sickness. She had asked for a more lenient attendance policy and permission to turn in assignments late without a penalty.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The pregnant student provided letters and notes from her doctor attesting to her extreme sickness and went to SLCC\u2019s Disability Resource Center and the Title IX office. Neither office offered to help her and the professor in question claimed that the accommodations she was asking for were unnecessary.\u00a0This student knew that as a pregnant woman, she was entitled to accommodations and that this professor was discriminating against her.\u00a0 <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Title IX prohibits discrimination based on gender at any school that receives federal funding, and pregnant students are protected under Title IX. According to the <\/span><a href=\"https:\/\/www2.ed.gov\/about\/offices\/list\/ocr\/docs\/dcl-know-rights-201306-title-ix.html\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">U.S. Department of Education\u2019s website<\/span><\/a><span style=\"font-weight: 400;\">, schools must:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Allow you to continue participating in classes and extracurricular activities even though you are pregnant.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Excuse absences due to pregnancy or childbirth for as long as your doctor says it is necessary.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Finally, the student filed a complaint with the Department of Education\u2019s Office for Civil Rights (OCR) in August 2021. On June 14, 2022, the OCR sent <\/span><a href=\"https:\/\/www.sltrib.com\/news\/education\/2022\/06\/15\/pregnant-student-was\/?fbclid=IwAR2k7WdddlCq1twRw0AtLj8cPw4Brg-M3mipsi2BHSzZmRSGSXOi4EzMQyM\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">a letter<\/span><\/a><span style=\"font-weight: 400;\"> to SLCC with the results of their investigation, demanding that the school complete of a number of requirements to comply with Title IX. OCR supported the student and ordered that Title IX be enforced, including for pregnant students. Unfortunately, it was too late for the original student. The pregnant student withdrew from the school and received a refund of her tuition. Hopefully, her fight will make a difference for current and future pregnant students.<\/span><\/p>\n<p><strong>READ:\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/coerced-abortion-more-common\/\" target=\"_blank\" rel=\"noopener\"><em>Coerced abortion: It\u2019s far more common than you think<\/em><\/a><\/strong><\/p>\n<p><span style=\"font-weight: 400;\">Discrimination against women who are pregnant happens not only in schools, but also in <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/fired-pregnancy-condition\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">workplaces<\/span><\/a><span style=\"font-weight: 400;\">. It is a common problem, especially when women experience difficult pregnancies and their absences increase. A <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/studies-impact-workplace-pregnancy-discrimination\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">recent study<\/span><\/a><span style=\"font-weight: 400;\"> even found that pregnant women who are discriminated against at work have a higher risk of postpartum depression. These acts of discrimination can also put women at risk of having unwanted abortions. More than <a href=\"https:\/\/archive.liveaction.org\/news\/coerced-abortion-more-common\/\" target=\"_blank\" rel=\"noopener\">60% of women<\/a> who have undergone abortions said they felt at least subtle forms of pressure to do so.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The good news is that women usually win when they file complaints and lawsuits.
