With the Supreme Court having officially overturned<\/a> both Roe v. Wade<\/em> and Planned Parenthood v. Casey<\/em>, returning the issue to states to decide, many wonder what this will mean for abortion in their states. A number of states already had “trigger laws” in place \u2014 legislation that would go into effect immediately, should Roe<\/em> ever fall. These are those states.<\/p>\n

Arkansas<\/h3>\n

In 2019, Arkansas passed the Arkansas Human Life Protection Act, which included a provision activating the law if Roe<\/em> was overturned. The law protects preborn children except in cases necessary to save the life of the mother (read more here about why it isn’t necessary<\/a>), and penalties are, again, only applied to the abortionist. All that is left is for Attorney General Leslie Rutledge to certify it.<\/p>\n

When the leaked draft opinion overturning Roe<\/em> went public in May, Rutledge said<\/a> certifying the law would be “the honor and privilege” of her lifetime.\u00a0Governor Asa Hutchinson also celebrated the ruling on Twitter<\/a>.<\/p>\n

“For decades I have said Roe v. Wade was wrongly decided,” he wrote. “Today, the Supreme Court overturned the abortion ruling and returned the issue to the states. Arkansas is a pro-life state, and we are able now to protect life.”<\/p>\n
