Update August 10, 2022:\u00a0<\/strong>Rabbi Barry Silver and his co-plaintiffs, including OB\/GYN Dr. Daniel N. Sacks, two Unitarian reverends, a Buddhist minister, and another rabbi, have filed a new lawsuit claiming that Florida’s law protecting preborn babies from abortion after 15 weeks infringes on the state’s constitutional right to privacy and freedom of religion. Another plaintiff in the case is a woman who “deeply believes that life begins at birth.”<\/p>\n

According to NBC News<\/a>, Sacks claims that the pro-life law has caused him “personal and professional stress as he is now unable — without violating the law and incurring criminal and other sanctions — to provide what he believes to be essential healthcare to his patients.” Abortion is not healthcare and is never medically necessary<\/a>.<\/p>\n

Silver, an attorney, is representing the plaintiffs along with\u00a0David Ferleger of Pennsylvania, Henry Sorett of Massachusetts and Daniel Uhlfelder, a Democratic candidate for Florida attorney general.<\/p>\n

June 18, 2022:<\/strong> A Jewish synagogue and The Satanic Temple make strange bedfellows, but both are suing different states due to their pro-life laws.<\/p>\n

A Florida synagogue, Congregation L\u2019Dor Va-Dor of Boynton Beach, is <\/span>suing<\/span><\/a> the state over its recently enacted protections for preborn children beginning at 15 weeks gestation, set to go into effect July 1. The synagogue claims the law violates that organization\u2019s religious liberty.<\/span><\/p>\n

The <\/span>complaint<\/span><\/a> filed by the synagogue claims: \u201cPlaintiff and its members, congregants and supporters rely on Jewish law and understanding regarding abortion, which differs from the requirements of the [15-week abortion limit], and thus, if the members, congregants and supporters of Plaintiff practice their religion regarding decisions related to abortion, they will be penalized by the state in violation of the Constitution.\u201d The complaint continues,\u00a0<\/span>\u201cIn Jewish law, abortion is required if necessary to protect the health, mental or physical well-being of the woman, or for many other reasons not permitted under the [new law].\u201d <\/span><\/p>\n

Notably, the complaint doesn\u2019t cite the source or text of this alleged Jewish law.<\/span><\/p>\n

However, in her <\/span>op-ed<\/span><\/a> detailing the Jewish pro-life position, the President of the Jewish Pro-Life Foundation disagrees with Congregation L\u2019Dor Va-Dor\u2019s assessment:<\/span><\/p>\n

Jewish law considers abortion to be murder. Moses ben Maimon (Maimonides), an influential Torah scholar, rabbi, legal authority, physician and philosopher, declared in his compilation of Jewish law, the Mishneh Torah: \u201cThe definition of murder according to the Noahide Laws includes a person \u2018who kills even one unborn in the womb of its mother,\u2019 and adds that such a person is liable for the death penalty.\u201d\u00a0<\/span><\/em><\/p>\n

The Talmud, a collection of writings that covers the full gamut of Jewish law and tradition, says that an unborn child is included in the Noahide prohibition of bloodshed that is learned from Genesis 9:6-7: (from a direct translation of the original text) \u201cHe who spills the blood of man within man shall have his blood spilt for in the image of God made He man. And you, be fruitful, and multiply; swarm in the earth, and multiply therein.\u201d The Talmud interprets \u201cthe blood of man in man\u201d to include a child in the womb, which is the blood of man in man. Things that are prohibited under the Noahide laws are also prohibited to Jews.\u00a0<\/span><\/em><\/p>\n

The only other organization to bring litigation against pro-life laws on so-called religious grounds is the Satanic Temple, which recently filed <\/span>suit<\/span><\/a> against the state of Texas\u2019s Heartbeat Act. <\/span><\/p>\n

Lucien Greaves, co-founder of the Satanic Temple, <\/span>claims<\/span><\/a> that abortion is a \u201critualistic practice\u201d for Satanists, and that any abortion restriction \u201c<\/span>infringes<\/span><\/a> upon our members\u2019 rights to engage with their chosen religion and to participate in religious rites and rituals.\u201d Their reasoning is strikingly similar to that of Congregation L\u2019Dor Va-Do, making the two organizations strange bedfellows, indeed.<\/span><\/p>\n

Ironically, the complaint filed by Congregation L\u2019Dor Va-Dor <\/span>states<\/span><\/a>: \u201cFor Jews, all life is precious and thus the decision to bring new life into the world is not taken lightly or determined by state fiat.\u201d The problem with their reasoning is that preborn human beings are already alive, and already exist \u201cin the world.\u201d Therefore, by the synagogue\u2019s own argument, preborn life should be considered \u201cprecious\u201d and worthy of protection.<\/span><\/p>\n
