Several media outlets, <a href=\"https:\/\/www.washingtontimes.com\/news\/2022\/apr\/19\/california-bill-protect-pregnant-women-liability-s\/\" target=\"_blank\" rel=\"noopener\">including Reuters, AP, PolitiFact<\/a>,\u00a0<a href=\"https:\/\/www.factcheck.org\/2022\/04\/california-not-poised-to-legalize-infanticide\/\" target=\"_blank\" rel=\"noopener\">FactCheck.org<\/a>, <a href=\"https:\/\/www.sacbee.com\/news\/politics-government\/capitol-alert\/article260528472.html\" target=\"_blank\" rel=\"noopener\">The Sacramento Bee<\/a> and <a href=\"https:\/\/factcheck.afp.com\/doc.afp.com.327Y7LV?fbclid=IwAR1kfgJ0kRl0pcwsS-vW_FWUDPhaJe_ZlZ0fc-uMw1NzmsKx5M_nUoz4PGA\" target=\"_blank\" rel=\"noopener\">AFP<\/a>, are critical of lawyers and journalists who have highlighted the obvious infanticide provisions of AB 2223.<\/p>\n<p>As background, AB 2223 is one of many bills pushed by the <a href=\"https:\/\/www.cafabcouncil.org\/\">Future of Abortion Council<\/a>, a group of more than 40 abortion advocacy groups, intent upon creating Gov. Gavin Newsom\u2019s \u201csanctuary state\u201d for abortion.<\/p>\n<p>The bill shields women \u2013and anyone assisting them\u2013 from criminal prosecution for the death of a baby due to miscarriage, stillbirths, and abortions . . . but also for perinatal death. \u00a0To be clear, \u201cperinatal death\u201d means the death of a born, living baby up to one month old. \u00a0AB 2223 literally shields women (and those assisting them) for the killing of a one month old baby if the death is \u201cdue to a pregnancy-related cause.\u201d What is a \u201cpregnancy related cause\u201d? No one knows, because it is not defined in the bill or anywhere else. The bill also changes coroner\u2019s duties and\u00a0blocks the use of coroners\u2019 findings concerning such deaths.<\/p>\n<p>The outrage over AB 2223 is that it includes protection against criminal prosecution for such perinatal death. Since the bill\u2019s introduction earlier this year, pro-life lawyers <a href=\"https:\/\/righttolifeleague.org\/california-bill-will-legalize-infanticide\/\" target=\"_blank\" rel=\"noopener\">have<\/a> <a href=\"https:\/\/righttolifeleague.org\/californias-infanticide-bill-distracts-from-abortion-sanctuary-legislation\/\" target=\"_blank\" rel=\"noopener\">repeatedly<\/a> and <a href=\"https:\/\/righttolifeleague.org\/ca-infanticide-bill-rushed-to-next-hearing-april-19th\/\" target=\"_blank\" rel=\"noopener\">specifically<\/a> pointed out how the language of AB 2223 will erode existing state born-alive protection and will legalize the killing of babies born alive up to a month old.<\/p>\n<p>These pro-life lawyers include this author, The President of the Right to Life League, Theresa Brennan, Esq., Alliance Defending Freedom\u2019s senior counsel Denise Burke,\u00a0the CEO of Life Legal, Alexandra Synder, Esq., and Americans United for Life attorney, Katie Glenn, Esq.<\/p>\n<p>Media and journalists reporting these claims include <a href=\"https:\/\/thefederalist.com\/2022\/04\/12\/california-bill-openly-admits-abortion-was-always-about-killing-babies\/\" target=\"_blank\" rel=\"noopener\">The Federalist<\/a>, <a href=\"https:\/\/www.theepochtimes.com\/california-assembly-committee-passes-bill-that-could-legalize-infanticide_4385682.html\" target=\"_blank\" rel=\"noopener\">The Epoch Times<\/a>,\u00a0<a href=\"https:\/\/www.lifesitenews.com\/news\/attorneys-warn-amended-california-abortion-bill-could-still-legalize-infanticide\/\" target=\"_blank\" rel=\"noopener\">LifeSite News<\/a>, <a href=\"https:\/\/archive.liveaction.org\/news\/california-assembly-committee-bill-infanticide\/\" target=\"_blank\" rel=\"noopener\">LiveAction<\/a>, <a href=\"https:\/\/www.ncregister.com\/news\/pro-lifers-press-case-against-calif-law-they-claim-decriminalizes-infanticide\" target=\"_blank\" rel=\"noopener\">The National Catholic Register<\/a>, and <a href=\"https:\/\/www.californiafamily.org\/2022\/04\/pastors-bringing-over-1500-people-to-ca-capitol-tomorrow-to-oppose-infanticide-bill\/\" target=\"_blank\" rel=\"noopener\">California Family Council<\/a>.\u00a0Each lawyer and each reporter has painstakingly and repeatedly explained HOW and WHY the current language of California bill AB 2223 will legalize infanticide.<\/p>\n<h3>BILL\u2019S AUTHOR SMEARS PRO-LIFE LEGAL ANALYSIS \u00a0AS \u201cDISINGENUOUS.\u201d<\/h3>\n<p>Assemblymember Buffy Wicks, the bill\u2019s primary author, is presenting AB 2223 as a compassionate bill to protect grieving parents from rogue prosecution for \u201cpregnancy loss.\u201d<\/p>\n<p>In an <a href=\"https:\/\/perma.cc\/Q6T8-G7BE\" target=\"_blank\" rel=\"noopener\">April 5th post on Twitter<\/a>, Wicks called the pro-life analysis of AB 2223 \u201cabsurd and disingenuous.\u201d She professed her legislative \u201cintent\u201d to protect mothers from prosecution for a \u201cpregnancy loss.\u201d Wicks holds a B.A.\u00a0degree in political science and history from the University of Washington. She is not an attorney and has no legal training.<\/p>\n<p>Her spox, Erin Ivie, pronounced the pro-life legal analysis to be \u201c<a href=\"https:\/\/factcheck.afp.com\/doc.afp.com.327Y7LV?fbclid=IwAR1kfgJ0kRl0pcwsS-vW_FWUDPhaJe_ZlZ0fc-uMw1NzmsKx5M_nUoz4PGA\" target=\"_blank\" rel=\"noopener\">disingenuous<\/a>\u201d while at the same time\u00a0<a href=\"https:\/\/www.washingtontimes.com\/news\/2022\/apr\/19\/california-bill-protect-pregnant-women-liability-s\/\" target=\"_blank\" rel=\"noopener\">admitting to\u00a0PolitiFact<\/a>\u00a0that \u201cthe <strong>perinatal stage is<\/strong> <strong>the period following pregnancy,\u00a0<\/strong>and it is currently undefined when it comes to duration.\u201d\u00a0Ivie herself is disingenuous.<\/p>\n<p>In fact, although not specifically defined in this bill,<strong><b> p<\/b>erinatal death IS\u00a0<a href=\"https:\/\/righttolifeleague.org\/california-bill-will-legalize-infanticide\/\" target=\"_blank\" rel=\"noopener\">already defined in California law<\/a>\u00a0in the Welfare Code<\/strong> to include the period from birth through the first month of life. Fact-checkers <a href=\"https:\/\/www.sacbee.com\/news\/politics-government\/capitol-alert\/article260528472.html\" target=\"_blank\" rel=\"noopener\">agree<\/a> on <a href=\"https:\/\/www.factcheck.org\/2022\/04\/california-not-poised-to-legalize-infanticide\/\" target=\"_blank\" rel=\"noopener\">that definition of perinatal<\/a>, <a href=\"https:\/\/factcheck.afp.com\/doc.afp.com.327Y7LV?fbclid=IwAR1kfgJ0kRl0pcwsS-vW_FWUDPhaJe_ZlZ0fc-uMw1NzmsKx5M_nUoz4PGA\" target=\"_blank\" rel=\"noopener\">too.<\/a><\/p>\n<p>But, rather than specifically explaining how the legal experts are wrong, the fact-checkers simply quote one-liners from Buffy Wicks and a few pro-abortion academics, with absolutely no explanation as to \u201cwhy\u201d the legal scholars are wrong. The pundits and professors quoted by the \u201cfact checkers\u201ddo not explain HOW or WHY the interpretation the pro-life analysis of the proposed statutory language is flawed.\u00a0 It just *IS.* Without analysis, the fact checkers parrot the abortion-industry\u2019s talking points.<\/p>\n<p><strong>READ:\u00a0<em><a href=\"https:\/\/archive.liveaction.org\/news\/california-loophole-alleged-infanticide-passes\/\">Amended California bill with alleged loophole allowing for infanticide passes committee<\/a><\/em><\/strong><\/p>\n<h3>FACT-CHECKING \u201cPREGNANCY LOSS\u201d<\/h3>\n<p>Fact checkers accept Wicks\u2019 <a href=\"https:\/\/perma.cc\/Q6T8-G7BE\" target=\"_blank\" rel=\"noopener\">claim<\/a> that the bill precludes accountability for intentional perinatal deaths at face value.\u00a0 Sadly, Wicks incorrectly asserts that adding the language \u201cdue to pregnancy related cause\u201d narrows the bill\u2019s scope to perinatal deaths due to \u201cpregnancy loss\u201d.<\/p>\n<p>There are at least two major problems with Ms. Wicks\u2019 claim. First, the bill does not define \u201cpregnancy-related cause\u201d. Second, AB 2223 does not use the term \u201cpregnancy loss.\u201d\u00a0 Instead, the bill uses the term \u201cpregnancy outcome\u201d, another vague, undefined term. Unfortunately, the fact checkers accept her claim without further examination.<\/p>\n<h3>WHAT DOES AB 2223 ACTUALLY SAY?<\/h3>\n<p>So, what does AB 2223 actually say? The <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billCompareClient.xhtml?bill_id=202120220AB2223&amp;showamends=false\">current version of the bill<\/a> calls out four categories of pregnancy \u201coutcomes\u201d: 1) miscarriage; 2) stillbirth, 3) abortion and 4) \u201cperinatal death due to a pregnancy related cause.\u201d<\/p>\n<p>It\u00a0will add the following new language to the state\u2019s Health and Safety Code as Section 123467:<\/p>\n<div>\n<blockquote>\n<div><em>\u00a0(a)\u00a0Notwithstanding any other law, a person shall not be subject to civil or criminal liability or penalty, or otherwise deprived of their rights under this article, based on their actions or omissions with respect to their pregnancy or actual, potential, or alleged pregnancy outcome, <strong>including miscarriage, stillbirth, or abortion, or perinatal death due to a pregnancy-related cause. <\/strong>(emphasis added)<\/em><\/div>\n<\/blockquote>\n<\/div>\n<p>The first three categories describe <strong>prenatal<\/strong>\u00a0death of the baby in the womb and before birth. \u00a0The fourth category \u2014 <strong>perinatal death<\/strong>\u2014 describes death AFTER THE BABY IS BORN AND ALIVE outside the womb, for up to one month after birth<\/p>\n<p>To reiterate, the term \u201cperinatal death\u201d is <a href=\"https:\/\/righttolifeleague.org\/california-bill-will-legalize-infanticide\/\">defined in California statutory law<\/a> to be from birth through the 28 days of\u00a0 life.\u00a0 Read California\u2019s <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?lawCode=WIC&amp;sectionNum=14134.5.&amp;article=4.&amp;highlight=true&amp;keyword=PERINATAL\">Article 4. The Medi-Cal Benefits Program<\/a> \u00a7 14134.5(b), effective date January 2020.\u00a0 It is set forth in the California Welfare and Institutions Code <a href=\"https:\/\/www.cdph.ca.gov\/Programs\/CFH\/DMCAH\/CPSP\/CDPH%20Document%20Library\/CPSP-Title22CPSPRegulations.pdf?TSPD_101_R0=087ed344cfab2000ff3c3f6d34fea447e60033af8e7ddd19ee4113b8f1351b6eb262fdc8c8b97ff00823def41a143000feb67310ecd812a0637302b076dbedebd222daea73ef958531cd225f20e314b05498dfa6b15aef88f71ce7f29cfd4684\">here<\/a>.<\/p>\n<p>Notwithstanding Ms. Wicks\u2019 woefully ignorant spin, AB 2223 lumps prenatal and perinatal death together so that the cause of ANY fetal death \u2014 before birth or after birth \u2014 cannot be used to investigate the mother or anyone who assisted in causing that death, which the bill euphemistically refers to as the \u201cpregnancy outcome.\u201d<\/p>\n<h3>WHEN IS IT OK TO KILL A ONE MONTH OLD BABY?<\/h3>\n<p>When is the killing of a one month old baby \u201cpregnancy related?\u201d Neither the indolent media nor the bill\u2019s author will say.\u00a0There is no legal definition given in the bill, which is deliberate. That is because the phrase \u201cdue to a pregnancy-related cause\u201d is so overbroad as to mean virtually anything.<\/p>\n<p>So, the question becomes: \u00a0Exactly WHEN is it ok to kill a one month old baby? \u00a0Neither the bill\u2019s authors nor the fact checkers answer that question. \u00a0They refuse to explain WHY the bill expressly allows for the killing of a born, breathing, living month-old baby such that the mother or anyone else involved cannot be prosecuted.<\/p>\n<p>Rather than confront the shocking drafting issues in AB 2223, the fact checkers simply ignore it.<\/p>\n<p>The announced purpose behind AB 2223 is to protect mothers from prosecution for miscarriages, stillbirths or abortions. But, by definition, <strong>a perinatal death does not include miscarriage, stillbirth or abortion.<\/strong> \u00a0It goes well beyond the pretext of protecting mothers who choose to have abortions or those who suffer stillbirths or miscarriages. It means the death\/killing of a live baby up to one month old.<\/p>\n<h3>AB 2223 PROTECTS THOSE WHO ASSIST IN ABORTIONS AND PERINATAL DEATHS.<\/h3>\n<p>AB 2223 proposes to protect mothers from all civil or criminal liability \u201c<em>based on their actions or omissions with respect to their pregnancy or \u2026 \u00a0alleged pregnancy outcome\u201d.<\/em><\/p>\n<p>Here are some sad and shocking examples of how that might work: A mother who strangles her newborn (an act) or fails to feed her newborn (an omission), is shielded from all liability under AB 2223 if the baby dies. She can assert the death was \u201cdue to a pregnancy-related cause\u201d and she\u2019s protected from civil or criminal liability.<\/p>\n<p>But wait. There\u2019s more.\u00a0 AB 2223 also shields ANYONE who assists a mother in obtaining her desired pregnancy outcome under that new amendment to Health and Safety Code Section 123467:<\/p>\n<blockquote><p><em>(b)\u00a0<strong>A person who aids or assists a pregnant person<\/strong> in exercising their rights under this article <strong>shall not be subject to civil or criminal liability or penalty<\/strong>, or otherwise be deprived of their rights, based solely on their actions to aid or assist a pregnant person in exercising their rights under this article <strong>with the pregnant person\u2019s voluntary consent. <\/strong>(emphasis added)<\/em><\/p><\/blockquote>\n<p>For example, under AB 2223, an abortionist who botches an abortion and delivers a living breathing baby would have up to one month to kill the baby and dispose of the corpse as \u201cmedical waste\u201d, so long as it is done with the mother\u2019s consent.\u00a0 Why?\u00a0 Because it is a perinatal death \u201cdue to a pregnancy related cause\u201d.\u00a0 AB 2223 would shield both the mother and abortionist, not just from prosecution but also, shockingly, from any investigation of the death.<\/p>\n<p>Here\u2019s another consequence of this bill that the fact checkers either fail to perceive or do not acknowledge. If a mother gives birth, and the baby\u2019s daddy is upset she did not get an abortion, if he kills the baby, he would not face criminal prosecution so long as the mother afterward consented and asserted a right to determine her pregnancy outcome within the one month perinatal period.<\/p>\n<h3>AB 2223 DETERS INVESTIGATION OF NEWBORN DEATHS<\/h3>\n<p>AB 2223 creates a private, civil cause of action for violation of the bill\u2019s privacy right.
