In reality, the charges against her had nothing to do with the Texas Heartbeat Act.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cYesterday afternoon, I reached out to counsel for Ms. Lizelle Herrera to advise him that my office will be filing a motion dismissing the indictment against Ms. Herrera Monday, April 11, 2022,\u201d Starr County District Attorney Gocha Allen Ramirez wrote in a Sunday <\/span><a href=\"https:\/\/www.facebook.com\/photo\/?fbid=387792383351845&amp;set=a.293809186083499\"><span style=\"font-weight: 400;\">statement<\/span><\/a><span style=\"font-weight: 400;\">. \u201cIn reviewing applicable Texas law, it is clear that Ms. Herrera cannot and should not be prosecuted for the allegation against her.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to <\/span><a href=\"https:\/\/abcnews.go.com\/Health\/wireStory\/texas-da-murder-charge-abortion-case-dropped-83998374\"><span style=\"font-weight: 400;\">ABC News<\/span><\/a><span style=\"font-weight: 400;\">, Herrera was arrested Thursday in Rio Grande City after a Starr County grand jury indicted her on March 30 for allegedly causing \u201cthe death of an individual&#8230;by self-induced abortion.&#8221; She was released Saturday after posting a $500,000 bond.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The case attracted attention from abortion advocacy groups like La Frontera Fund, which held a small protest over the weekend outside the Starr County Sheriff\u2019s Office. As <\/span><a href=\"https:\/\/www.reuters.com\/world\/us\/prosecutor-drop-charges-against-texas-woman-over-her-abortion-2022-04-10\/\"><span style=\"font-weight: 400;\">Reuters<\/span><\/a><span style=\"font-weight: 400;\"> reported, the group\u2019s leader, Rickie Gonzalez, claimed hospital staff or administration reported Herrera to the authorities after she miscarried at the hospital and admitted she had attempted to induce an abortion.\u00a0<\/span><\/p>\n<p><strong>READ:\u00a0<em><a href=\"https:\/\/archive.liveaction.org\/news\/murder-expectant-couple-new-york-fetal-homicide\/\">Man arrested for murder of expectant couple in New York won\u2019t be charged with fetal homicide<\/a><\/em><\/strong><\/p>\n<p><span style=\"font-weight: 400;\">In his statement, the Texas district attorney said the sheriff\u2019s department did its job by investigating the claims brought forth by the hospital, noting that ignoring the incident would have been a \u201cdereliction of their duty.\u201d While Ramirez stated the \u201cissues surrounding this matter are clearly contentious,\u201d the case\u2019s dismissal made it clear Herrera \u201cdid not commit a criminal act under the laws of the State of Texas.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">With certain media outlets and abortion advocates offering misleading information on the case, putting an unfair spin on Texas\u2019s abortion restrictions, it\u2019s worth separating fact from fiction to prevent any distrust of laws intended to protect the preborn.\u00a0<\/span><\/p>\n<p><b>The Texas Heartbeat Bill Does Not Target Women<\/b><\/p>\n<p><a href=\"https:\/\/www.houstonchronicle.com\/news\/houston-texas\/trending\/article\/texas-abortion-law-facts-17072709.php\"><span style=\"font-weight: 400;\">The Houston Chronicle<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/www.rollingstone.com\/culture\/culture-news\/texas-woman-murder-self-induced-abortion-1335293\/\"><span style=\"font-weight: 400;\">Rolling Stone<\/span><\/a><span style=\"font-weight: 400;\"> framed the story as if the charges against Herrera were tied to the <\/span><a href=\"https:\/\/capitol.texas.gov\/tlodocs\/86R\/billtext\/pdf\/HB01500I.pdf\"><span style=\"font-weight: 400;\">Texas Heartbeat Act (SB 8)<\/span><\/a><span style=\"font-weight: 400;\">, a bill banning abortions after an embryonic heartbeat becomes detectable. But the charges against Herrera had nothing to do with the Heartbeat Act, and any attempt to connect her arrest to the bill is misleading at best and downright deceptive at worst. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Heartbeat Act is considered unique among pro-life legislation, as it allows non-government individuals, including a woman who had an abortion, to sue an abortionist who violates the law.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In its reporting, <\/span><span style=\"font-weight: 400;\">Rolling Stone <\/span><span style=\"font-weight: 400;\">linked the timing of Herrera\u2019s arrest to the passage of SB 8, which went into effect last September, and the Chronicle claimed the case signaled that \u201cit&#8217;s time for a refresher on what exactly Texas&#8217; abortion law is.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As the Chronicle acknowledged later in the article, however, SB 8 <em>does not authorize<\/em> private citizens to sue women who attempt to or have had an abortion. The bill also <em>does not allow<\/em> women to be prosecuted for an abortion, with the text stating it does <strong>not<\/strong> \u201cauthorize the initiation of a cause of action against or the prosecution of a woman on whom an abortion is performed or induced or attempted to be performed or induced in violation of this subchapter.\u201d\u00a0<\/span><\/p>\n<p><b>How Texas Protects Women from Criminal Abortion Liability\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Planned Parenthood President Alexis McGill Johnson<\/span> <a href=\"https:\/\/twitter.com\/alexismcgill\/status\/1513214617987829760?ref_src=twsrc%5Etfw\"><span style=\"font-weight: 400;\">tweeted<\/span><\/a> <span style=\"font-weight: 400;\">Sunday that, even though the charges against Herrera were dismissed, \u201cthe fight against the criminalization of pregnancy outcomes has only just begun.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">But Texas already has measures to protect pregnant women from criminal charges, which may explain why the charges against Herrera were dismissed.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Daniel Gump, author of <\/span><span style=\"font-weight: 400;\">\u201c<\/span><a href=\"https:\/\/www.amazon.com\/Criminal-Abortion-Before-Fourteenth-Amendment\/dp\/B09GTP4NNJ\"><span style=\"font-weight: 400;\">Criminal Abortion Laws Before the Fourteenth Amendment: A Timeline and Visual Review of Jurisprudence and Historical Milestones<\/span><\/a><span style=\"font-weight: 400;\">,\u201d<\/span><span style=\"font-weight: 400;\"> told Live Action News how the situation with Herrera appeared to reflect what usually happens when women are charged with crimes for self-induced abortions. After the hospital contacts the police, authorities typically file charges related to a potential instance of fetal homicide \u2014\u00a0charges which are later dropped after the district attorney looks deeper into the statutes to find maternal exemptions to the crime.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to Gump, maternal exemptions prevent the prosecution of a woman whose pregnancy may have ended abruptly. The legal researcher related the situation in Texas to a 2019 incident involving <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/pregnant-alabama-woman-shot-baby-manslaughter\/\"><span style=\"font-weight: 400;\">Marshae Jones<\/span><\/a><span style=\"font-weight: 400;\"> in Alabama, another example of abortion advocates using a case against a pregnant woman to malign a pro-life law. While pregnant, Jones allegedly attacked Ebony Jamison, who fired a handgun in self-defense, resulting in the death of Jones\u2019s preborn child.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As Gump noted, while Jones was initially charged with instigating a fight that resulted in the murder of a bystander, the \u201ccharges were dropped under Alabama\u2019s maternal exemption provision of AL Code \u00a7 13A-6-1(d)(2).\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Regarding the charges against Herrera in Texas, Gump noted that the state\u2019s laws on maternal exemptions would have prevented a conviction. He also highlighted his <\/span><a href=\"https:\/\/www.patreon.com\/posts\/maternal-for-by-31241810\"><span style=\"font-weight: 400;\">research<\/span><\/a><span style=\"font-weight: 400;\"> into the immunity against prosecution of the woman seen in Texas and other states throughout the country, a project he undertook in response to claims that broadly establishing the personhood of the preborn would lead to the prosecution of women for illegal abortions or miscarriages.<\/span><\/p>\n<p><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter wp-image-266271 \" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2022\/04\/tx-penal-code.jpg\" alt=\"\" width=\"629\" height=\"236\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2022\/04\/tx-penal-code.jpg 600w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2022\/04\/tx-penal-code-300x113.jpg 300w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2022\/04\/tx-penal-code-500x188.jpg 500w\" sizes=\"(max-width: 629px) 100vw, 629px\" \/><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe target of criminal abortions has always been the providers. These maternal exemptions solidify that premise in statutory law.
