{"id":265999,"date":"2022-04-14T12:44:33","date_gmt":"2022-04-14T17:44:33","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=265999"},"modified":"2022-04-19T23:26:36","modified_gmt":"2022-04-20T04:26:36","slug":"conscience-rights-protections-pro-life-health-care","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/conscience-rights-protections-pro-life-health-care\/","title":{"rendered":"Conscience Rights: What protections do pro-life health care professionals have?"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><span style=\"font-weight: 400;\">With states like <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/marylands-pro-life-governor-bill-expanding-abortion\/\"><span style=\"font-weight: 400;\">Maryland<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/colorado-senate-abortion-limits-governor\/\"><span style=\"font-weight: 400;\">Colorado<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/oregon-allow-death-tourism\/\"><span style=\"font-weight: 400;\">Oregon<\/span><\/a><span style=\"font-weight: 400;\">, and <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/california-infant-death-neglect\/\"><span style=\"font-weight: 400;\">California<\/span><\/a><span style=\"font-weight: 400;\"> expanding assisted suicide and rushing to enact extreme pro-abortion, and even pro-infanticide, legislation, pro-life health care professionals may be feeling increasingly pressured to participate in such acts. What protections are afforded to them under the law, should they conscientiously refuse to do so?<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The United States has a noble tradition of protecting conscience rights. The Americans United for Life website <\/span><a href=\"https:\/\/aul.org\/2021\/10\/15\/why-state-conscience-laws-matter-more-than-ever\/\"><span style=\"font-weight: 400;\">notes<\/span><\/a><span style=\"font-weight: 400;\">:\u00a0<\/span><\/p>\n<p style=\"padding-left: 30px;\"><em><span style=\"font-weight: 400;\">History, tradition, and jurisprudence affirm that a person cannot be forced to commit an act that is against his or her moral, religious, or conscientious beliefs, and conscience protections have been affirmed by our Founders, the Supreme Court, and Congress.<\/span><\/em><\/p>\n<p><span style=\"font-weight: 400;\">The Founders recognized freedom of conscience as an unalienable right. Thomas Jefferson <\/span><a href=\"https:\/\/tjrs.monticello.org\/letter\/2260\"><span style=\"font-weight: 400;\">wrote<\/span><\/a><span style=\"font-weight: 400;\">, &#8220;<\/span><span style=\"font-weight: 400;\">[O]ur rulers can have authority over such natural rights only as we have submitted to them. The rights of conscience we never submitted, we could not submit. We are answerable for them to our God.&#8221;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Similarly, James Madison, considered the Father of the Bill of Rights, <\/span><a href=\"https:\/\/aul.org\/2021\/10\/15\/why-state-conscience-laws-matter-more-than-ever\/\"><span style=\"font-weight: 400;\">understood<\/span><\/a><span style=\"font-weight: 400;\">:<\/span><\/p>\n<p style=\"padding-left: 30px;\"><em><span style=\"font-weight: 400;\">[I]f man cannot be loyal to himself, to his conscience, then a government cannot expect him to be loyal to less compelling obligations, including rules, statutes, judicial orders, and professional duties. If the government demands that he betray his conscience, the government has eliminated the only moral basis for obeying any law.<\/span><\/em><\/p>\n<p><span style=\"font-weight: 400;\">The Supreme Court has traditionally upheld conscience rights. In 2014, it <\/span><a href=\"https:\/\/www.supremecourt.gov\/opinions\/19pdf\/19-431_5i36.pdf\"><span style=\"font-weight: 400;\">ruled<\/span><\/a><span style=\"font-weight: 400;\"> in <\/span><i><span style=\"font-weight: 400;\">Burwell v Hobby Lobby<\/span><\/i><span style=\"font-weight: 400;\"> that closely held corporations with sincerely held religious objections were not required to provide certain types of contraception coverage under the Affordable Care Act. This right was again <\/span><a href=\"https:\/\/aul.org\/2020\/07\/08\/supreme-court-upholds-freedom-of-conscience-protections\/\"><span style=\"font-weight: 400;\">affirmed<\/span><\/a><span style=\"font-weight: 400;\"> in <\/span><i><span style=\"font-weight: 400;\">Little Sisters of the Poor v. Pennsylvania<\/span><\/i><span style=\"font-weight: 400;\">, a similar case. Cases involving religious objections to the Pledge of Allegiance and conscientious objections to participating in war have been similarly <\/span><a href=\"https:\/\/aul.org\/2021\/10\/15\/why-state-conscience-laws-matter-more-than-ever\/\"><span style=\"font-weight: 400;\">decided<\/span><\/a><span style=\"font-weight: 400;\"> in favor of individual conscience.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Federal law provides a variety of legal protections for health care workers who object to participating in certain acts on conscience grounds. The <\/span><a href=\"https:\/\/www.hhs.gov\/sites\/default\/files\/ocr\/civilrights\/understanding\/ConscienceProtect\/42usc300a7.pdf\"><span style=\"font-weight: 400;\">Church Amendments<\/span><\/a><span style=\"font-weight: 400;\">, passed just weeks after the Supreme Court decided <\/span><i><span style=\"font-weight: 400;\">Roe v Wade<\/span><\/i><span style=\"font-weight: 400;\">, were enacted to protect freedom of conscience with regard to abortion and sterilization. They forbid forcing an individual\u2019s participation in either practice and prohibit discrimination in employment based on an individual\u2019s conscientious refusal to participate.\u00a0<\/span><\/p>\n<p><a href=\"https:\/\/aul.org\/2021\/10\/15\/why-state-conscience-laws-matter-more-than-ever\/\"><span style=\"font-weight: 400;\">According<\/span><\/a><span style=\"font-weight: 400;\"> to Americans United for Life, the <\/span><a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/42\/238n\"><span style=\"font-weight: 400;\">Coates-Snow Amendment<\/span><\/a><span style=\"font-weight: 400;\"> of 1995 similarly\u00a0<\/span><span style=\"font-weight: 400;\">prohibits the federal government and any state or local government receiving federal financial assistance from discriminating against any healthcare entity, which includes individual physicians and students, for refusing to provide or participate in training for abortions, do abortions, or refer for trainings or for abortion procedures.<\/span><\/p>\n<p><strong>READ:\u00a0<em><a href=\"https:\/\/archive.liveaction.org\/news\/hhs-secretary-becerra-violated-federal-conscience-protections\/\">HHS Secretary Becerra refuses to address GOP accusations that he violated federal conscience protections<\/a><\/em><\/strong><\/p>\n<p><a href=\"https:\/\/www.hhs.gov\/sites\/default\/files\/ocr\/civilrights\/understanding\/ConscienceProtect\/42usc238n.pdf\"><span style=\"font-weight: 400;\">Section 245<\/span><\/a><span style=\"font-weight: 400;\"> of the Public Health Service Act and the <\/span><a href=\"https:\/\/www.hhs.gov\/sites\/default\/files\/ocr\/civilrights\/understanding\/ConscienceProtect\/publaw111_117_123_stat_3034.pdf\"><span style=\"font-weight: 400;\">Weldon Amendment<\/span><\/a><span style=\"font-weight: 400;\"> of 2005 provide similar <\/span><a href=\"https:\/\/www.hhs.gov\/conscience\/conscience-protections\/index.html\"><span style=\"font-weight: 400;\">protections<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"http:\/\/www.healthcare.gov\/law\/introduction\/index.html\"><span style=\"font-weight: 400;\">Affordable Care Act<\/span><\/a><span style=\"font-weight: 400;\"> also has conscience protections built in. Section 1303(b)(4) states: \u201cNo qualified health plan offered through an Exchange may discriminate against any individual health care provider or health care facility because of its unwillingness to provide, pay for, provide coverage of, or refer for abortions.\u201d <\/span><a href=\"https:\/\/www.hhs.gov\/civil-rights\/for-individuals\/refusal-provide-assisted-suicide-services\/index.html\"><span style=\"font-weight: 400;\">Section 1553<\/span><\/a><span style=\"font-weight: 400;\"> broadens this protection to participation in killing generally, including euthanasia and assisted suicide.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, these protections only apply to recipients of federal funding, and are subject to the whim of bureaucrats. <\/span><a href=\"https:\/\/aul.org\/2021\/10\/15\/why-state-conscience-laws-matter-more-than-ever\/\"><span style=\"font-weight: 400;\">According<\/span><\/a><span style=\"font-weight: 400;\"> to Americans United for Life, \u201can individual cannot file a lawsuit under these laws on their own behalf, and instead must file a complaint for HHS to investigate and pursue.\u201d Consequently, when any particular administration happens to be unfriendly toward conscience protections, including and especially the current administration, there is no guarantee of justice for individuals, since HHS can simply choose not to act.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In September of 2021, HHS under <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/senate-confirms-pro-abortion-becerra-hhs\/\"><span style=\"font-weight: 400;\">Xavier Becerra<\/span><\/a><span style=\"font-weight: 400;\"> issued \u201c<\/span><a href=\"https:\/\/www.hhs.gov\/conscience\/conscience-protections\/guidance-church-amendments-protections\/index.html\"><span style=\"font-weight: 400;\">Guidance<\/span><\/a><span style=\"font-weight: 400;\"> on Nondiscrimination Protections under the Church Amendments,\u201d repositioning the emphasis thereof to highlight protections for those who <\/span><i><span style=\"font-weight: 400;\">do<\/span><\/i><span style=\"font-weight: 400;\"> participate in abortion. Becerra has also been <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/hhs-secretary-becerra-violated-federal-conscience-protections\/\"><span style=\"font-weight: 400;\">accused<\/span><\/a><span style=\"font-weight: 400;\"> of acting in violation of federal conscience protections by <\/span><a href=\"https:\/\/dailycaller.com\/2021\/08\/11\/xavier-becerra-merrick-garland-hhs-doj-abortion-lawsuit-conscience-protection-laws-james-lankford-tom-cotton\/\"><span style=\"font-weight: 400;\">senators and members of Congress<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Furthermore, it is <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/biden-hhs-regulations-threatening-conscience-protections\/\"><span style=\"font-weight: 400;\">expected<\/span><\/a><span style=\"font-weight: 400;\"> that the Biden administration will issue new HHS rule changes this month that will disallow religious objections to participation in surgical abortion, fertility treatments, contraception, abortifacients, sterilizations, and a variety of transgender-related procedures. Americans United for Life <\/span><a href=\"https:\/\/aul.org\/2021\/10\/15\/why-state-conscience-laws-matter-more-than-ever\/\"><span style=\"font-weight: 400;\">notes<\/span><\/a>,<span style=\"font-weight: 400;\">\u00a0\u201cThe Biden Administration has made it clear that it will not defend longstanding federal conscience protections \u2014 unless you\u2019re an abortionist in Texas who wants to violate the Heartbeat Act.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For these reasons, <\/span><a href=\"https:\/\/aul.org\/2021\/10\/15\/why-state-conscience-laws-matter-more-than-ever\/\"><span style=\"font-weight: 400;\">state<\/span><\/a><span style=\"font-weight: 400;\"> conscience protections are needed. However, only two states \u2013 Illinois and Mississippi \u2013 provide blanket protection for all health care providers who refuse on a conscientious basis to participate in any health care procedure or service. Forty-five states provide protection only to certain providers, or only with regard to certain specific procedures (usually abortion). Three states provide no protection whatsoever: New Hampshire, New Mexico, and Vermont.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you feel your conscience rights have been violated, <\/span><a href=\"https:\/\/www.freedom2care.org\/\"><span style=\"font-weight: 400;\">Freedom2Care<\/span><\/a><span style=\"font-weight: 400;\"> has excellent resources for health care providers, including commentary on relevant legislation, advocacy tips, and personal stories. Legal counsel is also available from organizations such as <\/span><a href=\"https:\/\/lifelegaldefensefoundation.org\/\"><span style=\"font-weight: 400;\">Life Legal Defense Foundation<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/adflegal.org\/\"><span style=\"font-weight: 400;\">Alliance Defending Freedom<\/span><\/a><span style=\"font-weight: 400;\">, and <\/span><a href=\"https:\/\/lc.org\/\"><span style=\"font-weight: 400;\">Liberty Counsel<\/span><\/a><span style=\"font-weight: 400;\">.
