{"id":265844,"date":"2022-04-07T15:38:44","date_gmt":"2022-04-07T20:38:44","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=265844"},"modified":"2022-04-07T14:17:24","modified_gmt":"2022-04-07T19:17:24","slug":"biden-hhs-regulations-threatening-conscience-protections","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/biden-hhs-regulations-threatening-conscience-protections\/","title":{"rendered":"Biden HHS to release new regulations threatening conscience protections, group claims"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><span style=\"font-weight: 400;\">According to <\/span><a href=\"https:\/\/www.catholicnews.com\/hhs-expected-to-propose-health-care-rule-on-abortion-transgender-services\/\"><span style=\"font-weight: 400;\">Catholic News Service<\/span><\/a><span style=\"font-weight: 400;\">, leadership at the Catholic Benefits Association believes the U.S. Department of Health and Human Services (HHS) will announce new regulations, perhaps as soon as this month, that will threaten conscience protections for health care professionals.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A 74-page legal memorandum prepared by the <\/span><a href=\"https:\/\/civilrights.org\/\"><span style=\"font-weight: 400;\">Leadership Conference<\/span><\/a><span style=\"font-weight: 400;\"> and discovered in November of last year revealed that HHS has promised to revise regulations with regard to health plan coverage to include surgical abortion, fertility treatments, contraception, abortifacients, and sterilizations, as well as a variety of transgender-related procedures.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe memo prepared by the Leadership Conference provides the best forecast of what the new regulation will say. \u2026 [T]here is good reason to believe that it will be quite similar to the memo signed on by 30 sexual rights activist groups including Planned Parenthood,\u201d <\/span><a href=\"https:\/\/www.catholicnews.com\/hhs-expected-to-propose-health-care-rule-on-abortion-transgender-services\/\"><span style=\"font-weight: 400;\">according<\/span><\/a><span style=\"font-weight: 400;\"> to attorney Martin Nussbaum, advisor to the Catholic Benefits Association. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">It is expected that the new regulations will disallow religious exemptions.<\/span><\/p>\n<p><strong>READ:\u00a0<em><a href=\"https:\/\/archive.liveaction.org\/news\/hhs-floods-planned-parenthood-taxpayer-dollars\/\">HHS floods Planned Parenthood with hundreds of millions more in taxpayer dollars<\/a><\/em><\/strong><\/p>\n<p><span style=\"font-weight: 400;\">These regulations would apply to <\/span><a href=\"https:\/\/www.hhs.gov\/civil-rights\/for-individuals\/section-1557\/index.html\"><span style=\"font-weight: 400;\">section 1557<\/span><\/a><span style=\"font-weight: 400;\"> of the Affordable Care Act, which prohibits discrimination based on race, color, national origin, age, disability, sex, pregnancy, sexual orientation, and gender identity. They would <\/span><span style=\"font-weight: 400;\">likely apply to all health care providers, clinics, nursing homes, hospitals, group health insurers, and third-party administrators of self-funded plans.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cAnd if the new regulation applies to all of those groups, it will effectively apply to all employers with a health plan,\u201d Nussbaum <\/span><a href=\"https:\/\/www.catholicnews.com\/hhs-expected-to-propose-health-care-rule-on-abortion-transgender-services\/\"><span style=\"font-weight: 400;\">said<\/span><\/a><span style=\"font-weight: 400;\">. \u201c[T]he penalties to noncompliance will likely include private enforcement, class-action lawsuits, \u2018qui tam\u2019 actions, which is where an individual can file a lawsuit as if he or she were the United States itself,\u201d Nussbaum explained. \u201cThe penalties may also include loss of Medicare and Medicaid funding and even imprisonment for noncomplying health care executives.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Doug Wilson, CEO of the Catholic Benefits Association, believes the anticipated regulations represent \u201ca well-crafted and well-thought out way\u201d to oust religion from the health care field. \u201cThe Leadership Conference\u2019s demands are very clear,\u201d he stated. \u201cThere must be no religious exemptions from this.
