{"id":265286,"date":"2022-03-30T08:34:54","date_gmt":"2022-03-30T13:34:54","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=265286"},"modified":"2022-03-28T23:36:11","modified_gmt":"2022-03-29T04:36:11","slug":"california-infant-death-neglect","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/california-infant-death-neglect\/","title":{"rendered":"New California bill&#8217;s wording appears to allow infanticide by neglect"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>(<a href=\"https:\/\/www.nationalreview.com\/corner\/now-a-california-bill-to-permit-infant-death-by-neglect\/\" target=\"_blank\" rel=\"noopener\">National Review<\/a>) A little while ago I highlighted\u00a0<a href=\"https:\/\/www.nationalreview.com\/corner\/maryland-bill-effectively-decriminalizes-neglecting-newborns-to-death\/\" target=\"_blank\" rel=\"noopener\">a shocking Maryland<\/a>\u00a0bill that would essentially decriminalize neglecting an infant to death in the \u201cperinatal\u201d period \u2014 i.e., through the first 28 days after birth \u2014 by preventing investigations and prosecution of such deaths that resulted from \u201ca failure to act.\u201d<\/p>\n<p>I was interviewed on several talk-radio programs and was asked what the sponsor was thinking. My most charitable thought was that he was unaware of the definition of \u201cperinatal.\u201d<\/p>\n<p>That \u201cdefense\u201d is now inoperative. A bill was just filed in the California Legislature that is even worse than the Maryland legislation.<\/p>\n<p>First, it would seem to create a broad claim for \u201cpeople who give birth\u201d to choose not to be a parent that is not limited to not getting pregnant, or in the context of the overall bill, abortion. Somehow, this is called \u201creproductive justice\u201d and given a racial tinge.\u00a0<a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202120220AB2223\" target=\"_blank\" rel=\"noopener\">From AB 2223<\/a>\u00a0(my emphasis throughout):<\/p>\n<p style=\"padding-left: 30px;\">SECTION 1. The Legislature finds and declares all of the following:<\/p>\n<p style=\"padding-left: 30px;\">(a)\u00a0Reproductive justice is a framework created by Black women in 1994 to address the intersectional and multifactored issues that women of color and their families face in society.<\/p>\n<p style=\"padding-left: 30px;\">(b) Reproductive justice is the human right to control our bodies, sexuality, gender, work, and reproduction. That right can only be achieved when all people, particularly women and girls, have the complete economic, social, and political power and resources to make healthy decisions about their bodies, families, and communities in all areas of their lives. At the core of reproductive justice is the belief in the right to bodily autonomy, the right to have children,\u00a0<em>the right to not have children<\/em>, and the right to parent the children we have with dignity and respect in safe and sustainable communities.<\/p>\n<p style=\"padding-left: 30px;\">(c) A critical part of realizing reproductive justice for people in California is clarifying that\u00a0<em>there shall be no civil and criminal penalties for people\u2019s actual, potential, or alleged pregnancy outcomes<\/em>.<\/p>\n<p>Okay. Let\u2019s be careful. Perhaps that wording just applies to preborn babies or the right not to get pregnant at all.<\/p>\n<p>Nope. It also applies to\u00a0<em>perinatal outcomes<\/em>, as well as \u201c<em>postpartum care<\/em>\u201d:<\/p>\n<p style=\"padding-left: 30px;\">The Legislature finds and declares that every individual possesses a\u00a0<em>fundamental right of privacy with respect to personal reproductive decisions<\/em>, which entails the right to make and effectuate decisions<em>\u00a0about all matters relating to pregnancy, including prenatal care, childbirth, postpartum care<\/em>, contraception, sterilization, abortion care, miscarriage management, and infertility care.<\/p>\n<p>What is postpartum care? I looked it up and\u00a0<a href=\"https:\/\/www.encyclopedia.com\/medicine\/encyclopedias-almanacs-transcripts-and-maps\/postpartum-care#:~:text=Definition%20Postpartum%20care%20encompasses%20management%20of%20the%20mother%2C,mother%27s%20postpartum%20check-up%20with%20her%20health%20care%20provider.?msclkid=3522ef62ac4d11ec88e70dc0ee0cca31\" target=\"_blank\" rel=\"noopener\">learned\u00a0<\/a>that it \u201cencompasses management of the mother, newborn, and infant during the postpartal period. This period usually is considered to be the first few days after delivery, but technically it includes the six-week period after\u00a0<b>childbirth<\/b>\u00a0up to the mother\u2019s postpartum check-up with her health care provider.\u201d Good grief.<\/p>\n<p>Here is the key passage:<\/p>\n<p style=\"padding-left: 30px;\">123467. (a) Notwithstanding any other law,\u00a0<em>a person shall not be subject to civil or criminal liability or penalty, or otherwise deprived of their rights, based on their actions or omissions<\/em>\u00a0with respect to their pregnancy or actual, potential,\u00a0<em>or alleged pregnancy outcome, including miscarriage, stillbirth, or abortion, or perinatal death<\/em>.<\/p>\n<p>In analyzing this, we have to assume that the bill means what it says: No \u201ccivil or criminal liability or penalty . . . based on their actions or omissions with respect to . . . perinatal outcomes.\u201d Come to think of it, &#8220;actions\u201d could be interpreted to mean active killing, couldn\u2019t it?<\/p>\n<p><strong>READ: <a href=\"https:\/\/archive.liveaction.org\/news\/colorado-senate-abortion-limits-governor\/\" target=\"_blank\" rel=\"noopener\"><em>Colorado Senate approves abortion bill without limits, governor expected to sign<\/em><\/a><\/strong><\/p>\n<p>As in the Maryland law, if a state actor seeks to bring an action against people who give birth or those who help them \u201cbased on their actions or omissions\u201d with regard to \u201cperinatal death,\u201d that person or entity can be sued:<\/p>\n<p style=\"padding-left: 30px;\">23469. (a) A party aggrieved by conduct or regulation in violation of this article may bring a civil action against an offending state actor in a federal district court or state superior court. A state claim brought in federal district court shall be a supplemental claim to a federal claim.<\/p>\n<p>Nothing in this bill would limit the license granted to the context of a baby surviving an abortion, which would be horrible enough. Rather, the freedom granted from civil and criminal liability would seem to apply generally.<\/p>\n<p>One blue-state bill that would allow a born baby to be neglected to death might be an anomaly. A second that does that \u2014 and perhaps could be interpreted to allow infanticide, also \u2014\u00a0<em>is a pattern<\/em>.
