{"id":263460,"date":"2022-03-01T14:45:00","date_gmt":"2022-03-01T20:45:00","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=263460"},"modified":"2022-02-28T18:16:47","modified_gmt":"2022-03-01T00:16:47","slug":"fired-pregnancy-condition","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/fired-pregnancy-condition\/","title":{"rendered":"Woman wins lawsuit against boss who became &#8216;hostile&#8217; due to her difficult pregnancy"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>A law firm receptionist was reportedly fired from her job due to a pregnancy condition that was \u201cinconvenient\u201d for her boss.<\/p>\n<p>As <a href=\"https:\/\/www.thesun.co.uk\/news\/17692487\/mum-fired-pregnancy-same-condition-kate-middleton\/\" target=\"_blank\" rel=\"noopener\">The Sun<\/a> reported, Kiran Nasreen told her boss, Dr. Akbar Ali Malik, that she was unable to work after being diagnosed with <a href=\"https:\/\/americanpregnancy.org\/healthy-pregnancy\/pregnancy-complications\/hyperemesis-gravidarum\/\" target=\"_blank\" rel=\"noopener\">hyperemesis gravidarum<\/a>, which can cause severe nausea and vomiting during pregnancy. But Nasreen\u2019s calls and texts were seemingly ignored, prompting her husband to visit the office on his wife\u2019s behalf to explain the situation.<\/p>\n<p>During an employment tribunal, it was revealed to the panel that Malik was \u201chostile,\u201d refusing to accept Nasreen\u2019s sick notes, as well as medical evidence of her condition. Dr. Malik said Nasreen \u201cwas no longer needed,\u201d despite having worked at the firm for three years.<\/p>\n<p>According to the <a href=\"https:\/\/www.dailymail.co.uk\/news\/article-10543385\/Law-firm-receptionist-wins-25k-pregnancy-discrimination-unfair-dismissal-claims.html\" target=\"_blank\" rel=\"noopener\">Daily Mail<\/a>, Nasreen attempted to persuade Malik to reconsider his decision to fire her. But all she received was her Christmas bonus and December payment, even though she had been working until January 20. Nasreen successfully sued for pregnancy discrimination, unauthorized deduction from wages, and unfair dismissal, the outlet reported.<\/p>\n<p><strong>READ: <em><a href=\"https:\/\/archive.liveaction.org\/news\/fired-pregnant-uk-mom-fights-pregnancy-discrimination\/\" target=\"_blank\" rel=\"noopener\">Fired for being pregnant, this UK mom now fights against pregnancy discrimination<\/a><\/em><\/strong><\/p>\n<p>During the panel, Employment Judge David Massarella noted that Malik took \u201cnone of the usual steps in relation to a pregnant employee,\u201d emphasizing how he appeared to treat her differently after learning about her condition. \u201cWe infer from all the evidence that [Dr. Malik\u2019s] attitude to her changed when he realized she was having a difficult pregnancy,\u201d Judge Massarella said. \u201cWhich was giving rise to a protracted period of sickness absence and (inevitably) a period of maternity leave.<\/p>\n<p>Nasreen and her boss reportedly had a good working relationship, according to the outlet. After she and her husband tried for a long time to have a baby, Nasreen eventually became pregnant in December 2017. Immediately at the start of her pregnancy, however, Nasreen began to suffer from adverse symptoms, such as severe sickness.<\/p>\n<p>Due to her health, Nasreen informed Malik about the pregnancy the following month and that she may also need some time off.<\/p>\n<p>\u201cThis was inconvenient to the firm and Dr. Malik decided to dispense with her services in a summary fashion,\u201d Massarella said. \u201cThe problems only arose after she became pregnant.
