Photo Credit: Heidi Miller<\/p><\/div>\n<p>Earlier this week, Rives M. Grogan decided to stage a protest during Obama\u2019s inauguration. From his perch on the top of a tree, he protested and held a sign: \u201cPray to end abortion.\u201d When he came down five hours later, he was arrested.<\/p>\n<p><a href=\"http:\/\/www.washingtonpost.com\/local\/attorneys-question-order-to-ban-protester-from-district-as-too-broad\/2013\/01\/23\/10d6ce34-6595-11e2-b84d-21c7b65985ee_story.html\">According to <em>The Washington Post<\/em><\/a>, the U.S. attorney\u2019s office asked the Magistrate Judge for an order banning Grogan from some of the governmental buildings of Washington, D.C., including the Capitol, congressional office buildings, the U.S. Supreme Court, and the Library of Congress. Magistrate Judge Karen Howze took the request a step further and banned Grogan from the city until his next court date of February 25. This order came while the case was still pending, meaning that Grogan has not yet been convicted.<\/p>\n<p>This surprised many people, including Grogan, and <a href=\"http:\/\/www.washingtonpost.com\/local\/attorneys-question-order-to-ban-protester-from-district-as-too-broad\/2013\/01\/23\/10d6ce34-6595-11e2-b84d-21c7b65985ee_story.html\">called into question<\/a> his First Amendment right to freedom of speech:<\/p>\n<blockquote><p>I don\u2019t know why they would ban me from all of Washington.\u00a0 I think they are totally suppressing my freedom of speech.<\/p><\/blockquote>\n<p>The judge <a href=\"http:\/\/www.washingtonpost.com\/local\/attorneys-question-order-to-ban-protester-from-district-as-too-broad\/2013\/01\/23\/10d6ce34-6595-11e2-b84d-21c7b65985ee_story.html\">weighed<\/a> free speech issues with issues of protecting the community, finding that the danger to the community was more important than free speech:<\/p>\n<blockquote><p>While trying to exercise free speech, the more .,. these things happen, the more you put yourself in jeopardy because we have to determine if this is a danger to the community.<\/p><\/blockquote>\n<p>President of the Rutherford Institute John Whitehead <a href=\"http:\/\/www.washingtonpost.com\/local\/attorneys-question-order-to-ban-protester-from-district-as-too-broad\/2013\/01\/23\/10d6ce34-6595-11e2-b84d-21c7b65985ee_story.html\">found<\/a> the decision absurd:<\/p>\n<blockquote><p>Banning him from the District because he\u2019s sitting in a tree or speaking out, I think is absurd. &#8230; He\u2019s strange, but do you know how many strange people enter D.C. every day who probably shouldn\u2019t be here?<\/p><\/blockquote>\n<p>Grogan has a history of protesting, which has caused him to be arrested on multiple occasions and even landed him in jail. This is the first time, however, he has been restricted from entering a city as a result of exercising what he believes to be his First Amendment right.<\/p>\n<p>David L. Hudson, Jr., a Vanderbilt University law professor, <a href=\"http:\/\/www.washingtonpost.com\/local\/attorneys-question-order-to-ban-protester-from-district-as-too-broad\/2013\/01\/23\/10d6ce34-6595-11e2-b84d-21c7b65985ee_story.html\">finds this<\/a> to be \u201ca pristine example of an overbroad condition,\u201d saying that \u201c[t]hey need to go back and draft a more narrowly tailored restriction \u2014 meaning something that would comport with the First Amendment.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A threat to the community?<\/p>\n","protected":false},"author":200,"featured_media":26287,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"om_disable_all_campaigns":false},"categories":[8],"tags":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v20.7 -
