{"id":262746,"date":"2022-02-18T06:39:41","date_gmt":"2022-02-18T12:39:41","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=262746"},"modified":"2022-02-17T00:45:46","modified_gmt":"2022-02-17T06:45:46","slug":"india-ending-commercial-surrogacy","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/india-ending-commercial-surrogacy\/","title":{"rendered":"India attempts to curb exploitation of women by ending commercial surrogacy"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><span style=\"font-weight: 400;\">India is making efforts to end surrogacy for pay \u2014\u00a0something that activists have hailed as a step in the right direction.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In December of 2021, the <\/span><a href=\"https:\/\/egazette.nic.in\/WriteReadData\/2021\/232118.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Surrogacy (Regulation) Act 2021<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/egazette.nic.in\/WriteReadData\/2021\/232025.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Assisted Reproductive Technology (Regulation) Act 2021<\/span><\/a><span style=\"font-weight: 400;\"> passed the legislature and received the Indian President\u2019s assent, after several bills in previous years failed to make it through. The bills prohibit commercial surrogacy, and Health Minister Mansukh Mandaviya said he hoped the new laws would stop one avenue of sex-selective abortion, regulate Assisted Reproduction Technology (ART) clinics, and curb the exploitation of poor Indian women, according to <\/span><a href=\"https:\/\/thediplomat.com\/2022\/01\/indias-new-reproductive-laws-trigger-debate\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">The Diplomat<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to the new laws, surrogates would only be permitted to be \u201caltruistic\u201d \u2014 that is, \u201cno charges, expenses, fees, remuneration or monetary incentive of whatever nature, except the medical expenses,\u201d could be charged. Additionally, the only type of woman who could be a surrogate must be one who is married, between the ages of 25 and 35, and have one child of her own. The surrogate must not use her own gamete and may not be a surrogate more than once in her life. Intended adoptive parents must have no children of their own. The law also penalizes anyone attempting to solicit or source a woman to be a surrogate with up to 10 years in prison or roughly $13,000.\u00a0<\/span><\/p>\n<p><strong>READ:<\/strong>\u00a0<strong><a href=\"https:\/\/archive.liveaction.org\/news\/sex-selective-abortion-india-wounding-skewing-ratios\/\" target=\"_blank\" rel=\"noopener\"><em>Sex-selective abortion in India is still wounding women and skewing sex ratios<\/em><\/a><\/strong><\/p>\n<p><span style=\"font-weight: 400;\">Indian surrogacy has gained more attention in recent days as actress <\/span><a href=\"https:\/\/people.com\/parents\/nick-jonas-priyanka-chopra-excited-parents-wanted-a-baby-for-some-time-exclusive\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Priyanka Chopra and husband Nick Jonas<\/span><\/a><span style=\"font-weight: 400;\"> announced via <\/span><a href=\"https:\/\/www.instagram.com\/p\/CZAJvizvjf4\/?utm_source=ig_embed&amp;ig_rid=50909073-fb77-4f72-acb4-6c4680d3423d\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Instagram<\/span><\/a><span style=\"font-weight: 400;\"> that their child was born to a surrogate mother. As Live Action News reported, at least one activist from within the country were <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/priyanka-chopra-nick-jonas-feminist-surrogacy\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">critical<\/span><\/a><span style=\"font-weight: 400;\"> of the celebrity couple.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Worldwide, the multi-billion dollar surrogacy industry is <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/experts-condemn-gestational-surrogacy-harmful-exploitative\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">poorly regulated<\/span><\/a><span style=\"font-weight: 400;\">, and the <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/surrogacy-dangerous-women-expert\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">dangers of surrogacy<\/span><\/a><span style=\"font-weight: 400;\"> are often not made clear to women. Contracting a woman to grow a baby (really, to become a baby\u2019s mother), give up the baby, and then discard her at the end is <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/dehumanizing-language-ivf-industry\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">dehumanizing<\/span><\/a><span style=\"font-weight: 400;\">, turning people into mere commodities to be used and traded. Experts <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/experts-condemn-gestational-surrogacy-harmful-exploitative\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">have condemned<\/span><\/a><span style=\"font-weight: 400;\"> surrogacy as exploitative.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Author and activist Talisma Nasreen rejected the idea that poor Indian women acting as surrogates could be anything other than exploited. \u201cI won\u2019t accept surrogacy until rich women become surrogate moms,\u201d she said in a January\u00a0<\/span><a href=\"https:\/\/twitter.com\/taslimanasreen\/status\/1484985274153467904?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1484985274153467904%7Ctwgr%5E%7Ctwcon%5Es1_&amp;ref_url=https%3A%2F%2Fwww.india.com%2Fviral%2Ftaslima-nasreen-surrogacy-controversy-twitter-reactiosn-priyanka-chopra-nick-jonas-5200442%2F\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">tweet<\/span><\/a><span style=\"font-weight: 400;\">. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Author and activist Pinki Verani praised the government\u2019s move in an interview with <\/span><a href=\"https:\/\/mercatornet.com\/its-time-for-the-world-health-organization-to-call-for-a-worldwide-ban-on-commercial-surrogacy\/77417\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Mercatornet<\/span><\/a><span style=\"font-weight: 400;\">. \u201cIt takes guts to course-correct, but the government of India has stood by, on this issue at least, for women and the greater good. Maybe it\u2019s time for global leaders, especially Western ones, to follow India\u2019s lead. It\u2019s definitely time for the World Health Organization to call for a worldwide ban on commercial surrogacy.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Many media sources have expressed concern that instead of preventing the exploitation of women, the law would actually somehow <\/span><a href=\"https:\/\/thewire.in\/law\/surrogacy-ban-assault\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">curtail women\u2019s rights and economic freedom<\/span><\/a><span style=\"font-weight: 400;\">. Major media sources such as the <\/span><a href=\"https:\/\/www.bbc.com\/news\/av\/world-asia-india-34876460\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">BBC<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/time.com\/6075971\/commercial-surrogacy-ban-india\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Time magazine<\/span><\/a><span style=\"font-weight: 400;\"> have expressed concern about the lack of economic \u201copportunity\u201d available to women who no longer have the option to be commercial surrogates, and how that could negatively impact their families and their villages. As seen in both BBC and Time reporting, Indian surrogates are often encouraged to go through the process to secure a better future for their children.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">But major, largely pro-surrogacy news sources turn a blind eye to the racist exploitation happening in plain sight. The mere fact that the most money these women and their towns would ever see would come from selling their bodies to rich (and frequently white) women make the issue apparent. A woman called Vasava interviewed for the story in Time described how prior to becoming a surrogate, she sometimes could not afford to eat. \u201cSometimes we slept with an empty stomach,\u201d she said. \u201cAfter the surrogacy, there is at least always something to eat.\u201d<\/span><\/p>\n<p style=\"text-align: center;\"><em><strong><a
