{"id":262653,"date":"2022-02-16T10:51:40","date_gmt":"2022-02-16T16:51:40","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=262653"},"modified":"2022-02-15T22:56:37","modified_gmt":"2022-02-16T04:56:37","slug":"professor-abortion-motherhood-slavery","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/professor-abortion-motherhood-slavery\/","title":{"rendered":"Law professor claims abortion is necessary because motherhood is slavery"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><span style=\"font-weight: 400;\">The Thirteenth Amendment to the Constitution made slavery and involuntary servitude illegal, but according to Andrew Koppelman, Professor of Law at Northwestern University,<\/span><span style=\"font-weight: 400;\">\u00a0it also rendered abortion a fundamental right. In\u00a0an op-ed in <a href=\"https:\/\/thehill.com\/opinion\/judiciary\/591973-abortion-and-the-13th-amendment\" target=\"_blank\" rel=\"noopener\">The Hill<\/a>, Koppelman argues that this is because <em>motherhood is a form of slavery<\/em>.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Koppelman describes the tragedy of chattel slavery prior to the Thirteenth Amendment and, in particular, its impact on women who were sometimes forced to procreate against their wills in order to generate revenue for the slaveowner. He describes how women\u2019s \u201clives are seized and put to the service of purposes not their own,\u201d a world in which \u201ctheir bodies are at the command of others.\u201d It is a description of a horrific condition, one that everyone can agree was rightly outlawed by the Thirteenth Amendment. Yet he then makes the illogical leap to claim that the Thirteenth Amendment, therefore, also requires that <em>abortion be legal<\/em>, lest the pregnancy of any American woman be \u201cforced.\u201d <\/span><\/p>\n<p><span style=\"font-weight: 400;\">This is a deceptive and erroneous argument that both minimizes the horrors experienced by enslaved women and denies the reality of what abortion is: the violent and inhumane killing of innocent human beings.<\/span><\/p>\n<p><b>Distorting the meaning of \u201cforced pregnancy\u201d<\/b><\/p>\n<p><span style=\"font-weight: 400;\">According to Koppelman, \u201cforced pregnancy\u2019s violation of personal liberty is obvious\u201d and is therefore outlawed by the Thirteenth Amendment. A reasonable person might think that the use of the term \u201cforced pregnancy\u201d has something to do with rape. But to Koppelman, \u201cforced pregnancy\u201d is a term for<\/span>\u00a0when a woman is pregnant in a society in which abortion is illegal.<\/p>\n<p>To Koppelman, every pregnant woman in such a society, regardless of the circumstances of the baby\u2019s conception, is therefore forced to\u00a0be pregnant. By this definition, he likens all unintended pregnancy\u00a0to life under slavery, in which women\u2019s \u201cbodily powers were seized, in the intrusive and degrading way that is unique to unwanted pregnancy, and directed to the end of producing children.\u201d<\/p>\n<p><span style=\"font-weight: 400;\">The comparison does not stand up to rational scrutiny. To imply that legal restrictions on ending the life of a preborn baby are somehow equivalent to the oppression of chattel slavery and systemic rape minimizes the horror of chattel slavery and forced sexual relations, solely for the purpose of supporting a pro-abortion ideological position.\u00a0<\/span><\/p>\n<p><b>Chauvinism laid bare<\/b><\/p>\n<p><span style=\"font-weight: 400;\">But Koppelman isn\u2019t finished. According to him, a society that outlaws abortion takes away the equality of women \u201cbecause forcing women to be mothers makes them into \u2026 a servant caste, a group that, by virtue of a status of birth, is held subject to a special duty to serve others and not themselves.\u201d He claims abortion protects women from being of &#8220;a servant caste.&#8221;<\/span><\/p>\n<p><strong>READ:\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/abortion-never-has-been-womens-equality\/\" target=\"_blank\" rel=\"noopener\"><em>Abortion is not, and never has been, about women\u2019s equality<\/em><\/a><\/strong><\/p>\n<p><span style=\"font-weight: 400;\">This is a shockingly chauvinistic view of women, motherhood, and what women\u2019s bodies are made to do. It&#8217;s part of a trend of devaluing what has traditionally been seen as &#8220;<\/span><a href=\"https:\/\/www.pbs.org\/newshour\/economy\/column-economy-undervalues-womens-work-needs-change\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">women\u2019s work<\/span><\/a><span style=\"font-weight: 400;\">&#8220;<\/span><span style=\"font-weight: 400;\"> \u2013 caregiving, teaching, nursing, elder care, domestic arts. These noble and normal acts are viewed as the work of servants and are therefore inherently inferior to the\u00a0<\/span><span style=\"font-weight: 400;\">\u201c<\/span><a href=\"https:\/\/www.stuff.co.nz\/life-style\/parenting\/family-life\/77671167\/how-kids-are-taught-to-devalue-motherhood\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">real work<\/span><\/a><span style=\"font-weight: 400;\">\u201d that is done by men<\/span><span style=\"font-weight: 400;\">\u00a0outside of the home. The fact that women\u2019s bodies don\u2019t work exactly the way men\u2019s bodies do has come to be seen as an obstacle for women to overcome. A woman&#8217;s potential for motherhood is a potential for servitude to Koppelman; therefore, when women become mothers they lose their equality with men.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This is the inherent misogyny in the phrase \u201cforced pregnancy,\u201d and one borne out of a society that refuses to support womens\u2019 reproductive potential, offering only horror stories and abortion for the woman who wants <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/pro-choice-unplanned-pregnancy-threatened-athletic\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">both<\/span><\/a><span style=\"font-weight: 400;\"> economic and personal fulfillment outside the home, alongside a fulfilling family life. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">If Koppelman were truly concerned with women&#8217;s equality, he could\u00a0<\/span><a href=\"https:\/\/archive.liveaction.org\/news\/pregnant-lawyer-forced-out-hostile-conditions\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">support working conditions<\/span><\/a><span style=\"font-weight: 400;\"> that respect motherhood<\/span><span style=\"font-weight: 400;\">, rather than likening motherhood to slavery. Although he sees the difficulty in motherhood, he fails to identify the\u00a0<\/span><a href=\"https:\/\/archive.liveaction.org\/news\/abortion-unplanned-pregnancy-south-america-societal-problems\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">lack of support<\/span><\/a><span style=\"font-weight: 400;\"> \u2013 partly due to easy, <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/corporate-misogyny-ceos-banning-abortion-bad-business\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">expected access to abortion<\/span><\/a><span style=\"font-weight: 400;\"> \u2013 as the reason for many of the struggles women face. Rather than offering support to mothers who work outside of the home, society has determined that these women should have abortions instead.<\/span><\/p>\n<p><b>An ideologically charged understanding of women\u2019s equality<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Koppelman\u2019s deficient definition of women\u2019s equality belies a radical strain of pro-abortion feminism that came about, as <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/feminism-lost-married-abortion\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">chronicled<\/span><\/a><span style=\"font-weight: 400;\"> by Sue Ellen Browder, due to the hijacking of feminism by male abortion activists. Men like Larry Lader and Bernard Nathanson, founders of what is now known as NARAL Pro-Choice America, lobbied leading feminists to make legalized abortion a precondition of women\u2019s equality, such that women could be \u201cfree\u201d from the obligation to raise children and thereby able to pursue a career. They convinced women that they were incapable of being both mothers and career women.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The plain fact is that when a baby is conceived in a woman\u2019s womb, the woman becomes a mother and the man, a father. And by the fact that she is a mother, she (and the baby&#8217;s father) have a responsibility to the child in her womb just as much as if that child were in a crib. There is no argument that can justify killing a human \u2013 even one who causes distress, inconvenience, or even trauma.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Early feminists like Susan B. Anthony and Elizabeth Cady Stanton understood this when they <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/a-look-at-the-past-present-and-future-of-pro-life-feminism\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">decried<\/span><\/a><span style=\"font-weight: 400;\"> the evils of abortion and infanticide. Likewise, a growing number of <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/feminism-pro-life-pro-women\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">prominent feminists<\/span><\/a><span style=\"font-weight: 400;\"> today have also rejected this definition of equality, and instead argue for authentic feminism that both empowers women and cherishes the lives of preborn babies. There should be no inherent conflict between a woman\u2019s career aspirations and her ability to have children. The sad fact is, as Anglican priest Tish Harrison Warren <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/roe-v-wade-incentives-abortion\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">pointed out<\/span><\/a><span style=\"font-weight: 400;\">, the legalization of abortion creates structural incentives that make it harder for women to choose life. Sadly, abortion becomes the socially acceptable answer to complex challenges when in reality it is the continuation of centuries of the devaluation of women.\u00a0<\/span><\/p>\n<p><b>Choosing an arduous good over a false emancipation<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Koppelman argues that the overturning of <em>Roe v. Wade<\/em> would roll back \u201cthat provision of the Constitution by which the United States, for the first time, became the land of the free.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Abortion is not emancipatory. Changing society to support women for who they are and what they can do, and enabling them to continue pregnancies even when they are unplanned rather than being pressured to consider ending the life of a preborn child, is the truly supportive, authentically feminist, and life-affirming option.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Of course, not all pregnancies are easy, nor is childbearing free of challenges. Yet as Warren argued in <\/span><a href=\"https:\/\/www.nytimes.com\/2022\/01\/22\/opinion\/roe-legal-abortion.html\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">The New York Times<\/span><\/a><span style=\"font-weight: 400;\">, a society free of abortion can also be clear-eyed about the challenges: \u201cCarrying a human life to term and either raising a child or placing a child with an adoptive family are, in all circumstances, arduous goods \u2014 moral, spiritual and social goods that also carry significant difficulty and risk.\u201d It is how we support women in attaining these arduous goods that is most important.<\/span><\/p>\n<p style=\"text-align: center;\"><em><strong><a href=\"https:\/\/www.facebook.com\/liveactionnewsonline\/\">\u201cLike\u201d Live Action News on Facebook<\/a>\u00a0for more pro-life news and commentary!<\/strong><\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Thirteenth Amendment to the Constitution made slavery and involuntary servitude illegal, but according to Andrew Koppelman, Professor of Law at Northwestern University,\u00a0it also rendered abortion a fundamental right.
