{"id":261540,"date":"2022-01-26T12:38:12","date_gmt":"2022-01-26T18:38:12","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=261540"},"modified":"2022-01-26T14:34:53","modified_gmt":"2022-01-26T20:34:53","slug":"virginia-texas-supreme-court","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/virginia-texas-supreme-court\/","title":{"rendered":"Virginia will no longer oppose Mississippi&#8217;s 15-week abortion limit in Supreme Court case"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>Virginia&#8217;s new attorney general, Jason Miyares, has filed a <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/19\/19-1392\/211089\/20220121173420402_Letter%20to%20the%20Court_19-1392.pdf\" target=\"_blank\" rel=\"noopener\">legal motion<\/a> asking the Supreme Court to remove the state&#8217;s name from an amicus brief previously filed in favor of abortion in the <em>Dobbs v. Jackson Women&#8217;s Health Organization<\/em> case.<\/p>\n<p>In September 2021, former Attorney General Mark Herring <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/19\/19-1392\/192963\/20210920135240540_19-1392%20Amicus%20Brief.pdf\" target=\"_blank\" rel=\"noopener\">signed onto a brief<\/a> with 22 other states, the District of Columbia, and the North Carolina Attorney General arguing that Mississippi&#8217;s law banning abortions after 15 weeks (the Mississippi Gestational Age Act) was unconstitutional. That brief also urged the Supreme Court not to overturn <em>Roe v. Wade<\/em> and <em>Planned Parenthood v. Casey<\/em>, two previous cases that reinforcing abortion as a constitutional right. Should the Court rule in favor of Mississippi, these court cases could be reversed.<\/p>\n<p><strong>READ: <em><a href=\"https:\/\/archive.liveaction.org\/news\/exit-polls-pro-life-helped-youngkin-virginia\/\" target=\"_blank\" rel=\"noopener\">Exit polls show pro-life stance helped Glenn Youngkin win Virginia governor\u2019s race<\/a><\/em><\/strong><\/p>\n<p>Miyares defeated Herring in the November elections. He was sworn into office on January 15.<\/p>\n<p>In a letter from Andrew Ferguson, Solicitor General of Virginia, Miyares says that due to a change in administration, &#8220;Virginia no longer adheres to the arguments contained in its previously filed brief. Virginia is now of the view that the Constitution is silent on the question of abortion, and that it is therefore up to the people in the several States to determine the legal status and regulatory treatment of abortion.&#8221;<\/p>\n<p>The letter goes on further to ask the courts to reverse both <em>Roe v. Wade<\/em> and <em>Planned Parenthood v. Casey<\/em>, saying:<\/p>\n<p style=\"padding-left: 30px;\"><em>It is Virginia&#8217;s position that the Court&#8217;s decision in Roe and Casey were wrongly decided. Unmoored from the Constitution&#8217;s text, the Court&#8217;s abortion jurisprudence has proven unworkable, and the Court&#8217;s effort to save it has distorted other areas of the law. This Court should restore judicial neutrality to the abortion debate by permitting the people of the several States to resolve these questions for themselves.\u00a0<\/em><\/p>\n<p>With the legal motion,\u00a0Miyares joins recently-elected Governor\u00a0Glenn Youngkin in implementing some pro-life initiatives in the state. Youngkin <a href=\"https:\/\/archive.liveaction.org\/news\/virginia-gov-glenn-youngkin-ambassador-unborn\/\" target=\"_blank\" rel=\"noopener\">recently named<\/a> Angela Sailor the state&#8217;s chief diversity officer, indicating that he wanted her to become an &#8220;ambassador for unborn children.&#8221;<\/p>\n<p>The Supreme Court heard <a href=\"https:\/\/archive.liveaction.org\/news\/supreme-court-pro-life-rally-oral-arguments\/\" target=\"_blank\" rel=\"noopener\">oral arguments<\/a> on the <em>Dobbs<\/em> case on December 1, and a ruling is expected later this spring.<\/p>\n<p style=\"text-align: center;\"><em><strong><a href=\"https:\/\/www.facebook.com\/liveactionnewsonline\/\" target=\"_blank\" rel=\"noopener\">\u201cLike\u201d Live Action News on Facebook<\/a>\u00a0for more pro-life news and commentary!<\/strong><\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Virginia&#8217;s new attorney general, Jason Miyares, has filed a legal motion asking the Supreme Court to remove the state&#8217;s name from an amicus brief previously filed in favor of abortion in the Dobbs v.
