The suit seeks the recovery of $10 million in payments made by the Texas Medicaid program. The <\/span><a href=\"https:\/\/www.texastribune.org\/2022\/01\/13\/texas-medicaid-planned-parenthood-lawsuit\/\"><span style=\"font-weight: 400;\">Texas Tribune reports<\/span><\/a><span style=\"font-weight: 400;\">:<\/span><\/p>\n<p style=\"padding-left: 30px;\"><em><a href=\"https:\/\/www.texastribune.org\/2016\/12\/20\/texas-kicks-planned-parenthood-out-medicaid\/\"><span style=\"font-weight: 400;\">In 2016, Texas officially filed<\/span><\/a><span style=\"font-weight: 400;\"> to remove Planned Parenthood as a Medicaid provider, setting off a lengthy legal battle. Planned Parenthood immediately asked the courts to intervene, and <\/span><a href=\"https:\/\/www.texastribune.org\/2017\/02\/21\/planned-parenthood-medicaid-court\/\"><span style=\"font-weight: 400;\">a federal district court blocked the state\u2019s notice of termination in 2017<\/span><\/a><span style=\"font-weight: 400;\">, allowing Planned Parenthood to continue to seek reimbursement through Medicaid.<\/span><\/em><\/p>\n<p style=\"padding-left: 30px;\"><em><span style=\"font-weight: 400;\">But in November 2020, <\/span><a href=\"https:\/\/www.texastribune.org\/2020\/11\/23\/texas-planned-parenthood-medicaid-abortion\/\"><span style=\"font-weight: 400;\">the 5th U.S. Circuit Court of Appeals reversed that decision<\/span><\/a><span style=\"font-weight: 400;\">, allowing Texas to proceed with removing Planned Parenthood as a provider. Planned Parenthood then filed an emergency lawsuit saying the state had not followed proper procedures, and <\/span><a href=\"https:\/\/www.texastribune.org\/2021\/02\/03\/planned-parenthood-texas-medicaid\/\"><span style=\"font-weight: 400;\">a state judge issued a temporary restraining order<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/em><\/p>\n<p style=\"padding-left: 30px;\"><em><span style=\"font-weight: 400;\">Ultimately, in February 2021, the state prevailed, bringing to an end Planned Parenthood\u2019s attempts to remain on the Medicaid rolls. <\/span><\/em><\/p>\n<p>However, Medicaid payments to Planned\u00a0Parenthood were still made during the three years of &#8220;legal and administrative proceedings.&#8221; It is these\u00a0payments that the AG is seeking to recover.<\/p>\n<p><span style=\"font-weight: 400;\">The lawsuit bases its allegations on the Medicaid Fraud Prevention Act (TMFPA), saying Planned Parenthood knew it was not eligible to recover the reimbursements, and \u201cPlanned Parenthood knowingly and improperly avoided its obligation to repay money owed to the Texas Medicaid program.\u201d<\/span><\/p>\n<p><strong>READ:\u00a0<em><a href=\"https:\/\/archive.liveaction.org\/news\/planned-parenthood-gives-lawsuit-texas-funding\/\">Planned Parenthood gives up lawsuit against Texas for Medicaid funding<\/a><\/em><\/strong><\/p>\n<p><span style=\"font-weight: 400;\">The suit cites TMFPA in Section 35, saying that if someone &#8220;k<\/span><span style=\"font-weight: 400;\">nowingly makes, uses, or causes the making or use of a false record or statement material to an obligation to pay or transmit money or property to this state under the Medicaid program, or knowingly conceals <\/span><b>or knowingly and improperly avoids<\/b><span style=\"font-weight: 400;\"> or decreases <\/span><b>an obligation to pay or transmit money<\/b><span style=\"font-weight: 400;\"> or property <\/span><b>to this state under the Medicaid program<\/b>,\u201d then it is considered fraud.<\/p>\n<p><span style=\"font-weight: 400;\">Because Planned Parenthood did not appeal the last decision in district court, the suit alleges that the organization was no longer entitled to any reimbursements on or after February 1, 2017.<\/span><\/p>\n<p>According to <a href=\"https:\/\/www.kristv.com\/news\/texas-news\/paxton-sues-planned-parenthood\"><span style=\"font-weight: 400;\">KRIS-TV in Corpus Christi,<\/span><\/a><span style=\"font-weight: 400;\"> Paxton said, &#8220;<\/span><span style=\"font-weight: 400;\">It is unthinkable that Planned Parenthood would continue to take advantage of funding knowing they were not entitled to keep it. I will not allow them to benefit from this abhorrent conduct after they were caught violating medical standards and lying to law enforcement.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">While technically federal monies cannot be used for abortion, as <\/span><a href=\"https:\/\/rtl.org\/legislation\/tax-dollars-paying-for-abortion\/\"><span style=\"font-weight: 400;\">Right to Life notes<\/span><\/a><span style=\"font-weight: 400;\">, abortion providers dance a fine line combining state and federal money, reminding us that money is fungible:\u00a0<\/span><\/p>\n<p style=\"padding-left: 30px;\"><em><span style=\"font-weight: 400;\">There is zero meaningful separation of staff, facilities, and operational costs at Planned Parenthood clinics between government-funded services and abortions. Federal contract rules allow taxpayer funds to pay staff salaries, supplies, and facility costs on a \u2018pro-rated\u2019 basis. It is merely an accounting gimmick; tax dollars literally pay the rent and energy costs to keep abortion clinics running and funds staff that help perform abortions. <\/span><\/em><\/p>\n<p><span style=\"font-weight: 400;\">But the Texas Tribune disputes this, claiming that the \u201c$3.1 million from Medicaid to provide family planning and women\u2019s health services to low-income Texans&#8230; were separate from the group\u2019s abortion services, which receive no public funding.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Planned Parenthood Federation of America general counsel Kumiki Gibson called the suit a \u201cmeritless\u201d political attack by anti-abortion politicians. \u201cPlanned Parenthood will continue to fight back against all of these false accusations and political attacks and will continue serving patients in Texas \u2013 no matter what,\u201d Gibson said.<\/span><\/p>\n<p style=\"text-align: center;\"><em><strong><a href=\"https:\/\/www.facebook.com\/liveactionnewsonline\/\" target=\"_blank\" rel=\"noopener\">\u201cLike\u201d Live Action News on Facebook<\/a>\u00a0for more pro-life news and commentary!<\/strong><\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Texas Attorney General Ken Paxton wants to recoup $10 million from abortion giant Planned Parenthood, and has filed a lawsuit against Planned Parenthood Federation of America along with a number of Planned Parenthood affiliates in Texas, spanning most of the state\u2019s Planned Parenthood providers.
