{"id":256611,"date":"2021-11-03T16:52:17","date_gmt":"2021-11-03T21:52:17","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=256611"},"modified":"2021-11-02T17:13:44","modified_gmt":"2021-11-02T22:13:44","slug":"indiana-abortion-complications-reporting-law-effect","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/indiana-abortion-complications-reporting-law-effect\/","title":{"rendered":"Indiana abortion complications reporting law finally goes into effect after 3-year fight"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><span style=\"font-weight: 400;\">An Indiana abortion complications reporting law that was blocked by a federal judge in 2018 has finally taken effect after three years, marking a major pro-life victory in the state.<\/span><\/p>\n<p><a href=\"http:\/\/iga.in.gov\/legislative\/2018\/bills\/senate\/340#document-0b0b1a82\"><span style=\"font-weight: 400;\">Senate Enrolled Act No. 340<\/span><\/a><span style=\"font-weight: 400;\"> was signed into law in 2018 and requires doctors to report complications arising from abortions. Conditions that could trigger the reporting requirements include infections, uterine perforations, depression and anxiety, failed abortion, and preterm labor, among others. Failure to report these complications could result in a misdemeanor, 180 days in jail, and a $1,000 fine.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The U.S. Court of Appeals for the Seventh Circuit <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/appeals-court-allows-indiana-abortion-restrictions\/\"><span style=\"font-weight: 400;\">voted<\/span><\/a><span style=\"font-weight: 400;\"> 2-1 in September to uphold the law on the heels of being <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/judge-strikes-indiana-abortion-laws-claims\/\"><span style=\"font-weight: 400;\">struck down<\/span><\/a><span style=\"font-weight: 400;\"> by a U.S. District Court Judge. The law was first challenged and subsequently blocked by a federal judge in 2018 following a lawsuit brought by Planned Parenthood arguing that the list of complications was \u201cunconstitutionally vague.\u201d After several challenges, the court has now cleared Indiana officials to begin enforcing the law.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Indiana Right to Life President and CEO Mike Fichter applauded the court\u2019s decision, noting that it was &#8220;long overdue&#8221; and that the organization would work to ensure that every abortion facility in the state complies with the law.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cIt is extremely telling that abortion businesses fought to shield these complications from being reported,&#8221; he <a href=\"https:\/\/irtl.org\/abortion-complications-reporting-law-goes-into-effect-today-in-indiana\/\">stated<\/a>.\u00a0Now that these reporting requirements go into effect, any abortion business refusing to comply must be denied a license renewal according to the new licensing law passed in the 2021 Indiana legislature.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">He continued, \u201cFull compliance with the complications reporting law must be one of the many areas subject to thorough state inspections of every licensed abortion business. Complications reporting is the law, not a suggestion.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Abortion advocates often tout abortion as a \u201csafe\u201d procedure. But, as <\/span><span style=\"font-weight: 400;\">Live Action News<\/span><span style=\"font-weight: 400;\"> has repeatedly <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/abortion-safe-read-fine-print\/\"><span style=\"font-weight: 400;\">reported<\/span><\/a><span style=\"font-weight: 400;\">, making abortion legal hasn\u2019t made it safe, and medical misconduct is widespread. In one example, Indiana abortionist Ulrich Klopfer <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/indiana-abortion-clinic-closes-prior-impending-judgment-repeat-health-violations\/\"><span style=\"font-weight: 400;\">came under fire<\/span><\/a><span style=\"font-weight: 400;\"> for habitually submitting abortion reports late and with false or missing information, showing complete disregard for women\u2019s health. He also failed to report cases of rape and abuse. Later, in 2019, Klopfer <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/police-photos-abortionist-klopfer-hoarded-aborted-bodies\/\"><span style=\"font-weight: 400;\">shocked the nation<\/span><\/a><span style=\"font-weight: 400;\"> when the bodies of over 2,000 babies were found in his home, causing great distress to the women who obtained abortions from Klopfer.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Abortion complications reporting is <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/report-abortion-industry-medically-unaccountable-wild-west\/\"><span style=\"font-weight: 400;\">seriously lacking<\/span><\/a><span style=\"font-weight: 400;\"> in the United States. According to the pro-abortion Guttmacher Institute, only about half of all states (28) currently require abortion providers to <a href=\"https:\/\/archive.liveaction.org\/news\/not-all-states-abortion-complications-reported\/\">report complications<\/a> from abortions.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">While the new law taking effect marks a major step forward in protecting mothers and their unborn children, as well as holding abortionists accountable, the abortion battle is far from over in Indiana. A recent <\/span><a href=\"https:\/\/www.in.gov\/health\/vital-records\/files\/ANNUAL-TPR-CY2020.pdf\"><span style=\"font-weight: 400;\">report<\/span><\/a><span style=\"font-weight: 400;\"> from the Indiana Department of Health <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/indiana-abortions-increased-2020-most-abortion-pill\/\"><span style=\"font-weight: 400;\">showed<\/span><\/a><span style=\"font-weight: 400;\"> an increase in the number of abortions performed in the state, with 119 more children killed by abortion in 2020 than in 2019.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, Indiana officials are continuing the fight for the life \u2014 both in the state and across the country. Attorney General Todd Rokita, who defended the abortion complications reporting requirement, is <\/span><a href=\"https:\/\/events.in.gov\/event\/attorney_general_todd_rokita_leads_20_states_asking_us_supreme_court_to_reject_challenge_to_pro-life_law\"><span style=\"font-weight: 400;\">leading<\/span><\/a><span style=\"font-weight: 400;\"> a 20-state coalition asking the U.S. Supreme Court to reject a lawsuit challenging the Texas law that prohibits abortion when doctors can detect a fetal heartbeat.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cWe will stay relentless in demanding that President Biden and Attorney General Garland respect states\u2019 authority to pass our own laws without being dragged improperly into federal court,\u201d Attorney General Rokita said. \u201cAnd in Indiana, we will continue striving to protect the lives of the unborn and the health of women.\u201d<\/span><\/p>\n<p style=\"text-align: center;\"><em><strong><a href=\"https:\/\/www.facebook.com\/liveactionnewsonline\/\" target=\"_blank\" rel=\"noopener\">\u201cLike\u201d Live Action News on Facebook<\/a>\u00a0for more pro-life news and commentary!<\/strong><\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>An Indiana abortion complications reporting law that was blocked by a federal judge in 2018 has finally taken effect after three years, marking a major pro-life victory in the state.
