Among the behaviors it seeks to criminalize is \u201cthe denial of safe and legal abortion care.\u201d<\/p>\n<p>The document condemns violence against women and girls \u201cin all their diversity\u201d as well as \u201cviolence against LGBTIQ+ persons on the grounds of gender, gender identity, gender expression or sex characteristics,\u201d and specifies that it refers to \u201cacts of online and offline violence.\u201d<\/p>\n<p>The report calls for the creation of uniform standards and minimum criminal penalties across the European Union by amending the Treaty on the Functioning of the European Union. It was <a href=\"https:\/\/www.europarl.europa.eu\/news\/en\/press-room\/20210910IPR11927\/make-gender-based-violence-a-crime-under-eu-law-meps-say\" target=\"_blank\" rel=\"noopener\">adopted<\/a> by a vote of 427-119, with 140 abstentions.<\/p>\n<p>Several members of the parliament referred to the high rates of physical and sexual violence perpetrated against European women and girls, arguing that to oppose this report would be to ignore their plight.<\/p>\n<p>\u201cIn our report, we state that in order to combat gender-based violence, we must have the right to decide over our bodies and our sexuality. We must have access to free abortion and contraception,\u201d said Malin Bj\u00f6rk of Sweden, one of the parliamentarians presenting the report.<\/p>\n<p>Others took a different view. \u201cThe fight against violence against women cannot become a tool of ideological struggle, and this is, unfortunately, an ideological project,\u201d said Polish member Jadwiga Wi\u015bniewska. \u201cPlease note that the concept of gender is not a treaty concept, nor are terms such as patriarchy or LGBT.\u201d<\/p>\n<p>Poland\u2019s abortion restrictions were specifically denounced in the report.<\/p>\n<p>Cindy Franssen of Belgium warned that the report \u201cgoes beyond national competences\u201d and noted that adding \u201cgender-based violence\u201d to the treaty would require unanimity in the Council of the European Union. \u201cThat will not come if we simultaneously demand that refusing an abortion be labeled as gender-based violence.\u201d<\/p>\n<p><strong>READ: <em><a href=\"https:\/\/archive.liveaction.org\/news\/european-parliament-to-decide-tuesday-if-abortion-is-a-human-right\/\" target=\"_blank\" rel=\"noopener\">European Parliament to decide Tuesday if abortion is a human right<\/a><\/em><\/strong><\/p>\n<p>Helena Dalli, the current European Commissioner for Equality, described the report as an attempt to achieve the goals of the Istanbul Convention, the Council of Europe treaty on preventing and combating violence against women and domestic violence. The convention came into force in 2014, but earlier this year, Turkey withdrew from it, <a href=\"https:\/\/www.iletisim.gov.tr\/english\/haberler\/detay\/statement-regarding-turkeys-withdrawal-from-the-istanbul-convention\" target=\"_blank\" rel=\"noopener\">declaring<\/a> that what was \u201coriginally intended to promote women\u2019s rights was hijacked by a group of people attempting to normalize homosexuality.\u201d<\/p>\n<p>The recently-adopted report makes explicit what was implicit in the Istanbul Convention by expressly including \u201cLGBTIQ+\u201d-identified persons as \u201calso victims of gender-based violence because of their gender, gender identity, gender expression and sex characteristics.\u201d<\/p>\n<p>Dalli said that her goal was to expand the definition of \u201cEuro-crimes\u201d to include both gender-based violence and hate crimes and hate speech, \u201con grounds of sexual orientation, amongst other grounds.\u201d<\/p>\n<p>As a Maltese politician as well as in her work at the EU, Dalli has been a champion for pro-LGBT laws and policies.
