Wade<\/em>, which made abortion a Constitutional right. It is thought this is the first such formal intrusion into a Supreme Court decision by UN actors.<\/p>\n<p>\u201cThe United States would contradict international human rights law by overturning its established constitutional protections for abortion access,\u201d the experts conclude in <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/19\/19-1392\/193045\/20210920163400578_19-1392%20bsac%20United%20Nations%20Mandate%20Holders.pdf\" target=\"_blank\" rel=\"noopener\">the brief<\/a>. Abortion is \u201cnecessary for women\u2019s autonomy, equality and non-discrimination,\u201d they argue.<\/p>\n<p><strong>READ: <em><a href=\"https:\/\/archive.liveaction.org\/news\/united-nations-promoting-human-right-abortion\/\" target=\"_blank\" rel=\"noopener\">The United Nations is heavily promoting the idea of a \u2018human right to abortion\u2019<\/a><\/em><\/strong><\/p>\n<p>The UN experts claim to want to \u201cset the record straight and explain how international human rights law protects abortion access\u201d in a legal brief submitted to the court last week in <em>Dobbs v. Jackson Women\u2019s Health<\/em>.<\/p>\n<p>The experts directly rebut the claims that children in the womb were never excluded from the right to life in international human rights law, in other briefs received by the Supreme Court in the same case, including a <a href=\"https:\/\/c-fam.org\/un_statement\/brief-of-amicus-curiae-center-for-family-and-human-rights-in-dobbs-v-jackson-womens-health-organization\/\" target=\"_blank\" rel=\"noopener\">brief submitted by C-Fam<\/a>, publisher of the Friday Fax.<\/p>\n<p>\u201cThe right to life emanating from human rights treaties does not apply prenatally,\u201d they claim.<\/p>\n<p>The UN experts do not cite U.S. Supreme Court precedent, the U.S. Constitution, or the provisions of any UN human rights treaty ratified by the U.S. government to support their claim that abortion is an international right. Instead, they cite the non-binding opinions of UN experts.<\/p>\n<p>\u201cOver time, States and human rights bodies clarified that human rights treaty obligations encompass the reproductive rights of women and girls, including safe and legal abortion access,\u201d they explain.<\/p>\n<p>The brief argues that \u201cprotections for abortion access are necessary to fulfill the rights to equality and non-discrimination, life, privacy, health, and freedom from torture, cruel, inhuman and degrading treatment, as well as freedom from gender-based violence, among other rights.\u201d Any prohibition on abortion access would result in a violation of these rights, according to the UN experts.<\/p>\n<p>The experts also speculate that following a reversal of <em>Roe v. Wade<\/em> \u201cmany U.S. states will implement bans or near-bans on abortion access that will make individual state laws irreconcilable with international human rights law.\u201d<\/p>\n<p>The lead author of the brief is <a href=\"https:\/\/c-fam.org\/friday_fax\/human-rights-council-approves-abortionist-as-special-expert-on-right-to-health\/\" target=\"_blank\" rel=\"noopener\">South African abortionist Tlaleng Mofokeng<\/a>, who was appointed by the UN Human Rights Council as UN Special Rapporteur on the right of everyone to the enjoyment of the highest attainable standard of physical and mental health in 2019. Following her UN appointment she came under scrutiny by anti-trafficking and child protection organizations for her promotion of <a href=\"https:\/\/c-fam.org\/friday_fax\/advocate-for-teen-prostitution-takes-top-un-post\/\" target=\"_blank\" rel=\"noopener\">legal prostitution as \u201csex work\u201d for teen girls<\/a>.
