{"id":253868,"date":"2021-09-24T10:39:17","date_gmt":"2021-09-24T15:39:17","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=253868"},"modified":"2021-09-23T23:36:24","modified_gmt":"2021-09-24T04:36:24","slug":"five-benefits-texas-heartbeat-act","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/five-benefits-texas-heartbeat-act\/","title":{"rendered":"Five benefits of the controversial Texas Heartbeat Act"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>(<a href=\"https:\/\/blog.secularprolife.org\/2021\/09\/5-benefits-of-texas-heartbeat-bill.html?fbclid=IwAR0tGnimllNxm9173F694iWou3HW3GMw3fEEarQAPOmEgXaJuk-Mo1WrE_E&amp;m=1\">Secular Pro-Life<\/a>)\u00a0There has been no shortage of pushback to <a href=\"https:\/\/legiscan.com\/TX\/text\/SB8\/id\/2395961\" target=\"_blank\" rel=\"noopener\">SB 8<\/a>, the Texas bill that bans almost all abortions after an embryonic heartbeat can be detected (about 4 weeks after fertilization, so 6 weeks gestation\/LMP). Even many pro-lifers have expressed skepticism as to whether this bill is a good idea, often focused on concerns about the private citizen enforcement mechanism. As far as I can tell, here are the options:<\/p>\n<ol>\n<li>Early abortion is restricted as a criminal matter with government enforcement.<\/li>\n<li>Early abortion is restricted as a civil matter with private citizen enforcement.<\/li>\n<li>Early abortion isn\u2019t restricted.<\/li>\n<\/ol>\n<p>In the last few years alone, <a href=\"https:\/\/en.wikipedia.org\/wiki\/Heartbeat_bill#Summary_table\" target=\"_blank\" rel=\"noopener\">multiple states have attempted<\/a> heartbeat bills with government enforcement to no avail; many bills are blocked by courts before they can go into effect. The Texas bill went into effect specifically because it replaced government enforcement with private citizen enforcement. So while I agree #1 is preferable to #2, I also recognize that, at least for now, government enforcement isn\u2019t actually an option. In that case, which of the remaining options would you prefer: private citizen enforcement, or no restriction?<\/p>\n<p>I leave that to readers to debate. Meanwhile I want to highlight some of the bill\u2019s benefits.<\/p>\n<p><b>1. The heartbeat law is dramatically reducing abortion in Texas.\u00a0<\/b>Yes, some women will leave the state to get abortions. Some will recognize pregnancy in time to get abortions before fetal heartbeat. Some will order medication abortion pills to induce an abortion illegally. The law will not eliminate abortion in Texas.<\/p>\n<p>But the law will dramatically reduce abortion in Texas and no doubt already has. More minor restrictions (<a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=3029823\" target=\"_blank\" rel=\"noopener\">parental notification<\/a>, <a href=\"https:\/\/bmcwomenshealth.biomedcentral.com\/articles\/10.1186\/s12905-019-0775-5\" target=\"_blank\" rel=\"noopener\">limits on taxpayer funding<\/a>) have significantly reduced abortions. An early gestational limit like this one will have a much broader impact. Even lower estimates suggest <a href=\"https:\/\/news.bloomberglaw.com\/us-law-week\/abortion-access-in-texas-is-annihilated-and-its-just-the-beginning\" target=\"_blank\" rel=\"noopener\">46% of Texas women<\/a> seeking abortion will carry pregnancies to term. If, like us, you view abortion as killing morally valuable humans, this result is a major step forward in protecting prenatal children.<\/p>\n<p><b>2. The heartbeat law is likely to reduce unintended pregnancy in Texas.\u00a0<\/b>Shortly after SB 8 went into effect, we saw tweets like this one in which medical professionals encourage people to hurry and start using birth control.<\/p>\n<table class=\"tr-caption-container\" cellspacing=\"0\" cellpadding=\"0\" align=\"center\">\n<tbody>\n<tr>\n<td><a href=\"https:\/\/1.bp.blogspot.com\/-tnUvYu4-CFA\/YUOoG_476vI\/AAAAAAABJhs\/NNlwQoHgoIM8vmlhjfFhzSAHxhu6CRQKgCLcBGAsYHQ\/s635\/2021.09.01%2BDaraKass%2Bbc%2B1.JPG\"><img decoding=\"async\" loading=\"lazy\" class=\"\" src=\"https:\/\/1.bp.blogspot.com\/-tnUvYu4-CFA\/YUOoG_476vI\/AAAAAAABJhs\/NNlwQoHgoIM8vmlhjfFhzSAHxhu6CRQKgCLcBGAsYHQ\/s280\/2021.09.01%2BDaraKass%2Bbc%2B1.JPG\" width=\"350\" height=\"346\" border=\"0\" data-original-height=\"628\" data-original-width=\"635\" \/><\/a><\/td>\n<\/tr>\n<tr>\n<td class=\"tr-caption\">Original tweet <a href=\"https:\/\/twitter.com\/darakass\/status\/1433051908554514438\" target=\"_blank\" rel=\"noopener\">here<\/a><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>This response is not surprising. When elective abortion isn\u2019t available as a back up option, people take more precautions to avoid pregnancy, which explains why abortion restrictions are associated with <a href=\"https:\/\/www.guttmacher.org\/journals\/psrh\/2015\/05\/state-abortion-context-and-us-womens-contraceptive-choices-1995-2010\" target=\"_blank\" rel=\"noopener\">increased contraceptive use<\/a>.<\/p>\n<p><b>3. The heartbeat law is compelling abortion activists to acknowledge embryos and fetuses killed in abortion.\u00a0<\/b>Granted, to whatever extent possible, activists are misleading the public about embryonic heart development.\u00a0But they\u2019re still being forced to <i>acknowledge <\/i>embryonic heart development \u2014 and embryos at all. More typically, activists avoid any mention of anyone involved in abortion other than the woman obtaining one. If they have to, they make vague allusions to \u201cclumps of cells,\u201d not embryos, and certainly not specific developmental milestones.<\/p>\n<p><i>[Read more &#8211;\u00a0<a href=\"https:\/\/blog.secularprolife.org\/2021\/09\/npr-interviews-abortion-rights.html\" target=\"_blank\" rel=\"noopener\">NPR interviews abortion rights activists to determine if embryos have hearts<\/a>]\u00a0<\/i><\/p>\n<p>Heartbeat laws inevitably bring prenatal children into the conversation, and that\u2019s important because&#8230;<\/p>\n<p><b>4. The heartbeat law is underscoring how much the general public doesn\u2019t know but does care about embryonic development.\u00a0<\/b>The pro-choice talking points that there is no embryonic heart or heartbeat at 6 weeks LMP\u00a0<a href=\"https:\/\/openstax.org\/books\/anatomy-and-physiology\/pages\/19-5-development-of-the-heart\" target=\"_blank\" rel=\"noopener\">are lies<\/a>. There would be no need for the pro-choice side to lie if no one cared about embryonic hearts and heartbeats. But people do. The general public has believed that very early abortion removes a literal sphere of amorphous cells, not an embryo with a functioning cardiovascular system (and arm and leg buds, the beginnings of facial features, etc). That level of development gives people pause, which may be why polls both <a href=\"https:\/\/www.rasmussenreports.com\/public_content\/politics\/current_events\/abortion\/fight_over_texas_abortion_law_divides_voters\" target=\"_blank\" rel=\"noopener\">nationally<\/a> and <a href=\"https:\/\/static.texastribune.org\/media\/files\/1e784fa492481ff750962a19196a9798\/ut-tt-2021-04-summary-day2.pdf?ipid=related-recirc\" target=\"_blank\" rel=\"noopener\">specific to Texas<\/a> have found more support than opposition for banning abortion after 6 weeks gestation.<\/p>\n<div id=\"attachment_169253\" style=\"width: 401px\" class=\"wp-caption aligncenter\"><img aria-describedby=\"caption-attachment-169253\" decoding=\"async\" loading=\"lazy\" class=\" wp-image-169253\" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2017\/07\/6-7-week-conception-8-9-weeks-LMP-.png\" alt=\"\" width=\"391\" height=\"486\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2017\/07\/6-7-week-conception-8-9-weeks-LMP-.png 537w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2017\/07\/6-7-week-conception-8-9-weeks-LMP--241x300.png 241w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2017\/07\/6-7-week-conception-8-9-weeks-LMP--500x622.png 500w\" sizes=\"(max-width: 391px) 100vw, 391px\" \/><p id=\"caption-attachment-169253\" class=\"wp-caption-text\">6-7 weeks<\/p><\/div>\n<p><b>5.
