{"id":252950,"date":"2021-09-11T09:23:38","date_gmt":"2021-09-11T14:23:38","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=252950"},"modified":"2021-09-09T23:19:17","modified_gmt":"2021-09-10T04:19:17","slug":"appeals-court-allows-indiana-abortion-restrictions","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/appeals-court-allows-indiana-abortion-restrictions\/","title":{"rendered":"Federal appeals court allows Indiana to enforce abortion restrictions"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>On Wednesday, a U.S. Court of Appeals for the Seventh Circuit <a href=\"https:\/\/news.bloomberglaw.com\/us-law-week\/indiana-can-enforce-abortion-law-after-court-lifts-injunction\" target=\"_blank\" rel=\"noopener\">lifted<\/a> the injunction that was placed on several of Indiana&#8217;s abortion laws last month. The ruling means that the state can temporarily continue to enforce five abortion laws that were struck down by a U.S. District Judge while the state appeals the lower court&#8217;s ruling.<\/p>\n<p>Thanks to the ruling this week, the state can continue to uphold the following abortion restrictions:<\/p>\n<ul>\n<li>A requirement that all second-trimester surgical abortions occur in surgical centers or hospitals<\/li>\n<li>A requirement that women must receive the abortion pill during an <em>in-person<\/em> visit with a physician<\/li>\n<li>A requirement that patients must receive <em>in-person<\/em> counseling prior to an abortion<\/li>\n<li>A requirement that women receive an in-person physical examination prior to abortion<\/li>\n<li>A restriction that prevents women from using telemedicine to access the abortion pill<\/li>\n<\/ul>\n<p>Those abortion laws were most recently <a href=\"https:\/\/archive.liveaction.org\/news\/judge-strikes-indiana-abortion-laws-claims\/\" target=\"_blank\" rel=\"noopener\">struck down in August<\/a> by Federal Judge\u00a0Sarah Evans Barker, who found them unconstitutional. Indiana Attorney General Todd Rokita appealed that ruling, leading to the decision of the appeals court to lift Barker&#8217;s injunction.\u00a0According to <a href=\"https:\/\/abcnews.go.com\/Health\/wireStory\/appeals-court-restores-indiana-abortion-restrictions-79917975\" target=\"_blank\" rel=\"noopener\">ABC News<\/a>,\u00a0Rokita praised the latest ruling. \u201cWe would expect our commonsense laws to be upheld as the appeal continues,\u201d he said in a statement. \u201cProtecting the culture of life is the top priority of my office, and we will continue fighting for every life alongside our legislative partners.\u201d<\/p>\n<p><strong>READ:\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/rasmussen-poll-americans-support-texas-heartbeat\/\" target=\"_blank\" rel=\"noopener\"><em>Rasmussen poll: More Americans support Texas Heartbeat Act than oppose it<\/em><\/a><\/strong><\/p>\n<p>In its 2-1 ruling, the court found that because the\u00a0contested provisions had been in force for years, precedent indicates that the state has a good chance of winning its legal battle.\u00a0&#8220;All we hold today is that existing precedents provide strong grounds for concluding that Indiana is likely to prevail on the contested issues,&#8221; wrote the judges.<\/p>\n<p>Judge Diane P. Wood dissented from the majority opinion. &#8220;The district court\u2019s rulings were grounded in careful and extensive findings of fact, and in my view scrupulously followed the Supreme Court\u2019s guidance in this difficult area,\u201d she wrote, according to <a href=\"https:\/\/news.bloomberglaw.com\/us-law-week\/indiana-can-enforce-abortion-law-after-court-lifts-injunction\" target=\"_blank\" rel=\"noopener\">Bloomberg Law<\/a>.\u00a0\u201cIt is a mystery to me why the State is unwilling frankly to say that its laws regulating abortion are designed to discourage that procedure to the maximum extent that is constitutionally permissible.&#8221;<\/p>\n<p>Indiana Right to Life President and CEO Mike Fichter cheered the reinstitution of the abortion restrictions. \u201cThis is a welcome ruling recognizing that Indiana is on solid legal ground in defending its laws.
