{"id":252443,"date":"2021-09-02T00:07:26","date_gmt":"2021-09-02T05:07:26","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=252443"},"modified":"2021-09-06T13:43:10","modified_gmt":"2021-09-06T18:43:10","slug":"supreme-court-allows-texas-abortion-law-stand","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/supreme-court-allows-texas-abortion-law-stand\/","title":{"rendered":"U.S. Supreme Court refuses to block Texas abortion law"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>On Wednesday evening, nearly 24 hours after the Texas Heartbeat Act (SB 8) <a href=\"https:\/\/archive.liveaction.org\/news\/texas-first-state-heartbeat-law\/\">went into effect<\/a> in Texas, the U.S. Supreme Court handed down a surprising 5-4 decision <em>rejecting<\/em>\u00a0all emergency requests to block it.<\/p>\n<p>According to a tweet from <a href=\"https:\/\/www.scotusblog.com\">SCOTUSblog<\/a>, the five Justices voting to allow the law to stand were Justices Clarence Thomas, Samuel Alito, Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett.\u00a0Justices Stephen Breyer, Sonia Sotomayor, and Elena Kagan were joined by Chief Justice John Roberts in dissent.<\/p>\n<p>Justice Sotomayor&#8217;s <a href=\"https:\/\/www.supremecourt.gov\/opinions\/20pdf\/21a24_8759.pdf\">dissent<\/a> in the application for injunctive relief, <em>Whole Woman&#8217;s Health v. Jackson<\/em>, joined by Justices Kagan and Breyer, notes, &#8220;Today, the Court belatedly explains that it declined to grant relief because of procedural complexities of the State\u2019s own invention.&#8221;<\/p>\n<div class=\"video-container\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">BREAKING: SUPREME COURT ALLOWS TEXAS ABORTION BAN TO REMAIN IN EFFECT. <br \/>The court rejects emergency request to block the law, which bans abortions after six weeks of pregnancy in defiance of Roe v. Opinions here:<a href=\"https:\/\/t.co\/5grhpm1GTA\">https:\/\/t.co\/5grhpm1GTA<\/a><\/p>\n<p>&mdash; SCOTUSblog (@SCOTUSblog) <a href=\"https:\/\/twitter.com\/SCOTUSblog\/status\/1433281871555833859?ref_src=twsrc%5Etfw\">September 2, 2021<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/div>\n<p>Sotomayor continued:<\/p>\n<p style=\"padding-left: 30px;\"><em>The Act authorizes any private citizen to file a lawsuit against any person who provides an abortion in violation of the Act, \u201caids or abets\u201d such an abortion (including by paying for it) regardless of whether they know the abortion is prohibited under the Act, or even intends to engage in such conduct&#8230;.<\/em><\/p>\n<p style=\"padding-left: 30px;\"><em>Today, the Court finally tells the Nation that it declined to act because, in short, the State\u2019s gambit worked. The structure of the State\u2019s scheme, the Court reasons, raises &#8216;complex and novel antecedent procedural questions&#8217; that counsel against granting the application, ante, at 1, just as the State intended. This is untenable. It cannot be the case that a State can evade federal judicial scrutiny by outsourcing the enforcement of unconstitutional laws to its citizenry.<\/em><\/p>\n<div class=\"video-container\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">The ruling is 5-4.<\/p>\n<p>Thomas, Alito, Gorsuch, Kavanaugh &amp; Barrett vote not to block the law.<\/p>\n<p>Chief Justice Roberts joins the three liberals (Breyer, Sotomayor &amp; Kagan) in dissent.<\/p>\n<p>&mdash; SCOTUSblog (@SCOTUSblog) <a href=\"https:\/\/twitter.com\/SCOTUSblog\/status\/1433282515817611266?ref_src=twsrc%5Etfw\">September 2, 2021<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/div>\n<p>In the Justices&#8217; <a href=\"https:\/\/www.supremecourt.gov\/opinions\/20pdf\/21a24_8759.pdf\">dissent<\/a>, Chief Justice John Roberts stated:<\/p>\n<p style=\"padding-left: 30px;\"><em>The application for injunctive relief or, in the alternative, to vacate stays of the district court proceedings presented to JUSTICE ALITO and by him referred to the Court is denied. To prevail in an application for a stay or an injunction, an applicant must carry the burden of making a \u201cstrong showing\u201d that it is \u201clikely to succeed on the merits,\u201d that it will be \u201cirreparably injured absent a stay,\u201d that the balance of the equities favors it, and that a stay is consistent with the public interest&#8230;.<\/em><\/p>\n<p style=\"padding-left: 30px;\"><em>The applicants now before us have raised serious questions regarding the constitutionality of the Texas law at issue. But their application also presents complex and novel antecedent procedural questions on which they have not carried their burden.<\/em><\/p>\n<p>Roberts also added that &#8220;it is unclear whether the named defendants in this lawsuit can or will seek to enforce the Texas law against the applicants in a manner that might permit our intervention,&#8221; noting that &#8220;this order is not based on any conclusion about the constitutionality of Texas\u2019s law, and in no way limits other procedurally proper challenges to the Texas law, including in Texas state courts.&#8221;<\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/S-lQOooYAs8\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe><\/p>\n<p><strong>READ:\u00a0<em><a href=\"https:\/\/archive.liveaction.org\/news\/first-trimester-babies-complex\/\">First trimester babies aren\u2019t blobs of tissue \u2014 they\u2019re amazingly complex<\/a><\/em><\/strong><\/p>\n<p>Prior to the decision, Amy Howe <a href=\"https:\/\/www.scotusblog.com\/2021\/09\/texas-abortion-ban-goes-into-effect-after-justices-fail-to-act\/\">wrote<\/a> at SCOTUSblog:<\/p>\n<p style=\"padding-left: 30px;\"><em>The Texas attorney general and other defenders of the law urged the justices to stay out of the dispute. Even if S.B. 8 were unconstitutional, the state contended, there still would be no reason for the Supreme Court to intervene because courts are limited in their power to grant relief before laws have actually been enforced. <\/em><\/p>\n<p style=\"padding-left: 30px;\"><em>In general, courts can bar people from doing something, but they have no power to \u201cexpunge the law itself,\u201d the state said. And in this case, the state contended, the challengers sued Texas government officials who \u201cexplicitly do not enforce the law\u201d as well as an anti-abortion activist who has testified that he will not bring any lawsuits under the law. <\/em><\/p>\n<p style=\"padding-left: 30px;\"><em>That means an order from the Supreme Court at this point would have no effect and would exceed the court\u2019s authority, the state argued.<\/em><\/p>\n<p>Justice Roberts mentioned these arguments in his dissent, as well.<\/p>\n<p>Texas Right to Life noted in an email, &#8220;Texas Right to Life celebrates this phenomenal victory for tens of thousands of preborn children who will be spared the evil of abortion. We are optimistic that the Texas Heartbeat Act will continue to survive ongoing and future legal attacks against this historic policy.&#8221;<\/p>\n<p>While this is good news for Texas babies and women for now, based on the dissents of the four Justices, there could be future successful court challenges to the Texas law. And while\u00a0there is no indication as to how the Justices will decide this fall in the case of <em>Dobbs v.
