A 25-year-old woman has been arrested and convicted for murder over the death of her newborn baby, who was tossed in an outdoor garbage bin shortly after birth in the area of Regensburg, Germany.<\/p>\n

According to The Mirror<\/a>, Jasmin H. was charged with murder after she put her baby girl in a plastic bag and threw her in the garbage bin on Christmas day 2020. She was sentenced to only three years in prison for negligent murder.<\/p>\n

Jasmin, a geriatric nurse, had gone into labor at about noon that day. When her roommates returned home, they found a pile of bloody towels, and asked Jasmin about it. She told them that her baby was stillborn, and they told her that she needed to go to the hospital. Once at the hospital, she also told the doctors that the baby had been stillborn. When asked where the child’s body was, she told them that she had flushed her baby down the toilet. “I didn’t want to have a child anyway,” she said.<\/p>\n

Her roommates, however, did not believe her, and called the police. The police then found the child’s body in the garbage bin, and arrested Jasmin. She maintained that the child had been stillborn, or that she at least thought<\/em> she was. However, an autopsy revealed that the baby girl was born alive, and lived for at least 30 minutes after birth. She died of suffocation, hypothermia, or possibly a combination of both.<\/p>\n

Germany has had its own version of baby boxes, known as Babyklappen, since 2000<\/a>. However, the rules surrounding them are said to be vague. In the U.S., safe haven laws<\/a> (or “Baby Moses laws”) and baby boxes<\/a> allow for newborns to be left with first responders anonymously if parents are unable to care for them.<\/p>\n

“We do not know when the child died, how she died, whether she was actively suffocated, or whether she suffocated or froze to death in the bag due to lack of air supply,” Judge Michael Hammer said. “If the mother wanted the child, the girl would be alive today.”<\/p>\n

And therein lies the problem. Children have been labeled “wanted” or “unwanted” by society for so long that it is used as a way to determine whether or not someone should be allowed to live. Every human being has the right to their life, even if “unwanted” by his or her own mother. One person’s opinion does not erase a child’s natural right to life, yet Jasmin viewed her daughter as disposable.<\/p>\n

Jasmin reportedly has another child who is currently in foster care.<\/p>\n
