The ordinance was first discussed last month where action on the measure was tabled until their August meeting. On August 9th, when the City Council met again, the ordinance was the first item addressed on the agenda and passed unanimously in a 6-0 vote. No one present spoke in opposition to the measure. The vote makes the City of Leona the smallest city to vote to ban abortion within its city limits \u2014 a point which was both recognized <em>and<\/em> celebrated by city leadership.<\/p>\n<p dir=\"ltr\">Mark Gray, the Vice Mayor of the City of Leona, shared, \u201cAs a member of the City\u2019s Council, it is a great privilege to be a part of such an important movement to save the lives of the unborn.\u201d Councilman Gray, who serves as the Pastor of Life Church in Leona, was quick to call other cities in his county to action, stating, \u201cFirst Centerville, now Leona and prayerfully the other municipalities in our great Leon County. I call on and ask the other councils in our community to take up this great need.\u201d<\/p>\n<p dir=\"ltr\">The City of Centerville, which is the county seat of Leon County, outlawed abortion last month. Other cities in Leon County which could join Centerville and Leona in outlawing abortion include: Buffalo (pop. 1,984), Jewett (pop. 1,250), Normangee (pop. 778), Oakwood (pop. 510), and Marquez (pop. 313).<\/p>\n<div id=\"attachment_251018\" style=\"width: 710px\" class=\"wp-caption aligncenter\"><img aria-describedby=\"caption-attachment-251018\" decoding=\"async\" loading=\"lazy\" class=\"size-large wp-image-251018\" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2021\/08\/Leona-City-Council-Texas-Mark-Lee-Dickson-700x379.jpg\" alt=\"\" width=\"700\" height=\"379\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2021\/08\/Leona-City-Council-Texas-Mark-Lee-Dickson-700x379.jpg 700w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2021\/08\/Leona-City-Council-Texas-Mark-Lee-Dickson-300x163.jpg 300w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2021\/08\/Leona-City-Council-Texas-Mark-Lee-Dickson-768x416.jpg 768w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2021\/08\/Leona-City-Council-Texas-Mark-Lee-Dickson-500x271.jpg 500w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2021\/08\/Leona-City-Council-Texas-Mark-Lee-Dickson.jpg 1200w\" sizes=\"(max-width: 700px) 100vw, 700px\" \/><p id=\"caption-attachment-251018\" class=\"wp-caption-text\">Leona City Council (Photo: Mark Lee Dickson)<\/p><\/div>\n<p dir=\"ltr\">Upon hearing of the news of Leona voting to outlaw abortion, Bishop Joseph E. Strickland of the Tyler Diocese shared, \u201cIt is my prayer that every community in East Texas and beyond will join this grassroots effort to protect the unborn. Let\u2019s make the USA a pro-life nation even if we have to do it one city at a time.\u201d<\/p>\n<p dir=\"ltr\">The Leona Ordinance reads: \u201cIt shall be unlawful for any person to procure or perform an abortion of any type and at any stage of pregnancy in the City of Leona, Texas\u201d and \u201cIt shall be unlawful for any person to knowingly aid or abet an abortion that occurs in the City of Leona, Texas.\u201d Abortion is defined by the ordinance as \u201cthe act of using or prescribing an instrument, a drug, a medicine, or any other substance, device, or means with the intent to cause the death of an unborn child of a woman known to be pregnant.\u201d The ordinance is clear that the term does not include birth control devices or oral contraceptives. The ordinance is also clear that the act is not an abortion if the act is done with the intent to \u201csave the life or preserve the health of an unborn child\u201d or \u201cremove a dead, unborn child whose death was caused by accidental miscarriage\u201d or \u201cremove an ectopic pregnancy.\u201d<\/p>\n<p dir=\"ltr\">In addition to outlawing abortion, the Leona Ordinance also outlaws abortion-inducing drugs, stating, \u201cIt shall be unlawful for any person to possess or distribute abortion-inducing drugs in the City of Leona, Texas.\u201d The Ordinance defines \u201cabortion-inducing drugs\u201d as \u201cmifepristone, misoprostol, and any drug or medication that is used to terminate the life of an unborn child.\u201d In defining \u201cabortion-inducing drugs\u201d the ordinance is clear that it does <em>not<\/em> include \u201cbirth-control devices or oral contraceptives, and it does not include Plan B, morning-after pills, or emergency contraception.\u201d The term also does <em>not<\/em> include \u201cdrugs or medications that are processed or distributed for a purpose that does not include the termination of a pregnancy.\u201d<\/p>\n<p dir=\"ltr\">Like every ordinance outlawing abortion in Texas, the Leona Ordinance contains both public and private enforcement mechanisms. The public enforcement mechanism establishes fines against the abortionist and anyone who aids and abets the abortionist for any abortion which takes place within the City limits of Leona. The ordinance is clear that these fines cannot be imposed unless it is determined by a state or federal court that the individual seeking to impose the penalty upon the one who committed the unlawful act will not create an \u201cundue burden\u201d on women seeking abortions, a state or federal court determines the person, corportation, or entity who committed the unlawful act of abortion lacks standing to assert the third-party rights of women seeking abortions in court, or the Supreme Court overrules <em>Roe v. Wade<\/em> and <em>Planned Parenthood v. Casey<\/em>.<\/p>\n<p dir=\"ltr\"><strong>READ:\u00a0<em><a href=\"https:\/\/archive.liveaction.org\/news\/eastland-texas-34th-nation-outlaw-abortion\/\">Another city in Texas has become the 34th in the nation to outlaw abortion<\/a><\/em><\/strong><\/p>\n<p dir=\"ltr\">While the public enforcement mechanism\u2019s enforcement is based on other factors, the private enforcement mechanism is immediately enforceable. The Leona Ordinance states, \u201cAny person\u2026 may bring a civil enforcement suit against a person or entity that commits or intends to commit an unlawful act\u2026\u201d This section is immediately enforceable and allows for anyone, including any relative of the unborn child, to sue the abortionist or anyone who aids and abets the abortionist for the death of the unborn child.<\/p>\n<p dir=\"ltr\">If Leona faces a lawsuit as a result of the adoption of this ordinance, former Texas Solicitor General Jonathan F. Mitchell has agreed to represent the city of Leona at no cost to the city and taxpayers for any litigation which may result over the passage of their ordinance outlawing abortion.<\/p>\n<p dir=\"ltr\">Leona follows the Texas cities of <a href=\"https:\/\/archive.liveaction.org\/news\/texas-city-levelland-30th-nation-outlaw-abortion\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/archive.liveaction.org\/news\/texas-city-levelland-30th-nation-outlaw-abortion\/&amp;source=gmail&amp;ust=1628697218624000&amp;usg=AFQjCNHmyaS62-eAkYDZDJzf6y6TK12dqg\">Levelland<\/a> (pop. 14,582), <a href=\"https:\/\/archive.liveaction.org\/news\/sundown-texas-31st-sanctuary-unborn-us\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/archive.liveaction.org\/news\/sundown-texas-31st-sanctuary-unborn-us\/&amp;source=gmail&amp;ust=1628697218624000&amp;usg=AFQjCNEaNUnRT4PSL-j7dtjM9NZLUvUFeg\">Sundown<\/a> (pop. 1,397), <a href=\"https:\/\/archive.liveaction.org\/news\/sterling-city-texas-32nd-sanctuary-unborn\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/archive.liveaction.org\/news\/sterling-city-texas-32nd-sanctuary-unborn\/&amp;source=gmail&amp;ust=1628697218624000&amp;usg=AFQjCNF90es43DGKcJDMdE1nfX9S4Hgcaw\">Sterling City<\/a> (pop. 888), <a href=\"https:\/\/archive.liveaction.org\/news\/texas-centerville-33rd-nation-outlaw-abortion\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/archive.liveaction.org\/news\/texas-centerville-33rd-nation-outlaw-abortion\/&amp;source=gmail&amp;ust=1628697218624000&amp;usg=AFQjCNGgP7AZx4oOsdejlxcBEQEYy5kRJA\">Centerville<\/a> (pop. 892), and <a href=\"https:\/\/archive.liveaction.org\/news\/eastland-texas-34th-nation-outlaw-abortion\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/archive.liveaction.org\/news\/eastland-texas-34th-nation-outlaw-abortion\/&amp;source=gmail&amp;ust=1628697218624000&amp;usg=AFQjCNGs-_QaNd0weGS0e8Sd-xYve5pmjg\">Eastland<\/a> (pop. 3,970) as the sixth city to outlaw abortion since the lawsuit by Planned Parenthood against the City of Lubbock was <a href=\"https:\/\/archive.liveaction.org\/news\/judge-dismisses-planned-parenthoods-lawsuit\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/archive.liveaction.org\/news\/judge-dismisses-planned-parenthoods-lawsuit\/&amp;source=gmail&amp;ust=1628697218624000&amp;usg=AFQjCNFgHuDuEERH25BkL8Bql-PkuafGxQ\">dismissed<\/a> in Federal Court and the 22nd city to outlaw abortion since the ACLU <a href=\"https:\/\/archive.liveaction.org\/news\/aclu-withdraws-lawsuit-texas-sanctuary-cities-unborn\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/archive.liveaction.org\/news\/aclu-withdraws-lawsuit-texas-sanctuary-cities-unborn\/&amp;source=gmail&amp;ust=1628697218624000&amp;usg=AFQjCNH1apOyAEbaGlYYHWIyFpcNiccm3w\">withdrew<\/a> its lawsuit against seven cities in East Texas.<\/p>\n<p dir=\"ltr\">Leona is not expected to be the last city to outlaw abortion.<\/p>\n<p dir=\"ltr\">On the same night Leona passed its ordinance, a heated exchange took place over a thousand miles away in Mason, Ohio (pop. 34,450) \u2014 a city located about 25 miles north of Cincinnati. Even though outlawing abortion was not on the Mason City Council\u2019s agenda for the night, Planned Parenthood and other pro-choice groups mobilized in opposition to the possibility of the city outlawing abortion in the near future.<\/p>\n<p dir=\"ltr\">While the City Council meeting in Leona was quiet and free of outbursts, the City Council meeting for Mason was the complete opposite, with the Mason Police Department eventually recommending that the Mayor and City Council adjourn the meeting early. Despite the adjournment of the council meeting, the discussion of outlawing abortion is far from over in Mason, Ohio.<\/p>\n<p dir=\"ltr\">Mason City Councilman T.J.
