As new pro-life legislation is been enacted in cities and states across the U.S., abortion activists have <\/span>signaled<\/span><\/a> a fear that state abortion laws are becoming too restrictive. Some point to the abortion legislation of a variety of <\/span>European nations as a model<\/span><\/a> for the United States to follow. But according to\u00a0<\/span>a new analysis<\/span><\/a> from the Charlotte Lozier Institute (CLI), the vast majority of European countries have laws that limit abortion more than U.S. states currently do.\u00a0<\/span><\/p>\n

CLI\u2019s <\/span>analysis<\/span><\/a> examined European nations\u2019 policies on elective abortion \u201cto determine how Mississippi\u2019s late-term abortion restriction stands in comparison to European norms.\u201d The report looked at a total of 50 European nations with populations of at least one million people. Mississippi\u2019s 2018 Gestational Age Act limited abortion to 15 weeks, but was struck down by a lower court. This fall, the Supreme Court will hear the case, known as\u00a0<\/span>Dobbs v. Jackson Women\u2019s Health Organization<\/span><\/i><\/a>.\u00a0<\/span><\/i><\/p>\n

According to the CLI report, 47 out of 50 European nations either do not allow abortion on demand or place limits to the procedure at less than 15 weeks\u2019 gestation. <\/span><\/p>\n

More than half of the European nations analyzed \u2014 27 out of 50 \u2014 limit abortion to the first 12 weeks of pregnancy. Of the remaining countries, five countries limit abortion on demand to 10 weeks\u2019 gestation; seven allow abortion on demand between 12 and 14 weeks\u2019 gestation; and eight prohibit abortion on demand altogether by requiring a <\/span>reason<\/span><\/i>, ranging from extremely restrictive reasons like concern for life of the mother, to least restrictive reasons like socioeconomic concerns. Only three of 50<\/em> countries permit abortion on demand at a point greater than 15 weeks\u2019 gestation: The Netherlands (24 weeks), Iceland (22 weeks), and Sweden (18 weeks).<\/span><\/p>\n

The findings place Mississippi\u2019s Gestational Age Act \u2014\u00a0along with any other standing pre-viability restrictions in other states \u2014\u00a0squarely in the mainstream of European policy. <\/span><\/p>\n

\u201cMississippi\u2019s law brings the United States a small step closer both to European and global norms,\u201d said Angelina B. Nguyen, J.D., the report\u2019s author and a Charlotte Lozier Institute scholar, according to a <\/span>press release<\/span><\/a>. \u201cNo European nation allows elective abortion through all nine months of pregnancy, as is effectively permitted in several U.S. states.\u201d\u00a0<\/span><\/p>\n

One might wonder how Texas\u2019 media-famous six-week abortion restriction holds up to this scrutiny. Despite media language referring to the law as an abortion “bounty,”<\/a> it is a <\/span>civil <\/span><\/i>law that allows private citizens to sue abortionists. It is not a criminally enforceable ban on pre-viability abortions. This means it doesn\u2019t fall under the Supreme Court precedent that bans states from penalizing abortions prior to viability, the precedent considered by the CLI report.\u00a0\u00a0<\/span><\/p>\n

The reality is that the U.S. is <\/span>one of just seven countries<\/span><\/a>, including China and North Korea, that allows abortion past 20 weeks\u2019 gestation. State-level abortion restrictions have been struck down by U.S. federal courts due to Supreme Court rulings that allow states to restrict abortion only at the point of “viability,”<\/a> which is not a definitive point. Several states \u2014 including two of the top four states by population, California and New York \u2014 have laws permitting abortion through all nine months of pregnancy.<\/span><\/p>\n
