Wade<\/em> abortion decision, Justice Harry Blackmun allowed in his opinion for unrestricted abortion prior to \u201cviability\u201d \u2014 typically\u00a0defined as the age at which a child can survive outside the womb (with 24 weeks as a longtime standard, despite the fact that children have since survived at 21 weeks).\u00a0But Blackmun\u2019s arbitrary 24-week line appears to be in conflict with a citation and definition used in a brief filed by Roe attorney Sarah Weddington as well as in a brief filed on behalf of the American College of Obstetricians and Gynecologists (ACOG).<\/p>\n<p>The citation can be found in Louise Hellman and Jack Pritchard&#8217;s medical textbook, &#8220;Williams Obstetrics 493,&#8221; (14th edition from 1971).\u00a0 The text stated at the time, \u201cAbortion is the termination of a pregnancy at any time before the fetus has attained a stage of viability.&#8221; The medical reference book then went on to define viability this way: &#8220;Interpretations of the word \u2018viability\u2019 have varied between fetal weights of 400 g (about\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/acog-slams-20-week-abortion-bans-wants-zero-restrictions\/\" target=\"_blank\" rel=\"noopener\">20 weeks<\/a>\u00a0of gestation) and 1,000 g (about 28 weeks of gestation)\u2026\u201d<\/p>\n<div id=\"attachment_250406\" style=\"width: 807px\" class=\"wp-caption aligncenter\"><img aria-describedby=\"caption-attachment-250406\" decoding=\"async\" loading=\"lazy\" class=\" wp-image-250406\" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2021\/08\/Hellman-and-Pritchard-Williams-Obstetrics-14th-edition-1971-Viability.jpg\" alt=\"Image: Hellman and Pritchard Williams Obstetrics 14th edition 1971 Viability and abortion \" width=\"797\" height=\"439\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2021\/08\/Hellman-and-Pritchard-Williams-Obstetrics-14th-edition-1971-Viability.jpg 1288w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2021\/08\/Hellman-and-Pritchard-Williams-Obstetrics-14th-edition-1971-Viability-300x165.jpg 300w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2021\/08\/Hellman-and-Pritchard-Williams-Obstetrics-14th-edition-1971-Viability-768x423.jpg 768w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2021\/08\/Hellman-and-Pritchard-Williams-Obstetrics-14th-edition-1971-Viability-700x385.jpg 700w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2021\/08\/Hellman-and-Pritchard-Williams-Obstetrics-14th-edition-1971-Viability-500x275.jpg 500w\" sizes=\"(max-width: 797px) 100vw, 797px\" \/><p id=\"caption-attachment-250406\" class=\"wp-caption-text\">Hellman and Pritchard Williams Obstetrics 14th edition 1971 Viability and abortion<\/p><\/div>\n<p><strong>Brief by\u00a0Roe attorney<\/strong><\/p>\n<p>That citation was referenced by Roe attorneys Sarah Weddington, Linda Coffee, and Roy Lucas in a brief they filed to appeal a June 1970 decision by the U.S. District Court for the Northern District of Texas, a lower court ruling which eventually led to the case being heard by the Supreme Court.<\/p>\n<div class=\"video-container\">\n<p>Roy Lucas was a lawyer who helped fashion the \u201cright to privacy\u201d legal argument used in\u00a0<em>Roe v. Wade<\/em>,\u00a0<a href=\"https:\/\/www.nytimes.com\/2003\/11\/07\/us\/roy-lucas-61-legal-theorist-who-helped-shape-roe-suit.html\" target=\"_blank\" rel=\"noopener\">according<\/a>\u00a0to the New York Times. Wade viability at 20 weeks (Sarah Weddington and Roy Lucas brief)<\/p><\/div>\n<p><strong>ACOG brief also acknowledged &#8220;viability&#8221; at 20 weeks<\/strong><\/p>\n<p>A second friend-of-the-court brief was\u00a0<a href=\"https:\/\/biotech.law.lsu.edu\/cases\/reproduction\/bolton.htm\" target=\"_blank\" rel=\"noopener\">filed<\/a>\u00a0by Lucas in the <em>Doe v. Bolton<\/em> case (the companion case to Roe) on\u00a0behalf of ACOG, the American Medical Women\u2019s Association, the American Psychiatric Association, the New York Academy of Medicine, and others. Russell<\/a>\u00a0as well as former Planned Parenthood president\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/planned-parenthood-population-control-abortion\/\" target=\"_blank\" rel=\"noopener\">Alan F. Guttmacher, M.D<\/a>, among several others.<\/p>\n<p>Guttmacher, a former VP of the American Eugenics Society, was the first medical doctor to head Planned Parenthood and was\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/planned-parenthood-first-abortion-center\/\">instrumental in leading the organization<\/a>\u00a0to begin committing abortions.\u00a0Russell served on the board of Planned Parenthood of Los Angeles and served two terms as ACOG president. According to the <a href=\"https:\/\/archive.liveaction.org\/news\/exposing-acog-population-control-influenced-organization\/\" target=\"_blank\" rel=\"noopener\">Los Angeles Times<\/a>,\u00a0Russell \u201cled medical professionals in their fight to liberalize the California abortion law in 1967.\u201d<\/p>\n<p>Interestingly, both editors of the Williams Obstetrics &#8220;viability&#8221; definition,\u00a0Pritchard and Hellman, lent their support in the brief as well. In 1971, Hellman <a href=\"https:\/\/www.plannedparenthood.org\/about-us\/newsroom\/campaigns\/ppfa-margaret-sanger-award-winners#hellman\" target=\"_blank\" rel=\"noopener\">received<\/a> Planned Parenthood&#8217;s Margaret Sanger award, named after their white supremacist founder. He became president of ACOG in 1974.<\/p>\n<p>The New York Times claimed that Hellman favored the liberalization of abortion,\u00a0<a href=\"https:\/\/www.nytimes.com\/1990\/07\/25\/obituaries\/dr-louis-m-hellman-dies-at-82-a-champion-of-family-planning.html\" target=\"_blank\" rel=\"noopener\">reporting<\/a> that, in 1973, Hellman &#8220;was in charge of population affairs for the Federal Government&#8221; where &#8220;his office made plans to distribute a film advocating legal abortion to public schools and colleges.&#8221; But the idea was reportedly &#8220;shelved by Caspar W. Weinberger, then Secretary of Health, Education and Welfare, when anti-abortion groups rose in opposition.&#8221; In 1977, Hellman left the department to become medical director of the Population Reference Bureau.<\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/yIiTGFdT4IM\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p><strong>Funded by abortion group likely responsible for term &#8220;right to choose&#8221;<\/strong><\/p>\n<p>Greenhouse claims Lucas, who helped to draft both briefs, received funding from the Association for the Study of Abortion\u201d (ASA), originally\u00a0<a href=\"https:\/\/www.sentienceinstitute.org\/anti-abortion\" target=\"_blank\" rel=\"noopener\">founded<\/a>\u00a0by Alan Guttmacher in <a href=\"https:\/\/academicinfluence.com\/inflection\/influence\/controversial-topic-abortion\" target=\"_blank\" rel=\"noopener\">1964<\/a> as the Committee for a Humane Abortion Law and\u00a0<a href=\"https:\/\/www.rbf.org\/sites\/default\/files\/2021-03\/1968-AR-web-optimized.pdf\" target=\"_blank\" rel=\"noopener\">funded<\/a>\u00a0in part by the Rockefeller Brothers Fund. According to author David Garrow, Hellman also served on the ASA board.<\/p>\n<p>\u201cThe Association for the Study of Abortion gave Lucas a grant to prepare a model trial brief that could be used to test the abortion laws of any state, based on the New York model \u2014 abortion only to preserve the mother\u2019s life\u2026\u201d Greenhouse\u00a0<a href=\"https:\/\/www.nytimes.com\/1970\/01\/25\/archives\/constitutional-question-is-there-a-right-to-abortion-is-there-a.html\" target=\"_blank\" rel=\"noopener\">wrote<\/a>\u00a0in the New York Times.<\/p>\n<p>ASA has been\u00a0<a href=\"https:\/\/www.lifenews.com\/2021\/04\/12\/document-reveals-how-abortion-activists-came-up-with-the-false-term-pro-choice\/\" target=\"_blank\" rel=\"noopener\">credited<\/a>\u00a0with the creation of the term \u201cright to choose.\u201d<\/p>\n<p>\u201cRight to life is short, catchy, composed of monosyllabic words \u2014 an important consideration in English. We need something comparable. Right to choose would seem to do the job. And \u2026 choice has to do with action, and it\u2019s action that we\u2019re concerned with,\u2019 \u201d <a href=\"https:\/\/www.npr.org\/templates\/story\/story.php?storyId=127931932\">said<\/a> Jimmye Kimmey, executive director of ASA. Kimmey once referred to the \u201cfierceness of the opposition\u201d claiming that if they received a favorable ruling in Roe, the struggle \u201cwould not be over\u201d but instead the \u201cbeginning of a tough new era.\u201d<\/p>\n<p><strong>ACOG ambivalence on 20-week abortion<\/strong><\/p>\n<p>A 1981 report published by the Philadelphia Inquirer, the \u201cDreaded Complication,\u201d addressed babies born alive after attempted abortions. In it was evidence that some of ACOG&#8217;s leadership felt an apprehension to abortion past 20 weeks.<\/p>\n<p>The Philadelphia Inquirer quoted Dr. Ervin Nicholas, then-director of practice activities for ACOG. \u201cWe\u2019re not really very pro-abortion. As a matter of fact, anything beyond 20 weeks, we\u2019re kind of upset about it,\u201d he said.<\/p>\n<p>The Inquirer asked, \u201cIf abortions after 20 weeks are a dubious practice, how does that square with abortion up to 24 weeks being offered openly in Los Angeles and New York and advertised in newspapers and the Yellow Pages there and elsewhere?\u201d<\/p>\n<p>Nicholas replied, \u201c\u2018That\u2019s not medicine. That\u2019s hucksterism.\u201d<\/p>\n<p><strong>ACOG now approves abortion on demand<\/strong><\/p>\n<p>But today, ACOG is staunchly pro-abortion. In fact, the organization&#8217;s evolution to <a href=\"https:\/\/archive.liveaction.org\/news\/american-college-obstetricians-gynecologists-will-members\/\" target=\"_blank\" rel=\"noopener\">supporting<\/a> abortion came through the\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/exposing-acog-population-control-influenced-organization\/\" target=\"_blank\" rel=\"noopener\">influence of population control enthusiasts<\/a>\u00a0connected to Planned Parenthood and the abortion industry, some which\u00a0even helped ACOG to\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/acog-abortion-population-control-redefined-beginning-life\/\" target=\"_blank\" rel=\"noopener\">redefine<\/a>\u00a0when human life begins. And despite acknowledging that &#8220;viability&#8221; could be as early as 20 weeks, any apprehension to abortion <a href=\"https:\/\/archive.liveaction.org\/news\/acog-slams-20-week-abortion-bans-wants-zero-restrictions\/\" target=\"_blank\" rel=\"noopener\">past<\/a> the 20-week gestational marker seems to have <a href=\"https:\/\/www.acog.org\/news\/news-releases\/2015\/05\/acog-wisconsin-section-opposes-20-week-abortion-ban-bill\" target=\"_blank\" rel=\"noopener\">faded away<\/a>; the organization today\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/american-college-obstetricians-gynecologists-will-members\/\" target=\"_blank\" rel=\"noopener\">fails to represent<\/a> the majority of its members while continuing to lend\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/exposing-acog-medical-organization-supports-abortion-industry\/\" target=\"_blank\" rel=\"noopener\">support and cover<\/a>\u00a0to the abortion industry while <a href=\"https:\/\/web.archive.org\/web\/20140308022450\/http:\/\/www.acog.org\/About_ACOG\/News_Room\/News_Releases\/2013\/Open_Letter_to_Texas_Legislators\" target=\"_blank\" rel=\"noopener\">advocating<\/a> abortion on demand at any stage of development.<\/p>\n<p style=\"text-align: center;\"><em><strong><a href=\"https:\/\/www.facebook.com\/liveactionnewsonline\/\">\u201cLike\u201d Live Action News on Facebook<\/a>\u00a0for more pro-life news and commentary!<\/strong><\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>In the Supreme Court\u2019s Roe v.
