Within the brief, the law firm argued the rights of voters and preborn children were violated by Rhode Island\u2019s 2019 <\/span><a href=\"http:\/\/webserver.rilin.state.ri.us\/BillText\/BillText19\/HouseText19\/H5125.pdf\"><span style=\"font-weight: 400;\">Reproductive Privacy Act<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/rhode-island-house-abortion-ending-protections\/\"><span style=\"font-weight: 400;\">Live Action News<\/span><\/a> <span style=\"font-weight: 400;\">has previously reported, the bill allows for abortions throughout all nine months of pregnancy even if <\/span><i><span style=\"font-weight: 400;\">Roe v. Wade<\/span><\/i><span style=\"font-weight: 400;\"> is overturned. In addition, the act <em>overturned<\/em> a statute that made it possible to charge an assailant who with fetal homicide if the perpetrator attacks a pregnant woman and kills her preborn child.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to the <\/span><a href=\"https:\/\/thomasmoresociety.org\/voters-and-preborn-children-find-support-in-thomas-more-society-rhode-island-supreme-court-filing\/\"><span style=\"font-weight: 400;\">Thomas More Society,<\/span><\/a><span style=\"font-weight: 400;\"> Rhode Islanders were deprived of the constitutional right to even vote on such a measure. In contrast, the preborn were denied an even greater right: their legal rights as persons.\u00a0<\/span><span style=\"font-weight: 400;\">As the nonprofit law firm stated on its <\/span><a href=\"https:\/\/thomasmoresociety.org\/voters-and-preborn-children-find-support-in-thomas-more-society-rhode-island-supreme-court-filing\/\"><span style=\"font-weight: 400;\">website<\/span><\/a><span style=\"font-weight: 400;\">, this filing will support the \u201cpersonhood rights of preborn children\u201d and the \u201crights of eligible Rhode Island voters who would have voted against a constitutional amendment recognizing the right of abortion had it been put before an electorate.\u201d<\/span><\/p>\n<p><strong>READ:\u00a0<em><a href=\"https:\/\/archive.liveaction.org\/news\/rhode-island-abortion-babies-birth-life-health\/\">Rhode Island abortion law allows babies to be killed up to birth for life or \u2018health\u2019 of mother<\/a><\/em><\/strong><\/p>\n<p><span style=\"font-weight: 400;\">In an interview with Live Action News, Thomas Olp, Vice President and Senior Counsel at the Thomas More Society, explained the flaws behind the 2019 act and the purpose in filing the brief.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cIt would be in a pro-life interest to have courts recognize that unborn human beings are persons, even if <\/span><i><span style=\"font-weight: 400;\">Roe v. Wade<\/span><\/i><span style=\"font-weight: 400;\"> says they\u2019re not a person under the Fourteenth Amendment,\u201d Olp said.\u00a0<\/span><span style=\"font-weight: 400;\">\u201cNow, we say, the only thing that <\/span><i><span style=\"font-weight: 400;\">Roe v. Wade <\/span><\/i><span style=\"font-weight: 400;\">said is &#8211; the contest between a mother and her baby &#8211; the mother trumps the interests of the unborn child, right?\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">He added, \u201cAnd so if we narrow <\/span><i><span style=\"font-weight: 400;\">Roe v. Wade <\/span><\/i><span style=\"font-weight: 400;\">to that context, in the fetal homicide area, for example, the quick child law area, there\u2019s no such pitting of interest &#8211; the interest of the mother and the interest of the fetus are identical &#8211; so why wouldn\u2019t a court be able to recognize the interest of that unborn child?\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Since fetal homicide laws grant preborn children \u201cprotectable interests under law,\u201d Olp said, idealogues like the ones behind bills like the Reproductive Privacy Act are trying to undo them.\u00a0<\/span><span style=\"font-weight: 400;\">\u201cIt\u2019s just striking to me what a different worldview it was before <\/span><i><span style=\"font-weight: 400;\">Roe v. Wade<\/span><\/i><span style=\"font-weight: 400;\"> in terms of how an unborn child was looked at in the law.\u00a0<\/span><span style=\"font-weight: 400;\">And I would say it\u2019s a mark of how degraded our society has become in terms of protecting the voiceless, the victims of the world &#8211; the people who have no voice.
