The former employee claims Amazon denied her a change of work position from her labor-intensive job which required heavy lifting. <\/span><\/p>\n<p>According to <a href=\"https:\/\/www.vice.com\/en\/article\/g5g8eq\/amazon-denied-a-worker-pregnancy-accommodations-then-she-miscarried\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Motherboard<\/span><\/a><span style=\"font-weight: 400;\">, Patty Hernandez alleges that Amazon\u2019s Human Resources (HR) department\u2019s refusal to reassign her to a less strenuous role within the warehouse was a contributing factor, if not the cause, of her miscarriage last October. The story reports that 23-year-old Hernandez was a packer at the OAK4 facility, one of six Amazon houses in the suburban San Francisco area of Tracy, California. One day while at work, she said she \u201cfelt the sudden urge to go to the bathroom\u201d and \u201cdashed across the warehouse to a bathroom stall, and discovered blood in her pants.\u201d Seven weeks pregnant, Hernandez suffered a miscarriage, believing Amazon\u2019s HR department was a contributor.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">While Motherboard did not print the note that Hernandez sent to the HR department prior to her miscarriage, <\/span><a href=\"https:\/\/www.vice.com\/en\/article\/g5g8eq\/amazon-denied-a-worker-pregnancy-accommodations-then-she-miscarried\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">the outlet said<\/span><\/a><span style=\"font-weight: 400;\">\u00a0it did obtain and verify a copy. Hernandez had reportedly \u201cpleaded repeatedly with her manager and the warehouse&#8217;s human resources for lighter duty, and submitted a doctor&#8217;s note to Amazon&#8217;s human resources requesting pregnancy accommodations.\u201d She requested that her job, while pregnant, not involve lifting or carrying more than 20 pounds or being on her feet for more than 50% of her shift \u2014\u00a0something Hernandez said was verbally and explicitly denied by an HR representative who told her that no such work existed.<\/span><\/p>\n<p><strong>READ:\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/google-employee-maternity-leave-return-pregnancy-discrimination\/\" target=\"_blank\" rel=\"noopener\"><em>Google employee alleges pregnancy discrimination and refuses to return after maternity leave<\/em><\/a><\/strong><\/p>\n<p><span style=\"font-weight: 400;\">While Amazon has not yet made a counter-reply regarding Hernandez\u2019s claim, this is not the first time the global retailer has come under fire for alleged pregnancy discrimination. Last year <\/span><a href=\"https:\/\/jezebel.com\/amazon-allegedly-forced-pregnant-people-to-risk-miscarr-1845302182\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">four women<\/span><\/a><span style=\"font-weight: 400;\"> at Amazon\u2019s Oklahoma City fulfillment center alleged circumstances almost identical to Hernandez\u2019s<\/span><span style=\"font-weight: 400;\">. And in 2019,<\/span> <a href=\"https:\/\/www.cnet.com\/features\/amazon-fired-these-7-pregnant-workers-then-came-the-lawsuits\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">CNET<\/span><\/a><span style=\"font-weight: 400;\"> reviewed seven lawsuits against Amazon filed on behalf of pregnant women in the eight years prior, reporting,<\/span><span style=\"font-weight: 400;\">\u00a0\u201cThe requests [from the pregnant women] included longer bathroom breaks and fewer continuous hours on their feet\u2026 but in all of the cases the expectant mothers were fired after telling their managers they were pregnant. Six of the cases were settled out of court.&#8221;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, Amazon continued to deny any wrongdoing. <\/span><span style=\"font-weight: 400;\">According to CNET<\/span><span style=\"font-weight: 400;\">, \u201cAmazon says it doesn&#8217;t monitor the length of bathroom breaks.&#8221;\u00a0Amazon said it would not comment on any of the lawsuits specifically, however, a<\/span>n Amazon spokeswoman said in a statement:<\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-weight: 400;\"><em>It is absolutely not true that Amazon would fire any employee for being pregnant; we are an equal opportunity employer. We work with our employees to accommodate their medical needs including pregnancy-related needs. We also support new parents by offering various maternity and parental leave benefits.<\/em> <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Whether Amazon will comment on Hernandez\u2019s allegations or not remains to be seen; however, <\/span><span style=\"font-weight: 400;\">Hernandez <\/span><a href=\"https:\/\/www.vice.com\/en\/article\/g5g8eq\/amazon-denied-a-worker-pregnancy-accommodations-then-she-miscarried\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">told<\/span><\/a><span style=\"font-weight: 400;\"> Motherboard<\/span><span style=\"font-weight: 400;\"> that her manager was not accommodating to her medical need and only asked her why her productivity was so low and why she spent so much time in the bathroom.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">After her miscarriage, she asked for medical leave, but it was denied because Hernandez had not worked enough hours under the Family and Medical Leave Act.
