Together, they have filed an amicus brief supporting South Carolina&#8217;s appeal of the ruling, arguing that the judge\u2019s decision was \u201can error-filled district court opinion.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In February, South Carolina Governor Henry McMaster <a href=\"https:\/\/archive.liveaction.org\/news\/south-carolina-heartbeat-bill-planned-lawsuit\/\" target=\"_blank\" rel=\"noopener\">signed<\/a> the <\/span><a href=\"https:\/\/www.scstatehouse.gov\/query.php?search=DOC&amp;searchtext=fetal%20heartbeat&amp;category=LEGISLATION&amp;session=124&amp;conid=36594881&amp;result_pos=0&amp;keyval=1240001&amp;numrows=10\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Fetal Heartbeat and Protection from Abortion Act<\/span><\/a><span style=\"font-weight: 400;\"> into law. The law requires abortionists to provide an ultrasound for the mother, and if the preborn child\u2019s heartbeat is detected, abortion is prohibited. The human heart begins to beat between 16 and 22 days post-fertilization.\u00a0A doctor who commits abortions after the preborn child\u2019s heartbeat is detectable could face a felony charge, fines, and jail time.\u00a0<\/span><span style=\"font-weight: 400;\">The law includes an exception for cases of a medical emergency, though the intentional killing of a preborn child is never <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/former-abortionist-not-necessary-abort-hard-cases\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">medically necessary<\/span><\/a><span style=\"font-weight: 400;\">, and also has additional exceptions for rape, incest, and fetal diagnoses.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Commenting on the law earlier this year, Senate Majority Leader Shane Massey (R) stated, \u201cIf this gets upheld by the courts, we will have saved thousands of lives in South Carolina every year.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Just one day after the governor signed the bill, Planned Parenthood South Atlantic and several other pro-abortion groups filed suit against it. U.S. District Judge Mary Geiger Lewis then granted a preliminary injunction against the law, which means that it can&#8217;t be put into effect until a court reaches a decision.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The lawsuit came as no surprise to pro-life advocates. When the House passed the bill in February, pro-abortion House members <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/south-carolina-house-walk-out-heartbeat-pretend-life\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">walked out<\/span><\/a><span style=\"font-weight: 400;\"> in protest during the debate. One of those House members referred to the bill as a \u201cfarce of a vote about pretend life\u201d\u2014despite the <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/40-quotes-from-medical-experts-that-prove-human-life-begins-at-conception\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">indisputable fact<\/span><\/a><span style=\"font-weight: 400;\"> that preborn children are living human beings from the moment of fertilization.\u00a0<\/span><\/p>\n<p style=\"text-align: center;\">\u00a0<iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/O3updQZsM7o\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">South Carolina\u00a0<\/span><a href=\"https:\/\/governor.sc.gov\/sites\/default\/files\/Documents\/Executive-Branch\/2021-07-07%2032%20Brief%20of%20Appellants%20(updated).pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">filed an appeal<\/span><\/a><span style=\"font-weight: 400;\"> of the injunction last week, arguing that the plaintiffs lacked the legal standing to bring a lawsuit and that only the &#8220;heartbeat&#8221; provision being challenged in court \u2014 not the entire measure \u2014 should be allowed to be blocked. They are arguing against the judge\u2019s ruling that the ultrasound requirement of the law is not severable from the &#8220;heartbeat&#8221; portion of the law.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cSouth Carolina\u2019s fetal heartbeat law was struck down in an error-filled district court opinion,\u201d said Attorney General Steve Marshall in a <\/span><a href=\"https:\/\/www.alabamaag.gov\/Documents\/news\/Attorney%20General%20Steve%20Marshall%20Files%20Brief%20Defending%20South%20Carolina%20Abortion%20Law.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">press release<\/span><\/a><span style=\"font-weight: 400;\">. \u201cAlthough Planned Parenthood and the other plaintiffs challenged only the law\u2019s regulation of abortion after a fetal heartbeat is detected, the district court enjoined the law in its entirety \u2014 including portions of the law that dozens of other states already have and regularly enforce.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">On July 13, Marshall filed an <\/span><a href=\"https:\/\/www.alabamaag.gov\/Documents\/news\/South%20Carolina%20Abortion%20Law%20Amicus%20Brief.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">amicus brief<\/span><\/a><span style=\"font-weight: 400;\"> before the U.S. Court of Appeals for the Fourth Circuit on behalf of Alabama and 19 other states in support of South Carolina\u2019s defense of the law.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Marshall was quick to note that at least 24 states require an abortion provider to offer to display the image from an ultrasound to the pregnant mother, at least 16 states require abortion providers to make fetal heartbeat audible if the mother would like to hear it, and at least 12 other states require an ultrasound to be performed before an abortion can be conducted.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Joining Marshall in signing the amicus brief are attorneys general from Arkansas, Georgia, Idaho, Indiana, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, North Dakota, Ohio, Oklahoma, Tennessee, Texas, Utah, and West Virginia.<\/span><\/p>\n<p><strong>READ:\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/congress-should-pass-the-heartbeat-bill-to-protect-life-once-a-heartbeat-is-detected\/\" target=\"_blank\" rel=\"noopener\"><em>The science is clear: At 22 days, a baby\u2019s heart begins to beat<\/em><\/a><\/strong><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe district court tread on South Carolina\u2019s sovereign ability to decide for itself the purposes of its legislation, completely ignoring the General Assembly\u2019s clear intent, written in the text of the law, that if any part of the law were held unconstitutional then the remainder would not be invalidated,\u201d Marshall stated.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Planned Parenthood lawyers <\/span><a href=\"https:\/\/illinoisnewstoday.com\/20-states-support-south-carolina-in-abortion-proceedings\/298968\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">have not<\/span><\/a><span style=\"font-weight: 400;\"> responded in court.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The U.S. Supreme Court is slated to soon hear <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/allowing-mississippi-abortion-ban-save-women-babies\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">litigation<\/span><\/a><span style=\"font-weight: 400;\"> from Mississippi addressing the question of at what point during pregnancy a state can restrict abortion. In the meantime, South Carolina Gov.
