A judge in Argentina ruled the country\u2019s recent legalization of abortion violated both the constitution and Argentina\u2019s international obligations, but abortion activists have intervened on preliminary appeal to keep the law in effect.<\/span><\/p>\n

On June 7, Judge Alfredo Eugenio L\u00f3pez, head of Federal Court Number 4 of Mar Del Plata, ordered a suspension of the abortion law. Law 27,610 on Access to Voluntary Interruption of Pregnancy (IVE) came into force on January 24, 2021, after having passed the Senate in December, as Live Action News <\/span>reported<\/span><\/a>. The measure legalized abortion on demand up to <\/span>14 weeks<\/span><\/a> gestation, at which point preborn babies are already well-developed and capable of feeling pain<\/a>.<\/span><\/p>\n

In his ruling, Judge L\u00f3pez argued that the pro-abortion IVE law violated Argentina\u2019s constitution, as well as article 4 of the <\/span>American Convention on Human Rights<\/span><\/a>. The judge cited a ruling from 40 years ago in a case unrelated to abortion that had found that \u201clife is the first right of the human person that is recognized and guaranteed by the National Constitution,\u201d as reported by <\/span>Infobae<\/span><\/a>.<\/span><\/p>\n

The judge also noted the pro-abortion law “would go in the opposite direction to the international obligations assumed by the Argentine State by virtue of the comprehensive protection of the right to life from conception,\u201d as reported by <\/span>El Clarin<\/span><\/a>. Specifically, <\/span>article 4<\/span><\/a> of the American Convention of Human Rights protects the rights of preborn babies:\u00a0 \u201cEvery person has the right to have his life respected. This right shall be protected by law and, in general, from the moment of conception. No one shall be arbitrarily deprived of his life.\u201d Argentina was party to the treaty on the date the agreement was signed in Costa Rica (November 22, 1969) and formally ratified in 1984.\u00a0<\/span><\/p>\n

Minister of Women, Gender and Diversity, Elizabeth G\u00f3mez Alcorta, defended the pro-abortion IVE law as a \u201cdemocratically legitimate norm” which she claimed “has an unobjectionable conventional solidity,\u201d according to El Clarin.\u00a0<\/span>Abortion activists in the national government appealed the ruling to another judge in Mar del Plata, head of Federal Court Number 2, Judge Santiago Mart\u00edn.<\/span><\/p>\n

Last week Judge Mart\u00edn sided with abortion activists and annulled Judge L\u00f3pez\u2019s ruling, arguing that “serious circumstances were found that seriously cast doubt on” the latter\u2019s performance “as an impartial judge in this case,” as El Clarin <\/span>reported<\/span><\/a>. The latest ruling effectively annuls Judge Lopez\u2019s findings and keeps abortion legal in Argentina, pending adjudication by a higher court.<\/span><\/p>\n
