Wade<\/em> is overturned. Governor Greg Abbott signed a bill on Wednesday that would ban abortions if a court ruling or constitutional amendment gives states the authority to prohibit the procedure.<\/span><\/p>\n<p><a href=\"https:\/\/capitol.texas.gov\/BillLookup\/History.aspx?LegSess=87R&amp;Bill=HB1280\"><span style=\"font-weight: 400;\">House Bill 1280<\/span><\/a><span>, known as a \u201ctrigger law,\u201d would take effect 30 days after <em style=\"font-weight: 400;\">Roe v. Wade<\/em> is\u00a0overturned. The\u00a0landmark Supreme Court ruling of 1973, with its partner decision <em style=\"font-weight: 400;\">Doe v. Bolton<\/em>, legalized abortion through all nine months of pregnancy across the U.S.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Texas legislation would outlaw almost all abortions and contains an exception if the pregnant woman has a life-threatening condition that places her \u201cat risk of death or poses a serious risk of substantial impairment of a major bodily function unless the abortion is performed or induced.\u201d However, in reality, the deliberate killing of a preborn child is <a href=\"https:\/\/archive.liveaction.org\/news\/pro-life-replies-abortion-never-medically-necessary\/\">not medically necessary<\/a>.<\/span><\/p>\n<p><strong>READ:\u00a0<em><a href=\"https:\/\/archive.liveaction.org\/news\/texas-abortion-law-rape\/\">Texas abortion law doesn\u2019t include a rape exception. Here\u2019s why.<\/a><\/em><\/strong><\/p>\n<p><span style=\"font-weight: 400;\">The legislation would also make it a second-degree felony to commit or attempt to commit an abortion. If the preborn child dies, the penalty would be increased to a first-degree felony, potentially resulting in a life sentence. In addition, abortion providers could also lose their licenses and face fines of more than $100,000 for each violation.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Just weeks ago, Gov. Abbott <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/texas-heartbeat-act-governors-desk\/\"><span style=\"font-weight: 400;\">signed into law<\/span><\/a><span style=\"font-weight: 400;\"> the Texas Heartbeat Act, which prohibits all elective abortions after a preborn child\u2019s heartbeat is detectable. The new heartbeat law is set to go into effect at the beginning of September.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe heartbeat bill is now LAW in the Lone Star State,\u201d Gov. Abbott <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/texas-heartbeat-act-governors-desk\/\"><span style=\"font-weight: 400;\">stated in a tweet<\/span><\/a> at the time<span style=\"font-weight: 400;\">. \u201cThis bill ensures the life of every unborn child with a heartbeat will be saved from the ravages of abortion.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The legislation emerged just following the U.S. Supreme Court&#8217;s <a href=\"https:\/\/archive.liveaction.org\/news\/mississippi-15-week-abortion-ban-supreme-court\/\">decision to hear a case<\/a> involving Mississippi&#8217;s 15-week (four month) abortion ban known as the &#8220;Gestational Age Act, <a href=\"https:\/\/legiscan.com\/MS\/text\/HB1510\/id\/1692666\">HB 1510<\/a>. <\/span><span style=\"font-weight: 400;\">The case, <\/span><em><a href=\"https:\/\/adfmedia.org\/case\/dobbs-v-jackson-womens-health-organization\"><span style=\"font-weight: 400;\">Dobbs v. Jackson Women\u2019s Health Organization<\/span><\/a><\/em><span style=\"font-weight: 400;\">, gives SCOTUS the opportunity to reconsider <em>Roe v. Wade<\/em> as well as <em>Planned Parenthood v. Casey<\/em>, the 1992 Supreme Court case that affirmed <em>Roe v. Wade<\/em> and set viability as the standard after which abortion can be restricted.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Arguments will likely be heard in the fall of 2021 and a decision on the case is expected by the summer of 2022.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If <em>Roe<\/em> is <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/roe-v-wade-happens-overturned\/\"><span style=\"font-weight: 400;\">eventually overturned<\/span><\/a><span style=\"font-weight: 400;\">, Texas would be one of the first states where nearly all preborn children would be protected by law and abortion would be effectively prohibited. <\/span><a href=\"https:\/\/www.nytimes.com\/interactive\/2021\/05\/18\/upshot\/abortion-laws-roe-wade-states.html\"><span style=\"font-weight: 400;\">Several<\/span><\/a><span style=\"font-weight: 400;\"> others states have similar \u201ctrigger laws,\u201d including Arkansas, Idaho, Kentucky, Louisiana, Mississippi, North Dakota, Missouri, Tennessee, South Dakota, and Utah.<\/span><\/p>\n<p style=\"text-align: center;\"><em><strong><a href=\"https:\/\/www.facebook.com\/liveactionnewsonline\/\">\u201cLike\u201d Live Action News on Facebook<\/a> for more pro-life news and commentary!<\/strong><\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Texas has joined a growing number of states seeking to ban abortion if Roe v.
